OBSERVED VIOLATIONS: NA
` ADDITIONAL COMMENTS
1. Staff, with the Section, visiting Yard Waste Notification (YWN-26-007), also IS262109, for a follow up inspection to verify corrective actions have been completed for this site. All waste has been removed from site, weight tickets documentation and City of Fayetteville “in house” tracking excel spreadsheet, to document loads each day, have been submitted. Waste ended up at Ann St. Landfill. All violations have been resolved, Yard Waste Notification is now considered CLOSED, and no longer can accept waste. To do so may be
considered in violation of General Statutes or NC state rule. Discussions onsite and after inspection consisted of what the site can be used for, considering the PRLF underneath the entire limits of the parcel. Solid Waste Section no longer has any regulations relevant with site. Yard Waste and yard trash should not be
brought to site, or any other waste type, even temporarily. City staff should contact PRLF Group for what can be done on top of the PRLF. Please be sure not to disturb cap of the Pre-Regulatory Landfill. Contact Ryan Channel for any requirements associated with the PRLF, if not done so already, at ryan.channell@deq.nc.gov or 919-707-8333. A Notice of Violation Resolution Letter is forthcoming. 2. It would be recommended to simply install signage at entrance/onsite for all to see entering Milan yard that no waste shall be dumped, staged or left onsite as well as no digging onsite. In addition, street sweepings have made it to this site in the past and should be taken to a Lined MSW for disposal. This will help to ensure compliance in future as time goes by and this fact is not forgotten with staffing changes etc. This would also help keep the cities property clean. 3. Ms. Sheila Thomas-Ambat was sent copies of 15A NCAC 13B .1401-.1410 rules and link to YWN closure from submittal on the NCDEQ Waste management website. Please be sure and complete this closure form for our records ASAP. Also please notify staffing inside City of Fayetteville who submits YW renewals yearly to not submit a notification or renewal for this site in the future.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
