RESOLVED: 15A NCAC 13B .1626(7) states that `Erosion and sedimentation control requirements. Erosion control measures consisting of vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the site and to prevent on -site erosion, and shall comply with 5A NCAC 04, which is incorporated by reference including subsequent amendments and editions." During the inspection, the northern and western side slopes of the active landfill were observed to have been regraded. A berm had been constructed on the top of the side slopes and vegetation had been established. OBSERVED VIOLATIONS: None. Page 1 of 3 NORTH CARnLINAD_E Q�� OepaNnent W Environnnnbl puel� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility is composed of a closed MSW landfill, a scrap tire collection area, a white goods collection area, scrap metal collection area, a collection and processing area for concrete, asphalt, and brick (CAB), and an active, lined MSW landfill. 2. The facility has a convenience center located west of the scale house. The convenience center appeared to be clean and well maintained. Mr. Dively stated that the area is staffed by the county. 3. Proper signage was observed at the facility entrance. 4. The facility access roadways were in good condition and are of all-weather construction. The main roads at the facility are constructed of asphalt with the rest of the facility roadways being constructed out of CAB material processed on site. 5. The facility was observed to be well maintained with the facility being clean. Some windblown material was observed alongside the roadway leading up to the working face. Litter pick up crews were observed collecting the windblown litter at the time of the inspection. 6. The scrap tire collection area is located north of the recycling center. The area was observed to be well maintained with four transport trailers on site. Mr. Dively stated that US Tires still operated the scrap tire collection. 7. The leachate tanks are located at the northwest corner of the closed landfill and across the street from the power plant. The tanks were observed to be in good condition with no evidence of damage or cracks in the concrete containment. No leaks were evident. 8. The CAB collection area is located off the access roadway at the northern corner of the closed landfill. The area is secured by a locking gate. CAB material is identified at the scale house then directed to the CAB area for disposal. Facility staff meet with the customers at the CAB area and direct them on were to unload. The material is inspected for any unacceptable materials before the load is unloaded. At the time of the inspection there was a large amount of CAB material stockpiled in the area. Mr. Dively stated that the CAB material is processed as necessary and used in the facility road construction. 9. No unacceptable material was observed in the CAB area at the time of inspection. 10. The white goods/scrap metal collections area is located west of the CAB area on a concrete pad originally designed as a transfer station tipping floor. At the time of inspection, the white goods units had recently had the CFC removed by the contractor and were marked accordingly. The area is manned during the facility's hours of operation to assist the public and to screen loads. The area appeared to be clean and well organized. 11. The facility side slopes were observed during the inspection. The northern side slope for the active landfill was observed to have minor evidence of erosion through rills. Stockpiled dirt was observed near the area to be used for maintenance of the slope. 12. The tipping area was observed to be large enough to provide adequate space for incoming traffic to maneuver safely. A spotter was observed directing traffic at the time of the inspection. 13. The working face was small enough for the facility staff to manage. No unacceptable material was observed at the time of the inspection. 14. Tarps and dirt used for daily cover were observed stockpiled near the working face.
