December 13, 2022 - Permit to Construct 7803-LCID-2022 4 Acre expansion; Permit to Operate current 3 Acre LCID (this was reissued to address wording and some issues with 3/17/2022 PTC/PTO.) PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The purpose of this visit was to do a comprehensive inspection of the Robeson County Landfills. An operator was onsite during the inspection visit. This previous NLCID had been approved for an additional One (1) acre of LF added to the Two (2) acre, total of Three (3) acres, notification on October 18, 2018, by the Section, due to increase demand from recent hurricanes. A PTC/PTO was issued on 3/17/2022 for continued operations in the current 3-acre section and to allow for construction of the additional 4-acre section, permitting the LCID. Construction has not begun on these additional acres. A preoperational inspection will be needed, along with other conditions met, before operations can begin in the new 4-acre section once constructed, and the LCID will total 7 acres. Discussion onsite was that expansion construction is expected soon. 2. Site is gated, fenced and now has proper signage. Ms. Kristina emailed copies of new signs for CDLF, MSWLF and LCID that were installed at each access road to the working face of each landfill. LCIDs sign was recently run over and will need to be replaced. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 3. The LCID working face was reaching max size. Waste was being compacted and no unapproved wastes were visible. Cover logs, although not required, were kept by Robeson County, good job. Be sure all waste is covered when reaching one acre in size or monthly, whichever comes first. Some waste was not covered on inside corner on east side. Please cover, slope 3:1. Good job. Access roads were of all-weather construction and went around almost the entire perimeter. Roads need to meet rule but would be counterproductive when site is awaiting to be constructed for new LCID expansion. Either site needs to begin construction and add the roads around 7 acre site or current site needs to meet rule. Either way a perimeter road is needed surrounding LCID of all-weather construction. 15A NCAC 13B .0566 (7) Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles. Mulch has been used for erosion control, slope stabilization and to encourage vegetation as a top dressing. On south slope mulch is much too deep. Max depth should be 3 inches. Either cover appropriately as waste or spread out the mulch for approved uses. South slope of LCID with thick mulch on side slopes. 6. Eastern slope was well covered, sloped and vegetation taking hold. Good job. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 6 of 7 7. In front of working face was a low area, just beside the western road access. Water has been pooling here and there is much mud present. Please address by covering to slope to prevent water impounding over waste but restrain erosion as it runs offside slopes. 15A NCAC 13B .0566 (8) Surface water shall be diverted from the working face and shall not be impounded over waste. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 7 of 7 8. West side slope well sloped and covered and vegetation taking hold. 9. As a reminder, any changes to the facility or operations plan should be submitted to Section permitting for approval before they are enacted. 10. Corrective measures are necessary as result of this inspection. A follow up inspection will be conducted by Solid Waste Section Staff in about 30 days from the inspection sent date.
