The dumpster that was located on the tipping floor during the February 21, 2023 inspection had been removed and it appeared all waste is being removed from the tipping floor at the end of each operational day. Therefore, the violation is resolved. B. 15A NCAC 13B .0405(11): Resolved. The accumulation of foam, cardboard, plastic, and other wastes that were observed behind the push walls had been removed and the area cleaned. Therefore, the violation is resolved. C. 15A NCAC 13B .0405(b): Resolved. During the February 21, 2023 inspection, leachate was observed flowing out of the "vent" pipe on top of the leachate tank. The ground immediately surrounding the tank was saturated and dark staining was visible. Regional Disposal contacted the section, submitted a soil sampling plan to the section, conducted the soil sampling and submitted the results as required. April 27, 2023, Ervin Lane sent an email stating "Based on the soil analytical results, additional excavation/assessment related to the February 2023 leachate release is not required." Therefore, the violation is resolved. D. 15A NCAC 13B .0203(d): Resolved. During the February 21, 2023 inspection, leachate was observed flowing out of the "vent" pipe on top of the leachate tank. Therefore, the violation is resolved. E. 15A NCAC 13B .0403(b)(2): Resolved. During the February 21, 2023 inspection, multiple piles of countertop remnants and concrete were observed behind the transfer building. Intermingled in the stockpiles were nails, plywood, painted wood, shingles, plastic sheeting, metal hardware cloth, plastic drainpipe, and metal shelving. All waste that had been stored behind the transfer building had been removed and had been sent for disposal. Therefore, the violation is resolved. OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on July 14, 2023. 2. The facility hours of operation are Monday through Friday, 8:00 am to 4:00 pm. 3. The facility is secured by gates and natural terrain to prevent unauthorized access. 4. The access roads were of all weather construction and were being maintained at the time of inspection. 5. Waste is transferred from the facility to the Pine Bluff Landfill in Ballground, Georgia for final disposal. Operations Inspection of the Transfer Station (2003T-TRANSFER-2020) 6. Windblown waste was minimal and was well managed at the time of inspection. 7. The soil around the leachate vent pipe that was observed stained during the February 21, 2023 inspection had been removed and gravel had been added to the area. Facility staff stated that the soil had been removed and was sent to the Pine Bluff landfill for disposal. 8. The interior walls of the transfer building had recently been pressure washed as required by 15A NCAC 13B .0405(11). 9. All the waste that was observed behind the push walls during the February 21, 2023 inspection had been removed and the area had been cleaned. 10. The piles of the countertop remnants and concrete and other materials that were observed behind the transfer building during the February 21, 2023 inspection had been removed. Facility staff stated that the waste had been sent in transfer loads to the Pine Bluff landfill for disposal. 11. The tipping floor and push walls were in good condition at the time of inspection. 12. An accumulation of waste and soil was observed in the trench drain at the entrance to the tipping floor. However, no leachate was observed outside the transfer building. Ensure that the trench drains are being cleaned to prevent the release of leachate into the environment. 13. One of the trench drain grates is bent and not working as designed. Replace the bent/broken trench drain grate. 14. Pallets and yard waste was observed on the tipping floor during the inspection. On March 6, 2023, the facility provided a document from the receiving facility stating that those items were not banned from disposal at the Pine Bluff landfill.
