A release of petroleum hydrocarbons was discovered at the site on October 11, 2002. The UST Section determined that Handy Mart of Liberty, Inc., owned and operated the UST system at the time the release was discovered. Handy Mart of Liberty, Inc., has been administratively dissolved and the UST Section and the project is being accepted by the State-Lead program for inclusion on the list of releases awaiting further assessment and remediation pursuant to G.S. 143-215.94G. Due to the potential risk to receptors within 1500 feet of the release and based on the contamination remaining at the release location, the risk of this release is characterized as "High". Additional assessment and necessary remediation will be initiated as funds become available. The State-Lead Program contractor must access the property to conduct assessment and remediation activities. Pursuant to G.S. 143-215.94A, based on the information currently available in our files you will not be responsible for this work. The UST Section would appreciate your permission to enter your property to conduct necessary assessment and cleanup activities. Please note that pursuant to 15A NCAC .0106(b), failure to allow the UST Section and/or their contractor to access your property may result in a determination that you are controlling an activity which results in the discharge of waste, and you may potentially be held responsible for assessment and cleanup of the contamination. Please review and sign the attached access agreement. Please indicate on the access agreement whether you wish to be notified before assessment and/or cleanup activities begin.
