HomeMy WebLinkAboutAS-1434_15292_C_NFA_20230711_Ingles Admin Closure North Carolina Department of Environmental Quality | Division of Waste Management UST Section Central Office | 1646 Mail Service Center | Raleigh, NC 27699-1646 | (919) 707-8171 July 11, 2023 MEMO TO FILE RE: Notice of No Further Action 15A NCAC 2L .0407(d) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Ingles Warehouse, Releases 10059, 15292, and 16784 HWY 70, Black Mountain, Buncombe County, NC In January 1993, July 1996, and October 1996, releases were reported from the former UST systems at the subject site. Based on this information, the UST Section finds it appropriate to classify the risk of all the former discharges or releases as low and that no further action is warranted for any of these incidents. However, Ingles has indicated that they do not want a Notice of Residual Petroleum and have agreed to quarterly sampling of the site under incident #10059. As such, incidents 15292 and 16784 are being administratively closed. This determination shall apply unless the UST Section later determines that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment.
