The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. At this facility there are two notified LCID landfills, N1089 upfront, and N1104 in rear. The rear N1104 only reached about ~ 1 acre in size. Site has been closed to the public and no waste dumped in sometime. Has become overgrown. Both sites need mowing and proper cover to meet rule. The notified sites were located
on separate parcels and meet all required property line buffers back in 2019. A surveyor is pending to confirm all Harris trucking NLCIDS proper size, corner markers installed, buffers etc., according to Mr. Johnny Harris.
2. According to the new LCID Rule 15A NCAC 13B .0563(6), effective January 1, 2021, the notification facilities have to be either closed out or converted into a permitted facility by January 1, 2026. Mr. Powell and Mr. Johnny Hariss discussed closure while onsite. Copies of newest LCID rules and closure letter sent by Edward Mussler, Solid Waste Section Chief for DEQ, dated 10/6/2021 will be sent with this inspection report via email attachment.
3. The edge of waste markers (EOW) were in place on some corners but missing on others. Mr. Powell discussed reinstalling the corner markers that were missing in correct locations and upgrading for high visibility. Suggest tall white PVC pipe. One should be visible to the next. Please ensure all waste is inside of two-acre
footprint and correct buffer distance from property lines.

4. Some exposed waste was observed when walking on top and around both N1089 and N1104. Vegetative cover
has become overgrown and difficult to see exposed waste. Please mow and cover according to rule. If not using the NLCIDs, then they should meet intermediate cover requirements until full closure.
15A NCAC 13B .0566 (3) - All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.
15A NCAC 13B .0566 (4) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with
vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community.
5. Although slopes looked to be good or close to 3:1, there was some erosion rills present around toe of slope, and both NLCIDs needed additional cover. After proper mowing, covering with soil, be sure and slope appropriately, while keeping waste inside the 2-acre EOW and buffers. Side slopes shall be maintained at no steeper than a 3 to 1 ratio. 6. Both NLCIDs need access surrounding entire waste boundary of all-weather construction. 15A NCAC 13B .0567 (c) Post-Closure Care Requirements - (1) Following closure of the site, the owner or operator shall conduct post-closure care in accordance with the closure and post-closure care plan incorporated into the permit and the following requirements: (C) maintenance of vehicle and fire-fighting lanes to allow access to the entire waste boundary of the site;

7. If owners choose to close the NLCIDLFs, then the NLCID waste must be inside the two-acre notification, meet buffers, be compacted, covered with at least 12 inches of soil, all weather access surrounding the landfill and sloped 3:1. A follow up will be needed to ensure buffers are met and waste is inside the EOW for the two-acre approved disposal area. Once site meets rule requirements, then to finalize closure, the Section requires:
• A cap survey and PLAT map is required to be completed, by a land surveyor, with their name and company name, official stamp and signature, certifying that at least one foot of suitable soil cover has been placed over the entire landfill, utilizing 4 random test holes per acre.
• Photos of test holes, GPS location of each bore hole, also referenced on the cap survey/PLAT map.
• The survey should be recorded with the County Register of Deeds and documentation provided.
• A letter to the Section stating that the owners, “Request closure and have completed the corrective actions in recent inspections.” In addition, this letter should include the name of the facility, notification number, owners name, return mailing address and contact information and be signed by the landowner.
• Digital copies of all these items should be emailed to Section/David Powell via email. 8. For permitting or closure requirements questions please consult the Sections Permitting Branch Head Sherri Stanley, sherri.stanley@deq.nc.gov or (919) 707 – 8235. Section assigned permitting engineer for Moore County was Mr. Ming Chao, who is now retired, and so all correspondence should go to Sherri Stanley until she delegates those duties to another in Section permitting. 9. Corrective measures are necessary as a result of this inspection and should be met within 60 days receipt
of this inspection. Failure to meet the conditions for compliance may result in Compliance Actions. A follow-up inspection in the future will be needed to confirm the corrective actions have been taken. Given the nature of the situation and the corrective actions, it may take longer time. If additional time is needed, please communicate with Mr. Powell, and discuss before the end of the deadline timeframe.
