Life of Site Permit issued March 31, 2020 and will expire April 17, 2057. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A NCAC 13B .0405 (b), "Water that comes into contact with solid waste is leachate and shall be collected from the site for disposal to an approved facility or discharged directly from the site into a sanitary sewer line." The Harnett County Anderson Creek C&D Landfill is in violation of 15A NCAC 13B .0405 (b) in that leachate has not been contained on -site. During the inspection, leachate was found to be pooling at the drainage pipe near the western end of the working face. The leachate followed the drainage ditch and into the sediment basin. The leachate had mixed with the standing water within the sediment basin. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility is fenced and is secured by a locking gate when it is not open for operation. 2. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 3. The facility accepts waste Monday, Tuesday, Thursday, and Friday from 7:30 am until 4:00 pm, and Wednesday and Saturday from 7:30 am until 12:00 pm. 4. Digital pictures were taken during the inspection. C&D Landfill 5. The facility is permitted to receive C&D waste generated in Harnett County. 6. The cover log was verified through July 14, 2023. 7. The working face was approaching the '/2 acre size limit. Six (6) inches of earthen material should be properly applied once weekly or when the working face reaches % acre. The cover log was verified through July 14, 2023. Continue to ensure that the working face is covered with six inches of soil weekly or when the working face reaches '/z acre in size, whichever occurs first. 8. At the time of this inspection, the waste type was identified to be construction and demolition waste. No unacceptable wastes were observed within the waste stream. 9. No areas of standing water were observed on the top of the CDLF Phase I and II. 10. The sediment basin has been cleaned since the last inspection; however, leachate-stained soils were observed within the basin. The side walls were vertical with little to no vegetative cover. Several areas of the vertical side walls have sloughed off into the basin. The side slopes of the sediment basin should be graded to a three horizontal to one vertical to allow for proper maintenance of the sediment basin. 11. 15A NCAC 13B .0542 (k), "Erosion and sedimentation control requirements. Erosion control measures consisting of vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the site and to prevent on -site erosion, and shall comply with 15A NCAC 04, which is incorporated by reference including subsequent amendments and editions." Erosion control measures, to include, vegetative cover should be utilized at the facility to prevent the erosion of new cells, sediment basins, and any additional areas which are experiencing erosions issues. It is recommended that the facility is constructed and maintained in accordance with the sedimentation and erosion control and operations plans. 12. Edge of Waste (EOW) markers were observed around the CDLF. 13. The CDLF was in need of mowing. The brush hog was enroute from the Dunn -Erwin facility to the Anderson Creek Facility for the purpose of mowing the CDLF. Ensure that the landfill areas are mown as often a necessary to allow for proper inspection. 14. A perimeter road has been established around the entire footprint of the landfill. There was one large static pile of unground land clearing/yard waste and one windrow of ground yard waste. The larger pile should be managed to allow for positive drainage of surface water. 16. An area of stained soils was observed in the natural drainage feature from the yard waste storage area towards the grassy area to the east of the pile. Areas impacted by leachate may require excavation and assessment. This area should be graded to promote positive drainage of surface water away from the windrows. 17. The waste stream was relatively clean with minimal unacceptable wastes. 18. Continue to manage the yard waste area in accordance with the permit and approved operations plan.
