According to the available information, this property was used as a gas station from approximately 1965 to the 2018. The information regarding the petroleum release indicates a release from the UST system was identified and confirmed in 2001. The Holding Brothers, LLC were the owners at that time and responsible for the addressing the release. The Holding Brothers, LLC dissolved in 2003. United Oil of the Carolinas, Inc. acquired the property/tank systems and maintained operations until 2017 when the tanks systems were placed in temporary closure. The tank systems were permanently removed in October 2018 by United Oil of the Carolinas, Inc. Residual soil contamination was confirmed in the closure but it could not be determined whether the soil contamination was due to the original 2003 release or to a new release. The property was then sold to 2418 North Main, LLC which then sold/transferred the property to Cook Out-Cotton Grove, Inc. October 2020. Due to the documented presence of residual contamination of both the soils and groundwater at the referenced property, further assessment and possible remediation may be necessary. Based on the information available, you, as the current owner of the property would not be considered the owner or operator of the tank(s), and therefore, not responsible for the release associated with the original USTs in accordance with G.S. 143-215.94A. To determine the risk posed by the contamination at the subject property, the UST Section needs to access to the property to take all reasonable and necessary action(s) to conduct assessment and remedial activities necessary to protect human health and the environment. Please sign the attached site access agreement letter and return it to the address indicated on the letter. Please understand that failure to allow access to the property could potentially make the property owner responsible for cleanup under other State and Federal regulations.
