Julie Cooley; Robert Cooley; Arnold Tucker; Linda Buckner; Barbara Ball; James and Susan King 441 V S Dalton Road Rutherfordton, NC 28139 RE: Notice of No Further Action 15A NCAC 2L .0407(d) Risk based Assessment and Corrective Action for Petroleum Underground Storage Tank Lake View Grocery 2655 Memorial Highway Lake Lure, Rutherford County, North Carolina (ARO) Incident #28992 Risk/Rank: Low Dear Property Owners: This letter is to inform you that the State’s Division of Waste Management, Underground Storage Tank Section is providing Public Notification of a Notice of No Further Action concerning an environmental cleanup near your property in Lake Lure. During a site inspection at the Lake View Grocery in 2012, a petroleum release was detected near one of the underground storage tank’s vapor recovery units. A Limited Site Assessment was conducted, and the groundwater results did not exceed the standards or interim standards established in 15A NCAC 2L .0202. However, a soil sample collected near the vapor recovery unit exceeded state action levels. On March 8, 2021, a Notice of Residual Petroleum with land use restrictions on the soil was placed on the referenced property deed. Based on information provided to date, the UST Section finds it appropriate to classify the risk of the discharge or release as low. Furthermore, the UST Section determines that no further action is warranted for this incident. A copy of the No Further Action letter is attached.
