PURPOSE OF SITE VISIT:

STATUS OF PAST NOTED VIOLATIONS:
A. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0201(c) states, in part: "No solid waste
management facility shall be established, operated, maintained, constructed, expanded, or modified without a
currently valid permit issued by the Division for the specified type of disposal activity." Waste continues to be
removed from the South Site and disposed of at the A-1 Sandrock facility (permit# 4117) in Guilford
County. The waste stockpile has been reduced since the last inspection of the facility on March 18, 2022.
Mr. Tarkenton provided an estimate of 10% of the waste remaining on the site. He stated that waste
continues to be removed and transported to the A-1 Sandrock C&D Landfill (41-17) in Guilford County,
where it is used as landfill cover.
B. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states: `By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall

comply with the conditions of the permit." Permit to Operate No. 3424, ATTACHMENT 1, PART I: GENERAL
PERMIT, general permit condition 6 states, in part, "Operation of this solid waste management facility shall be in
accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the
North Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit, and the
approved plan." Permit to Operate No. 3424, ATTACHMENT 1, PART VI, TRANSFER
STATION/TREATMENT & PROCESSING UNIT(S), List of Documents for Approved Plan, includes the
Operations Manual, December 31, 2015 (DIN 25646). Section 2.8 of the approved Operations Manual
(December 31, 2015), Processing Area Legend, indicates that the preferred location for aging trommel-overs is
the South Site. No additional waste has been added to the South Site since the transfer of ownership in
December 2019, and work continues in the removal and disposal of the remaining waste.
C. RESOLVED: 15A NCAC 13B .0203(d) states, "By receiving solid waste at a permitted facility, the permittee
shall be considered by the Department to have accepted the conditions of the permit and shall comply with the
conditions of the permit. " Operational condition 11 — General Facility - of Permit No. 3424-TRANSFER-2010
states, "A responsible individual trained and certified in facility operations must be on -site at all times during all
operating hours of the facility, in accordance with G.S. 130A-309.25. An attendant must be present to oversee the
loading and unloading of waste. "
During the previous inspection on March 18, 2022, Abbey Green, Inc. was found to be in violation of 15A NCAC
13B .0203(d) for operating the facility without having a certified individual onsite at all times during all operating
hours of the facility. During this inspection. During the inspection on June 6, 2023, Certified Transfer Station
Operations Specialist training certifications were provided by the facility.
D. RESOLVED: 15A NCAC 13B .0203(d) states, "By receiving solid waste at a permitted facility, the permittee
shall be considered by the Department to have accepted the conditions of the permit and shall comply with the
conditions of the permit. " Operational condition 37 — Wood Grinding for Boiler Fuel — of Permit No. 3424-
TRANSFER-2010 states, "The facility is permitted to receive wooden pallets constructed of unpainted and
untreated natural wood. " Operational condition 42 — Inert Debris Pulverizing — of Permit No. 3424-TRANSFER-
2010 states in part, "This facility is permitted to receive "Inert Debris " which is defined in 15A NCAC 13B
.0101(28) as consisting solely of "asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris
waste shall not contain chemical adhesives or sealants, or lead -based paint. "
During the previous inspection on March 18, 2022, Abbey Green, Inc. was found to be in violation of 15A NCAC
13B .0203(d) for accepting wooden pallets, cured concrete, and concrete blocks that contained chemical adhesives
or sealants, or lead -based paint. During the inspection on June 6, 2023, the unacceptable material observed in the
unprocessed wood and unprocessed inert debris piles had been removed.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
Records Review:
1. The facility is permitted as a transfer station and treatment processing facility.
2. The sorting/picking line has not been in operation since the transfer of ownership in December 2019.
3. The Permit to Operate and Operations Plan are kept in the facility scale house and are available for review upon
request.
4. Daily tonnage records were reviewed from January 1, 2023, through July 6, 2023, and indicated that the facility
has received 28,541.74 tons of waste.
5. Waste screening records were reviewed from April 2022, through July 1, 2023, and were found to be complete.
6. Transfer station cleaning records were reviewed from April 2022, through June 2023. Records indicate that the
facility meets the permit requirements.
7. Leachate tank pumping records were reviewed and indicated the tank was pumped on July 15, 2022.
8. Facility training certifications were observed for the following personnel:
• Mickey Bowman — Certified Transfer Station Operational Specialist; expires April 13, 2025
• Solomon Martinez — Certified Transfer Station Operations Specialist; expires February 26, 2025
Field Inspection:
9. The facility is secured by a perimeter chain -link fence with access controlled by locking gates.
10. Proper signage was observed at the facility entrance.
11. Access roadways are of all-weather construction and were in good condition.
12. Windblown litter appeared to be well controlled on site with little observed during the inspection.
13. No waste was observed outside the limits of the covered tipping floor. No unacceptable waste was noted in the
transfer station operations area.
14. Waste is deposited on the tipping floor and pushed towards the back where an excavator is used to load transfer
trailers staged behind the back wall. Mr. Bowman stated that the loading area is cleaned as needed throughout
the day.
15. The trench drain in the tipping floor was observed and appeared to be functioning properly. Mr. Bowman stated
that the trench drain is inspected at the end of the day and is cleaned as needed.
16. The tipping floor was observed and appeared to be in good condition with no large cracks visible. No ponding
water was observed on the tipping floor. Mr. Bowman stated that the tipping floor is cleaned at the end of every
day.
17. The concrete pad surrounding the transfer station appeared to be in good condition and well maintained. Mr.
Bowman stated that sweeping equipment is brought onsite and used every two weeks to help control windblown
waste.
18. The facility leachate collection system consists of a 1500-gallon separation tank. After leachate passes through
the separator it is directly introduced to the sewer line.
19. Four transfer trailers were staged southwest of the covered tipping floor. The transfer trailers were inspected
and appeared to be in good condition.
20. The area North of the transfer station is used for the inert debris operation area. A large stockpile of inert debris
was inspected. No unacceptable material was observed at the time of the inspection. Mr. Tarkenton stated that
the inert debris was scheduled to be processed in the coming months.
21. The facility no longer accepts wood waste for processing.
22. A large amount of processed wood waste is still present to the west of the inert debris operation area. The
processed wood waste is stored in windrows that appear to be of manageable height. Mr. Tarkenton stated that
the facility is currently working on the removal of the windrow material from site.
23. The South Site appeared to be stable with a significant portion of the waste stockpile removed. The remaining
waste is concentrated at the rear of the site. Please see the Status of Past Noted Violations section of the
report for additional information.
