Dear Mr. Patel:
The Winston-Salem Regional office of the North Carolina Underground Storage Tank (UST) has recommended that the referenced site be accepted in to the State Lead Clean-up Program. The purpose of this letter is to explain an alternative to Rey Petroleum, LLC. Save More, Inc., applied for eligibility to receive reimbursement
from the North Carolina Leaking Petroleum Underground Storage Tank Trust Fund for the incident. In a letter dated October 17, 2008, Save More, Inc., was determined to be eligible for reimbursement from the Fund with a $20,000 deductible. Save More, Inc., submitted two reimbursement claims for work completed at the site, has
satisfied the $20,000 deductible, and remains eligible for reimbursement from the Fund. Save More, Inc., is able to waive its right to receive reimbursement and transfer its eligibility to Rey Petroleum, LLC. If Save More, Inc., agrees to transfer the eligibility to the Fund, Rey Petroleum, LLC can be reimbursed for reasonable
and necessary costs incurred on the project directly from the Fund. Rey Petroleum, LLC would not be required to pay any additional deductible. A notarized statement from both parties is sufficient to transfer eligibility. The currently eligible party must simply state that they agree to transfer their eligibility to the new tank owner or operator, and agrees to not submit any additional claims.
