Facility Permit 51-03 is a combination of facility permits 51-01 and 51-02. Permit to Construct Johnston County MSW Landfill, Phase 6 issued May 8, 2020. Permit to Operate 5103-MSWLF Phase 4A and 5103-CDLF Area 2 Cells 1 and 2 issued May 8, 2020. Permit for Closure for MSW Phases 1 through 4 and C&D Area 1 issued May 8, 2020. Life of Site Permit for 5103-MSWLF and 5103-CDLF issued May 8, 2020 and will expire August 8, 2057. Permit to Construct Johnston County MSW Landfill Phase 6 issued November 30, 2021. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS On August 9, 2023, Mr. Brian Beasley contacted Ms. Thompson at 1350 to report that a leachate release had occurred at approximately 1140 during the replacement of leachate pump along the northern side slope of the closed CDLF. A flange had failed which had caused the leachate to leave the collection system. The leachate release was reported to Mr. Eddie Overby by an on -site contractor. Mr. Overby contacted Mr. Andrew Braswell to have equipment brought over to the release. The leachate release was stopped, and work began immediately to remove the leachate and impacted soils. Ms. Thompson arrived on -site to inspect the release at 1515. Ms. Thompson had observed that a soil berm had been built to contain an area of leachate adjacent to the pump. The impacted soil in the roadway had been removed and the area repaired. Ms. Thompson observed Mr. Braswell actively removing impacted soils from the sediment basin. Mr. Beasley and Mr. Overby explained that the leachate had flowed from the failed pump, along the roadway to a low spot and into the sediment basin but did not leave the basin. The leachate release and cleanup activities were discussed with Mr. Drew Hammonds, Eastern District Supervisor. Due to Johnston County quickly stopping and beginning the cleanup of the leachate release, it was determined that Johnston County would not need to sample the soils from the release. Ms. Thompson also stated to Johnston County that the soils excavated from the area could be utilized as cover soils on the interior active working face. On August 11, 2023, Mr. Overby contacted Ms. Thompson to inform her that the work had been completed prior to 0800 on August 10, 2023. The soils had been excavated to a depth of 18-inches and placed at the working face. Mr. Overby provided Ms. Thompson with a copy of the Johnston County Incident Report on August 14, 2023. SMITHFIELD, N.C. 27577 (919)938-4750 INCIDENT REPORT Leachate Pump Malfunction 8/9/2023 On 8/9/2023 repairs were being make to the C&D Leachate Pumping Station. Pump #2 had been giving trouble and a new pump was installed. At approximately 11:30am Facility Maintenance Supervisor, Brian Stephenson, left the Pumping Station to take his temporary workers to lunch and return to the station. As he was enroute back to the station a call was made pertaining to leachate spilling onto the road. An inspection at the pump and lines revealed that a clamp broke, separating the line from the fitting thus Leachate pumped out of the containment system. Picture #2 shows leachate soil removed new soil and rocks applied to the area. 1 Incident Report— Pump 8/9/2023 11:41 am Travis, employee of Thale Construction, called and reported leachate spilling onto the road at C&D Pump Station. 11:45 am Johnston County Landfill Staff arrived to the area and begin to assess what needed to be done. 11:50 am Supervisor, Andrew Braswell, called Thale Construction Supervisor, Aaron for assistance/use of their operator and dozer which was in the area to help contain the leachate. 12:07 pm Operator and dozer began banking up the soil to contain the leachate runoff. 7 i. -,� . .r - _ 2 Incident Reoort — Puma 8/9/2023 12:30 am The Puma Truck was used to remove leachate once it was rounded into a pool. This was the second time the pump truck was used to remove all the liquid from the area. (Vote: The leachate that was removed by the pump truck was taken to the waste treatment plant. 1:U0 pm Johnston County Staff began removing all contaminated dirt from the area. Fresh dirt was used to replace the contaminated soil and absorb any additional leachate. 8/10/2023 6:30 am All contaminated dirt was removed and taken to Cell 5.
