ADDITIONAL COMMENTS
1. David Powell inspected the site for a follow up on June 30, 2023, for corrective actions. The site had made considerable progress, but some waste remained onsite on and around a large soil stockpile. An additional follow up was done on July 6, 2023, to have an operator for the site, Scott Campbell, to dig a couple holes in the
large stockpile of soil/waste to inspect to gauge how much waste was possibly still in the stockpile. Since the previous inspection there had been some significant rainfall, which made viewing the waste surrounding the stockpile and on top of the stockpile more visible. Holes dug also showed some waste still inside the stockpile,
as well as more than previously were visible surrounding and on top of the soil stockpile. Mr. Powell and Mr. Campbell discussed corrective actions onsite. Mr. Campbell offered to clean up area surrounding and on top of the stockpile of soil/waste. There was also a small area in front of stockpile that had plastic, metal rods and
wire etc. that Mr. Campbell also agreed to haul away to landfill. Mr. Powell explained he would need to discuss with his supervisor to ensure the extent of the corrective actions needed. It was determined that all waste has not been removed and the stockpile needed to be screened and underneath excavated, if necessary, but all waste needs to be removed to a C and D landfill. Any of the soil left would need to be sampled to ensure it meets “unrestricted use standards” by contacting Perry Sugg with NCDEQ. Otherwise, the entire stockpile should be taken to C and D landfill. Crushed concrete and asphalt stockpile is also remaining and needs to be utilized or taken to landfill. All weight ticket documentation should be provided.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

7/6/2023 - In front of stockpile, waste has been spread out, Mr. Campbell agreed to haul away to landfill.
2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year.
3. The Yard Waste area has been cleaned up and is now vegetated. Edge of Waste markers are in place and road surrounding the YW area has been improved with the crushed concrete and asphalt. Good job.
4. Mr. Powell spoke with Mr. Kirkpatrick on 7/6/2023 via phone and email to inform of the status and determination. Further communication the following day via email to discuss realistic timeframe for finalizing all corrective actions. This cleanup has taken a long time and man y extensions. The final corrective actions should be completed ASAP, with documentation soon following for all disposals. Remember this waste must go to C and D landfill or be sampled etc. Mr. Powell is waiting Mr. Kirkpatrick’s response on a realistic timeframe for completion. Should it take longer than 30 days from receipt of this report an extension request should be made and an update on progress given.

5. Corrective measures are necessary as result of this inspection within 30 days receipt of this inspection report. A follow up compliance inspection will be conducted by Solid Waste Section Staff shortly after that time. Failure to meet the conditions for compliance may result in further Compliance Actions. If additional time is needed, then communicate with Mr. Powell and request additional time while providing an update on current progress.
