The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This facility is permitted as a land clearing and inert debris treatment and processing facility to receive land clearing debris, untreated and unpainted wood waste, uncontaminated wood pallets, and uncontaminated soil. The facility does not accept or process inert debris at this site. 2. Composting is not permitted at this site. 3. The facility's Permit to Operate and approved Operations Plan are maintained at the office located next to the site and are available for review upon request. 4. A review of the 2022-23 Facility Annual Report indicated that the facility accepted 105 tons of wood waste material during the reporting cycle. 5. The site is secured through a perimeter fence and berms with site access secured through a locking gate and large concrete blocks. 6. Signs are posted at the site entrance and provide the information required in the permit. 7. The site was in good condition and was observed o be well maintained with no windblown material on site. 8. The facility roadways are of all-weather construction. The roadway is constructed of gravel and in good condition. 9. The site buffers were observed and appeared to meet all conditions set in the permit. 10. The facility continues to not accept material from the public, only accepting material from Lowder land clearing sites. 11. Facility staff also stated that the facility has stopped selling mulch to the public as of July 6, 2023. 12. Only one small windrow of processed wood waste was located on site. 13. The unprocessed wood waste was stockpiled Northwest of the windrows. The stockpile was approximately 211' long, 50' wide, and 15' in height. The wood waste stockpile has expanded from the last inspection. 14. Wood waste was observed, and no unacceptable material was found. 15. A collection of large concrete rubble and a small pile of clean rock was observed just South of the wood waste stockpile. No unacceptable material was observed. 16. The site is designed to direct stormwater runoff to two check dams located along the western side if the facility. No ponding water was observed on or near the processed and unprocessed wood waste. 17. The site continues to focus on the clean soil side of the operations. Large stockpiles of clean soil were observed on the Western edge of the property as well as on the Northern side of the property.
