Please see observed violations for details. OBSERVED VIOLATIONS: 1) The 10,000-gallon tank appears to be in the beginning stages of rusting out near the top. Please repair the tank as needed to ensure compliance with 15A NCAC 13B .0838(c), which states that "containers... shall be free of evidence of damage or weakness such as holes or cracks that may allow the escape of septage." 2) Lettering on the signage is faded and should be repaired as noted in the previous inspection report. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Pagel of 3 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section ADDITIONAL COMMENTS 1) This facility consists of one 10,000-gallon and two 20,000-gallon above ground metal tanks with a total capacity of 50,000 gallons for the storage of domestic septage (including portable toilet waste) and grease trap pumpings. 2) 15A NCAC 13B .0838(b): The access road is well maintained as required. 3) The 10,000-gallon tank appears to be in the beginning stages of rusting out near the top. Please repair the tank as needed to ensure compliance with 15A NCAC 13B .0838(c). 4) No vectors were noted at the time of inspection, complying with 15A NCAC 13B .0838(e)(2). 5) NCAC 13B .0838(g): No odors were noted around the tanks. 6) 15A NCAC 13B .0838(i): Vegetation was not present within 5-feet of the tanks. 7) Appropriate signage was posted at the entrance to the site per 15A NCAC 13B .0838(k); however, the lettering is faded and should be repaired as noted in the previous inspection report. 8) 15A NCAC 13B .0838(m): Setback requirements appear to have been met.
