PURPOSE OF SITE VISIT: Follow-Up Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: A. 15A NCAC 13B .0105 (4), “The vehicle or container body, waste holding area, and hopper, if so equipped, shall be free of holes, cracks, rusting, corrosion, or other evidence of damage or weakness that may allow the escape of solid, semi-solid, or liquid waste.” PARTIALLY RESOLVED: At the time of this inspection, new metal siding had been added to the northside wall of the transfer station building to repair damage noted in the previous inspection. However, significant damage, in the form of a new large gaping hole, was now present on the northside exterior wall adjacent to the trailer loading bay exit. Mr. Wendt stated that the new damage was sustained from high winds during a severe weather event on 8/7/2023. Mr. Wendt stated that the damage should be repaired within a week’s time. Mr. Davis requested that pictures be sent to him of repaired metal siding, once completed. Ensure damaged metal wall panels are repaired or replaced to prevent the escape of waste or leachate outside the contained area. Temporary measures must be installed to ensure the integrity of this facility and the ability to contain waste and leachate as required. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 B. 15A NCAC 13B .0405 (b), “Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line.” RESOLVED: A sampling plan and supporting documentation was submitted to and approved by the Section, affected soils were removed, and subsurface soils were satisfactorily sampled and analyzed. Connal Boyd, Section Hydrogeologist, approved the sample results in an email dated 8/2/2023. Mr. Wendt stated that he and Republic Services staff have discussed installing a concrete berm at the entrance and exit of the transfer trailer loading bay as a permanent leachate containment measure but have not yet chosen to move forward with this project. ADDITIONAL COMMENTS The facility is a waste transfer station operated by Republic Services of North Carolina, LLC and is permitted to receive municipal solid waste, construction and demolition waste, inert debris, land clearing debris, and asphalt generated in Wake, Johnston, Durham, Granville, Franklin, Nash, Harnett, Lee, Chatham, and Orange Counties. Incoming loads of MSW and C&D waste are not segregated but combined into transport trailers for disposal at an MSWLF. Stella Environmental Services is subcontracted to perform the daily operations of the transfer station. 1. The facility permit, operations plan, waste screening logs, and training records were not reviewed during this inspection. 2. The facility access roads consist of a gravel aggregate base and are of all-weather construction. Several potholes containing standing water were observed within the gravel access roads and outside the trailer loading bay exit. Mr. Wendt stated that the transfer station received 0.5 inches of rain just prior to this inspection, thus resulting in standing water within low-lying areas. It is recommended that the access roads be graded and repaired as needed to prevent standing water. 3. The waste on the tipping floor is being managed in accordance with the facility permit and approved operations plan. No unacceptable wastes were observed at the time of the inspection. 4. Mattresses are separated from incoming loads and hauled to South Wake MWSLF (Permit# 9222) for disposal. 5. Leachate ponding observed on the tipping floor during the previous inspection was greatly reduced, and typical of a day’s operation. Mr. Wendt stated that the drainage system was recently discovered to have a ninety-degree turn within the piping and was hydro jetted from both ends to ensure a complete cleanout, allowing the drainage . Continue to ensure all drains are clear and in free-flowing condition. The drains should be cleaned and maintained as necessary to ensure that they are functioning as designed. 6. Facility grounds were relatively clean and free of windblown waste, which was actively being picked up during this inspection. Waste observed outside of the fencing to the north and east of the facility during the previous inspection had been picked up. Continue to ensure windblown waste is picked up and properly disposed of at the end of each operating day. 7. During this inspection, the stormwater catch basin adjacent to the transfer trailer loading bay exit, as well as the northwestern stormwater catch basin and drainage ditch was overgrown with vegetation and in need of mowing. It is recommended that all stormwater management and drainage features are mowed and maintained as necessary to ensure that they are functioning as designed. 8. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
