Post-closure care shall …consist of the following: maintaining the integrity and effectiveness of any cap system, including making repairs to the cover as necessary to correct the effects of settlement, subsidence, erosion, or other events, and preventing rainwater that drains over land from or onto any part of the facility or unit from eroding or damaging the cap system;” Unresolved-corrective measures are underway. OBSERVED VIOLATIONS: 1) 15A NCAC 13B .1627 (d)(1)(A) states “Following closure of each MSWLF unit, the owner or operator shall conduct post-closure care. Post-closure care shall …consist of the following: maintaining the integrity and effectiveness of any cap system, including making repairs to the cover as necessary to correct the effects of settlement, subsidence, erosion, or other events, and preventing rainwater that drains over land from or onto any part of the facility or unit from eroding or damaging the cap system;” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 6705_INSP_20230809 Page 2 of 6 Please see the ADDITIONAL COMMENTS section below for details concerning the violation(s) listed above. ADDITIONAL COMMENTS: 1) This facility is a closed MSW Landfill, a closed Asbestos Waste Disposal Site and a Landclearing and Inert Debris (LCID) Landfill. 2) The site is secured by a locked gate at the facility entrance. 3) Proper signage is posted at the entry gate stating the permit number and facility contact information. 4) The facility access road is of all-weather construction and appears well maintained at this time. 5) This facility manages Landfill Gas (LFG) through a collection system which is plumbed to the adjacent active Onslow County MSW Landfill, permit #67-09 for use at the onsite Onslow Power Producers/Cube District Energy llc LFG-to-energy plant. The LFG collection system appears well maintained at this time. 6) Facility monitoring wells were reviewed. All reviewed wells were properly secured and labeled. 7) The closed asbestos disposal cell was reviewed. Overall, this area has a well-established cover crop of native warm season grasses. The cover crop is mowed throughout the year as needed. 8) Wetlands dependent vegetation was observed growing in an area near the western end of the asbestos disposal cell. The presence of these types of vegetation indicate that this area is restricting the flow of surface waters which is causing ponding. *Plans need to be underway for the filling and grading of this area to promote the positive flow of surface waters away from the asbestos disposal cell. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 6705_INSP_20230809 Page 3 of 6 9) Permanent, highly visible Edge-of-Waste markers delineating the waste disposal boundary have been installed in portions of the landfill. *Please ensure the waste disposal footprint is accurately delineated throughout the entire facility. 10) Overall, this facility has a well-maintained cover crop of native warm season grasses, however, areas of sparse cover and erosion were observed throughout the Facility. *Within thirty days of receipt of this facility compliance inspection report, please repair any erosion found in these areas, grade at a slope not greater than 3:1 and then seed and mulch all areas of sparse cover to establish a cover crop suitable to prevent erosion of the landfill cap system. Application of topsoil or other soil amending material may be necessary in these areas. Soil sampling and nutrient analysis may be beneficial to determine the necessary steps needed to establish and support a healthy cover crop. 11) Erosion and differential settlement repairs have been partially completed. However, significant erosion of the repaired area has occurred on the southern sideslope. *Within thirty days of receipt of this facility compliance inspection report, please repair the eroded repair areas, grade at a slope not greater than 3:1 and then seed and mulch to establish a cover crop suitable to prevent erosion of the landfill cap system. Moving forward, all repaired areas should be seeded and mulched promptly upon completion of any repair project. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 6705_INSP_20230809 Page 4 of 6 12) Off-site erosion was observed on the southern sideslope downslope of the eroded repair area. Sedimentation was observed outside of the waste disposal area and in the surface water ditch. The siltation control fencing placed downslope of the repair has been over-washed by surface waters and sediment. *Within thirty days of receipt of this facility compliance inspection report, please remove all sedimentation found outside the permitted disposal area and return it to the repair project area. 13) The areas of differential settlement and erosion that were previously observed on the northern and southern outside slopes and documented in previous facility compliance inspection reports have been filled and graded but were noted during this facility compliance inspection as still lacking a groundcover suitable to prevent erosion of the landfill cap system. Erosion of the repairs has occurred and sediment has been conveyed to the toe of these slopes. *Within thirty days of receipt of this facility compliance inspection report, please repair FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 6705_INSP_20230809 Page 5 of 6 these eroded areas. After completing these repairs, seed and mulch all repaired areas to establish a groundcover suitable to prevent erosion. 14) Areas of seeping leachate were observed in some of the eroded areas on the southern and eastern sideslopes. No leachate from these seeps was observed leaving the permitted disposal footprint of the landfill. *Within thirty days of receipt of this facility compliance inspection report, please repair the landfill cap system in all seeping areas. The repaired areas should be graded at a slope not greater than 3:1, seeded, and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. Please monitor all repaired areas for continued seeping. Any areas where leachate continues to seep should be addressed promptly to prevent the release of leachate outside the permitted disposal boundary. Moving forward, please ensure these areas and all landfill sideslopes are maintained at a slope not greater than 3:1 to promote the positive flow of surface waters from the landfill disposal boundary. Areas of differential settlement should be repaired promptly to prevent the ponding of surface waters. 15) Heavy equipment traffic along the toe of the eastern sideslope has caused differential compaction along the eastern landfill boundary, damaged the cover crop, and damaged the landfill cap system. *Within thirty days of receipt of this facility compliance inspection report, please repair the damage that has occurred to landfill cap system in this area and grade the area to promote positive drainage of surface waters away from the landfill. Moving forward, please restrict heavy equipment from this area until a road suitable to support this use has been constructed.
