Purpose: Confirm Project Requirements and Answer Contractor Questions
Items of Discussion:
1) Agenda was distributed and sign-in sheet was circulated.
2) Notice to Proceed was given in the transmittal letter for the contract as March 12,
2001. Earth Tech will provide a separate, formal Notice to Proceed to IT.
3) Phase I of the contract has been funded and awarded. Phase II has not yet been
funded.
4) Contract terms were explained. The basic requirements of this contract are
performance based. IT has a Design-Build contract. Changes in design, such as
upgrading foundations to support IT equipment, are IT's responsibility.
5) Pat Backus will set up a coordination meeting with EPA TSCA, Region IV, IT,
DENR, and Earth Tech to occur next month.

6) EPA in-kind services are still to be determined. Terry Lyons is point of contact for
EPA and he will be invited to the coordination meeting.
7) IT estimates that design and preparation of the TSCA permit application will take two
months. Receipt of the North Carolina air permit will require approximately 90 days.
The state and TSCA permits will be on a parallel track.
8) IT doesn't need any additional county land, will use the footprint given in Drawing
C-3 unless they notify Earth Tech otherwise.
9) IT will maintain access for the adjacent landowner.
10) IT handed out a preliminary schedule, showing construction to begin on June 4th.
Earth Tech will conduct the baseline air monitoring prior to that date and will notify
IT and DENR in advance of the sampling date.
11) IT estimates their thermal unit will produce approximately 35 MM BTU/hr. Their
unit will satisfy the NC sulfur criteria for fuel oil.
12) IT estimates their unit can treat 19 to 30 tons/hour of soil.
13) IT is not planning to use a flameless thermal oxidizer for emissions control. This will
be addressed as part of the TSCA permit application.
14) IT needs to estimate how many tons of soil will be treated during the Performance
Demonstration. TSCA allows 720 hours of operation under shakedown.
15) IT would like leeway from EPA to treat soils with higher concentrations than those
treated in the Performance Demonstration, may use historical data to get this.
16) IT will add required permits to their project schedule.
17) Pat Backus will see if the existing DENR permit for storm water discharge can be
modified for use by IT.
18) Phase I is currently scheduled to be completed on February 26, 2002, which is past
the 270 day contract time (completion date of December 7, 2001).
19) IT requires a minimum of 250 gallons of condensed oils for LBCD treatment. They
will have a 2,000-gallon reactor.
20) A pre-construction meeting will be scheduled with the NC State Construction Office
prior to mobilization (prior to June 4th).
21) IT handed out a preliminary schedule of values and submittal register. Once the
schedule and schedule of values are fixed, IT will generate a spending forecast that
will predict the values of future invoices. Earth Tech distributed a copy of the SCO
Section 323 form to be used as an Application for Payment.
22) IT said they may need a storage permit for fuel oil and propane and may need a
SARA Title 3 permit for nitrogen.
23)Pat Backus will provide IT with the necessary information for abandonment of the
monitoring wells.
24) Earth Tech will forward the communication report from the meeting with Don Van
Der Vaart of the NC Division of Air Quality to IT.
25) Earth Tech and DENR will prepare a list of existing agency contacts for IT.
26) IT would like to schedule HAZWOPER training for one week prior to mobilization.
This date needs to be set and advertised in the community.
27) IT will prepare a table identifying the title, duties, requirements, and employment
dates for the available job openings.
28) DENR needs to track MBE participation and project costs spent in the local
community. IT will submit a sample form for review and approval.

29) Facilities are to be constructed as needed to support the remediation. The contract
requires some facilities to be left in place after the remediation. It is not necessary to
build these facilities if they are not required to support the remediation.
Improvements to remain on the property are listed in Section 01270, Part 1.03F. IT
will not construct a building for the PCSAPT system.
30) IT will use a frac tank to store most of the storm water that accumulates in their
process areas. Overflow during storm events will go to the lined pond. A 100-year
storm would produce 8-inches of rain in 24 hours. IT can treat 100-gpm of
stormwater through their activated carbon system.
31) IT asked if a double liner was required in the retention pond. Earth Tech will
evaluate whether there is a regulatory requirement. If not, a double liner won't be
required.
32) IT submitted a revised concrete plan that removes expansion joints and requires
smaller pours.
33) Carl Palmer will do a pilot test of the system at a facility in Elgin, Illinois. He will
need approximately 30 gallons of soil. Pat Backus will check on the available
volume of soils already in pails at Ecoflo in Greensboro, NC.
34) IT and Earth Tech will have a conference call next week to discuss submittals and the
project schedule.
35) Digital pictures with minimum 1 MB pixels are acceptable for progress photographs.

Ms. Wallace visited Earth Tech's Greenville South Carolina office to discuss the scope
and schedule for upcoming perimeter air monitoring work.
Ms. Wallace signed and delivered the subcontract to our office.
Earth Tech will provide Ms. Wallace with a schedule, based on the construction schedule
we will receive from IT.
Pace will provide a contact name from the Minneapolis laboratory. Reports can be
transmitted in spreadsheet form, or as PDFs of the laboratory report. Pace will provide us
with some example copies and we can work with them to determine what format is
preferred.
We confirmed that the following work would be required:
• Baseline -4 locations, 1 event. Each location will have PUF sample for PCB by TO-
4A and dioxin/furan by TO-9A; Summa canisters for VOCs by TO-14A; and TSP
gravimetric per 40 CFR 51. We will be able to give notice to Pace once we have
equipment delivery scheduled. This work will be completed before June 4, 2001.
• Performance Demonstration -4 locations, once per stack test, 3 tests probably a 1 to
2 week period. Will be able to give advance notice, but exact day may differ from
predictions. Each location will have PUF sample for PCB by TO-4A and
dioxin/furan by TO-9A; Summa canisters for VOCs by TO-14A; and TSP
gravimetric per 40 CFR 51.
• After Performance Demonstration, we may be able to go directly into operations or
there may be a delay. We will not know for sure until PD is conducted and EPA
decides.
• First Month of operation -daily samples from 4 locations. Each location will have
PUF sample for PCB by TO-4A; TSP gravimetric per 40 CFR 51 .
• Following first month -weekly samples from 4 locations. Each location will have
PUF sample for PCB by TO-4A; TSP gravimetric per 40 CFR 51.

Purpose: Discuss TSCA Permitting Requirements and EPA In-Kind Services
Items of Discussion:
1) Agenda was distributed and sign-in sheet was circulated.
2) Midwest Soil Remediation (MSR) will hold the TSCA permit as owner/operator of
the BCD treatment unit. MSR will provide an org chart to EPA.
3) Craig Brown of Region IV is in charge of the landfill remediation permitting and will
provide 761(c) approval.
4) Terry Lyons of ORD in Cincinnati is in charge of the SITE demonstration, including
sampling of the stack, soils and oil.
5) Dody Dodohara of HQ will evaluate the demonstration test results for compliance
with the permit application.
6) Winston Lue of HQ will have the lead on the TSCA permit and be the main point of
contact.
7) MSR will not install the equipment until the demonstration test plan is approved.

8) Shakedown testing could include 20,000 tons of soil over one month during January
and February of 2002. Shakedown testing will be part of the demonstration test plan.
9) MSR anticipates a soils feed rate of 19 to 30 tons/hour.
10) Confidential business information (CBI) is very difficult for EPA to handle, requiring
a safe and a document control officer. Submitting documents as CBI will make the
permitting process three times longer. Documents should not be stamped as
"Confidential" or "Proprietary" unless absolutely necessary.
11) MSR stated that compounds in the process vent will be nitrogen and non-condensable
hydrocarbons (e.g., ethane, methane). There will be no SVOCs and dioxins will be
below ambient air standards.
12) MSR will submit their NC air permit application in June. They expect to receive their
permit in 30 to 90 days, as there are no major issues.
13) MSR will demonstrate treated soils at 2 ppm of PCBs for the permit and 0.2 ppm for
the contract.
14) The TSCA permit will be for thermal unit with liquid BCD treatment as an optional
unit. This could be done as a two-part or conditional permit. EPA will resolve the
best approach for handling the dual treatment systems.
15) Diatomaceous earth will be used as filter aid in the press. Filter cake will be returned
to the soils unit for treatment. Recovered fines at the end of the project that could not
be re-treated and final decon water would be sent off-site for disposal. Classification,
manifesting, and treatment would be according to TSCA regulations.
16) The SITE program will do the sampling and analysis but MSR will do the reporting.
EPA has to bid the sampling work to four pre-qualified firms, need process
description and details to allow preparation of bids. SITE will prepare the sampling
QAPP for the demonstration test, need one month to bid the work, 4 -6 weeks to
prepare the document, and two weeks to review, total of three months once they have
the process information. If ORD gets process description from MSR by May ih, they
should have a contractor on board by June 8th and a QAPP by July 20th•
17) Results of the shakedown pre-test will be submitted to HQ as soon as available to
allow approval for interim operation.
18) EPA HQ will provide approval or comments on the demonstration test plan in eight
weeks. EPA-HQ stated that while their initial review normally is complete in eight
weeks, it is likely that approval will require both a meeting to discuss key technical
issues, and an additional period for review of additional information requested by
EPA-HQ.
19) MSR will provide Region IV with Notification to Demonstrate 30 days prior to
testing, although Region IV said this is not necessary.
20) MSR wants to demonstrate higher feed concentrations by running unit for three
weeks during shakedown, recovering the oil, and augmenting the feed with recovered
PCBs. Goal is to show performance at 10,000 ppm. EPA will need two out of three
runs in the PDT at the highest feed concentration. MSR plans on three runs at 500
tons each.
21) MSR can do shakedown testing under the Demonstration Permit, will need to define
quantity of soils required to generate sufficient oil to augment feed. May be able to
recover oil from the first test and use in the later tests.

22) The unit will be permitted at a maximum concentration and maximum throughput
based on what is demonstrated during the test. There will be a limit on throughput
irrespective of concentration.
23) MSR expects to issue report one month after test results are received.
24) EPA can approve interim operations using raw data to show six 9's DRE. The data is
generated from a pre-test during the shakedown period and will allow interim
operations while awaiting results of the performance demonstration testing (PDT).
The pre-test must provide PCB stack test results for one run. Process is to show DRE
with pre-test data, then show DRE two weeks following the three-run PDT, and then
provide D/F data. EPA-ORD was in agreement that they can support both the pre-test
and PDT. Unit can keep operating so long as data shows compliance while waiting
for the final TSCA permit. MSR is to provide the details of this testing sequence,
along with a schedule for data submission, as part of the demonstration test plan.
EPA-ORD stated that "results only" preliminary data will be made available directly
to MSR as soon as possible after each test event (pre-test and PDT). EPA-HQ stated
that this type of data is acceptable for approving interim operations.
25) Schedule is to set up unit in early January and conduct shakedown testing in late
January 2002.
26) The 1998 amendments for PCB remediation waste allow a self-implementing
approach with variances for closure of the landfill. As an example, closure should
note use of the variances for confirmation sampling, as described in 76l(a)(3).
27) The NCDENR will submit a request to stop leachate collection and abandon the
groundwater monitoring wells.

NOTE: Meeting was started at 9:30 AM as scheduled and repeated at 1 :30 PM due to schedule
conflicts. Not all attendees were present for both meetings.
MEETING MINUTES
1. Work performed in the last 30 days.
IT Corporation (IT) has completed subcontract agreements with all major subcontractors and
suppliers. Seeding subcontractor will be selected later in the project. Names of
subcontractors and minority businesses will be provided to Jim Cloonan to forward to State
Construction Office. IT is preparing grading plan and structural plans. Completion of the
concrete drawings awaits details from building supplier. IT is also coordinating with CP&L
for terminating existing power (planned June 4, 2001), and installing new power supply and
poles.
2. Work to be performed in the next 30 days
Initial site survey will be completed, and IT Corp. plans to mobilize to the site week of June
4, 2001. Ground breaking ceremony is schedule for 11 :00 am on June 11, 2001 at the site.
Power will be provided to the trailers and telephone lines installed. IT will notify Pat Backus
of site telephone number, who will relay the number to State Construction Office. Erosion
and sediment control permit will be obtained, and draft TSCA permit will be completed for
Earth Tech and DENR review June 8, 2001. Midwest Soil Remediation (MSR) will continue
with their efforts to prepare the BCD unit for mobilization to the site. Earth Tech will
perform the baseline air monitoring.
3. Review of change orders ( outstanding/anticipating)
No change orders are outstanding or anticipated at this time.
4. Review status of permits applications, project drawings and submittals
Draft TSCA permit will be submitted for Earth Tech and DENR review June 8, 2001. NC air
permit will follow. IT was reminded of minimum 90-day Air Quality review period. IT was
also reminded of the 180-day review time required by Water Quality for NPDES permits,
which may be required for the site storm water treatment system.
5. Review construction schedule compliance
Project schedule unchanged. IT Corp. will hold to 270-day Phase I completion schedule
excluding EPA review times for the TSCA permit. Using the given EPA review time,
estimated completion date for Phase I is March 1, 2002. State Construction Office reminded
IT to include time for State Construction Office final inspections in the project schedule.
State Construction Office also explained the procedure for calculating contractor schedule
extension based on weather delays.
6. Percentage complete to be reported by Contractor (actual work in place)
Project is 13.84% based upon contractor invoices. No work was in place at the site, but work
plans, drawings, permit applications, and BCD equipment preparation are in various stages of
completion. IT has provided a surety certificate from their bonding company affirming the
progress payment to MSR.
7. Discuss construction/coordination issues
Earth Tech plans to conduct base-line air sampling prior to IT mobilization and disruption of
power. Sampling will be completed week of May 29, 2001.
8. Comments from Owner, SCO, Contractor, and Designer
State Construction Office stated that no firearms are permitted on the site, reviewed change
order procedures, and requested that Earth Tech complete the SCO weekly and monthly
inspection reports. State Construction Office also reminded IT that DENR is exempt from
North Carolina state sales tax and such taxes should be documented on invoices. Earth Tech
commented that vehicles are to be clean when brought on-site, IT should place signs at site
entrance and on roads leading to the site to facilitate deliveries of supplies and equipment,
monitoring wells are to be abandoned in accordance with State Regulations, and copies of the
well abandonment forms are to be provided to DENR and Earth Tech. The official SCO ID
number for the project is 010440101A. DENR reminded IT that the replacement benchmark
should have horizontal and vertical controls.
9. Schedule project monthly progress meeting date, time, and place
The next monthly progress meeting is scheduled for June 7, 2001 at the Warren County PCB
Landfill at 1 :00 PM. Future monthly progress meetings will be coordinated with the
Community Advisory Board meetings such that both will occur on the same date.

Erosion and Sediment Control permit submitted to State June 4, 2001 ,
Comments received June 6, 2001. Site grading plan will change to
lessen slopes on fill areas. Change may effect erosion and sediment
control plan such as relocation of sediment trap, but no significant
changes expected.
Site survey started during the week ending June 8, 2001 to define
perimeter limits.
Limited clearing also started week ending June 8, 2001.
Trailers will be on site June 8, 2001.
2. Work to be performed in the next 30 days
Site Clearing and grubbing scheduled to start June 19, 2001 , and erosion
and sediment control measures construction to start the same date.
Monitoring well abandonment scheduled for June 12, 2001. Delayed due
to weather, does not effect overall project schedule.

It is expected that CP&L and telephone will bring power to the site and
provide telephone service, respectively, during the next 30 days.

& Yelle. IT will construct two sedimentation basins on the west side of the landfill
and they have requested additional land from the County for this construction.
TSCA permit application was submitted to EPA for review. The Performance
Demonstration Plan will be submitted separately.
All monitoring wells that were to be abandoned have been abandoned. Well
construction records were found for all but one of the abandoned wells (MW-3S).
Completed clearing of trees and brush. Materials to be hauled to Kearney's yard for
disposal.
Trailers sited and connected to power. Still waiting for complete phone service, have

No further site work can be conducted without the Erosion and Sedimentation Control
Permit. Earliest anticipated date for permit is July 13th. Will then need pre-
construction meeting with NCDENR before installing controls and inspection of
installed controls prior to start of grading.
Draft Performance Demonstration Plan is scheduled to be submitted to NCDENR and
Earth Tech for comment on July 23rd .

IT will submit a request for change order for time and costs associated with delays in
receipt of the Erosion and Sedimentation Control Permit. Under General Conditions,
they have 20 days from date of delay to submit request.

Draft TSCA permit application was submitted to EPA. Draft Performance
Demonstration Plan scheduled to be submitted to Earth Tech and DENR on July 23rd
(vs. target date of June 26th at last meeting). IT requested to send plan directly to
Kathleen McNelis.
IT Corp. stated that they cannot obtain an NPDES permit unless they have no other
discharge options. IT needs to dispose of more contaminated stormwater from the
excavation and process areas than can be used in their treatment process. They will
obtain an indirect discharge permit using spray irrigation to discharge treated
stormwater. Treatment standard will be 0.5 ug/1 of PCBs. IT will hire a soil scientist
to evaluate the wooded area to the west of the landfill to receive the water. Discharge
may require up to 20 acres of land. Testing the soils and obtaining the permit should
not impact the schedule.
DENR requested preliminary concrete drawing (less pole barn supports) at last

grading plan and have not been submitted.
At their monthly meeting on July 2nd, the County approved IT's request for access to
their land to the west for construction of two sedimentation basins. IT will formally
find out about their request for access to County land for discharge of treated water by
spray irrigation on August 61\ when the County commissioners next meet.
IT already has the NCDOT encroachment agreement for connection to the water main.
IT will submit the draft NC air permit application to NCDENR and Earth Tech for
review on July 23rd. IT requested to send Earth Tech copy directly to John Funk in
Raleigh.

Earth Tech discussed preliminary results of the baseline air monitoring. PCBs were
non-detect at all four locations. Dioxins/furans TEQs were detected at all four
locations but these compounds are detected across North America and Europe.
Station No. 2 exceeded the site standard for TEQs and the State standard for
methylene chloride. The data must still be validated and the air flow rates of the
samplers confirmed.

The Draft Performance Demonstration Plan was submitted to Earth Tech and DENR
on August 15th for review and comment. A conference call was set for Friday,
September ?1h to discuss comments from DENR and Earth Tech.
IT submitted information on the origin and condition of Jersey barriers to be used to
segregate treated soil piles. Use of the barriers was approved but soil residuals were
observed on a number of the delivered barriers. IT agreed to remove and containerize
the adhered soil.
5. Review construction schedule compliance
IT submitted a revised schedule. This schedule shows completion of Phase I on April
11, 2002. Including EPA review time, IT's schedule is within the revised Contract
Time of 291 days.

Percent complete by invoice is 32% through Application for Payment No. 6. Based on
the revised Contract Time of 291 days, the project is 61 % complete.

Progress on the grading work needs to be accelerated to maintain the project schedule,

IT will provide a form showing rain days for Earth Tech's oversight to approve as
they occur.

EPA received the confidential business drawing and the Demonstration Test Plan on
October 11th• IT anticipates comments from EPA by December 5th. Submittal of CBI
drawing should not delay EPA review. [NOTE: EPA subsequently requested a
meeting in DC to discuss general comments.] EPA in Cincinnati is revising the lab
QAPP and will submit to EPA HQ, date uncertain.
NCDENR submitted preliminary comments on the non-discharge permit application.
IT will discuss with their subcontractor, Agriwaste Tech, on Monday. IT doesn't need
the permit until site activities resume in March.
Earth Tech requested design submittal on the dry stack wall to be used for loading of
the feed prep area. IT provided copies of Submittal Nos. 39, 40, 42, and 43 at the end
of the meeting.
IT is waiting on final test results from Gundle on their liner materials. Earth Tech
approved used of the 40-mil LLD PE instead of the previously approved 30-mil HDPE.

IT submitted a revised schedule. This schedule shows completion of Phase I on June
17, 2002. Site preparation should be complete by November 28th• The thermal
treatment unit should be complete by the end of the year.

The subgrade for the new pond contains numerous cleat marks from compaction.
Earth Tech questioned whether the irregularities would allow competent installation of
the liner. Earth Tech requested smooth grading, IT said they could not get a roller out
of the excavation. IT will evaluate condition and provide a response.
Nat White, the adjacent property owner, may need access through the fenced area. Pat
Backus will look into this.

Purpose: Discuss EPA Comments on TSCA Demonstration Test Plan
Items of Discussion:
1. EPA indicated they are reviewing both the operating permit application and test plan,
but are currently focusing most of their efforts on the test plan. They will provide
comments on the operating permit application after the demonstration test. The scope
of this meeting was limited to addressing requirements for performance testing.
2. EPA inquired about a date set for the demonstration testing. IT indicated that
shakedown with PCB soils was scheduled to begin in April based on receiving
approval of the demonstration plan by the end of January. A pre-test will be
performed within the first five days that PCB-contaminated soils are fed to the
desorber and would be followed by the performance tests. EPA stated they will
require performance testing to document destruction and removal efficiency (DRE)
for each 5,000 tons of PCB soils treated during shakedown, pre-testing and
performance testing. The pre-test and initial performancetest will count for two of
these. Two additional tests will be required to treat the proposed 20,000 tons prior to
interim operations. IT agreed, butwants to use NIOSH method 5503 instead of
Method 0010 to demonstrate DRE during the additional tests. EPA will consider
approving the use of the NIOSH method if during the pre-test a correlation can be
shown between the results of Method 0010 and NIOSH method 5305.

3. EPA inquired about the sufficiency of oils for spiking. IT stated that oils collected
from the shakedown will be used to spike soil for the performance testing. Based on
laboratory practical quantitation limits (PQLs), as little as 2 ppm in soil will allow for
demonstration of 99 .9999 % ("six nines") DRE. IT's concern is the ability to
generate sufficient oil to spike soils to a minimum of 2,000 ppm in order to set a
maximum concentration range for operation. IT estimates that it will take 15 to 20
days of desorption to collect sufficient quantity to spike soils to 2,000 ppm. EPA will
review the concentration estimates.
4. EPA will target the end of January to have a permit complete for the demonstration.
The demonstration permit will include approval for pre-testing, performance testing,
and interim operations. EPA will provide a draft demonstration permit around the
end of December. They will need a copy of the Quality Assurance Project Plan
(QAPP) to review prior to this. EPA is concerned about collecting isokinetic samples
from a small diameter duct. IT indicated that flow might be laminar in the 4-inch
section. EPA will contact the contractor, EQM, who is preparing the QAPP to
discuss stack testing protocols. IT provided EPA with a draft copy of the QAPP. IT
provided the phone number of the test engineer at EQM, John Wentz, so that EPA
may contact EQM directly with questions on the QAPP.
5. EPA requires more information on the Base Catalyzed Decomposition (BCD) process
-a description of equipment and test protocols -that will be used to treat the
recovered PCB-contaminated oils. IT will provide the additional information. EPA
will combine the BCD and desorber into the same permit. IT requested that the
permit include the provision for the oil to be sent off site for disposal at a TSCA
permitted facility to allow flexibility.
6. EPA is concerned about the condensed water from the off-gas recovery system being
put back onto treated soils without first being treated to regulatory levels ( either 0.5
or 3 ug/L depending on use). IT contends that this stream is internal to the process
and should not be required to meet these regulations because analysis of treated soil
occurs after the addition of the condensed water. IT will prepare a justification for
remixing water and soil without treating the water and will it submit to EPA for
review of regulatory compliance.
7. EPA reminded IT that a 30-day notification is required before PCB-contaminated
materials can be fed to the desorber. EPA will provide information on the
notification requirements to IT via email. The notification should include reference
to all PCB treatment phases -i.e. demonstration, interim operations and operations.

without comment.
The non-discharge permit application was resubmitted to NCDENR m early
November. Pat Backus will check on the status.
IT will submit a revised design for the stacked wall to be used for unloading
contaminated soils onto Pad 1.
IT provided copies of Submittal Nos. 41 and 48 -55 and updated progress
photographs at the meeting.
5. Review construction schedule compliance
IT submitted a revised schedule. This schedule shows completion of Phase I on June
10, 2002. The thermal treatment unit will be complete prior to mobilization but the
timing is tight. Pending EPA approval of the TSCA submittals, IT would remobilize
to the site around February 18th and the TIU would arrive around February 25 th• A
project meeting would be held prior to remobilization in Earth Tech's Raleigh office
to verify procedures and forms to be used during thermal treatment.

Concrete breaks for slab 4 are 4% low compared to the 4,000-psi requirement. IT will

Earth Tech needs the as-built surveys when they are ready. Earth Tech will conduct
periodic (at least monthly) visits to the site during the down time to check security and

IT will need minimum 4,000 tons of soil for the performance demonstration,
maximum of 20,000 tons. Will need 15 days of treatment to be able to spike at 300
ppm. Will need three, 6-hour destruction and removal efficiency (DRE) tests, two at
the maximum feed rate.

All major issues have been resolved but need to adjust date of performance based on

concentration standard.
Earth Tech repaired the erosion and sediment control features.
2. Work to be performed in the next 30 days
IT is reconsidering the dry stack wall submittal concept. Kearnco to provide IT with
justification for final payment amount.
The surety has agreed to provide the last progress payment to MSR. MSR will resume
fabrication of the thermal treatment unit once they receive the payment.
NCDENR will submit landfill permit revision to Craig Brown, EPA Region IV. EPA
HQ should provide final TSCA demonstration permit.

There was no significant site work in February and no change orders were submitted. IT
cannot sign the deductive change order for the erosion repairs due to the surety claim.

The final QAPP was submitted to EPA HQ in early January. EPA HQ added testing
for dioxins during the pre-test. EQM will be sampling contractor and STL will be the
analytical laboratory. Agriwaste will submit the draft of the revised non-discharge
permit to the NCDENR no later than March ih.

A revised schedule was submitted by IT. MSR should receive the last progress
payment next week and call back their workers from furlough. MSR has ordered the
BCD treatment tank. Pending confirmation of the fabrication schedule, IT plans to
remobe to the site on April 22nd and the BCD system would begin to arrive on May
ih. Earliest possible date for shakedown would be May 29th. DRE test would then
begin around June 6th with end of demonstration test around July 15th. Group should
target early April for kick-off meeting, will confirm date at next progress meeting.

EPA reviewed test plan permit. Shaw (MSR) has not received responses from Carl Palmer's
comments on TSCA permit, but permit is expected by the end of May. Shaw has received
comments from DWQ on NPDES permit, Shaw will submit responses by May 10, 2002.
DWQ requested a closure plan for lined pond. Shaw started construction of the site haul road
and the ramp from the road to pad #1. Shaw has mobilized some equipment to the landfill
site and will continue to mobilize during May.

Complete site haul road and ramp. Shaw handed out an equipment shipping schedule during
the meeting. Schedule indicates that all equipment will be on site by the end of May and

complete by July 15, 2002. Shakedown runs (contaminated soil) July 24, 2002. DRE testing
will be comprised of three runs starting July 31, 2002. Testing will require an estimated 1000
tons of soil.

Project is 80.35% complete based upon contractor invoices. Note that percent complete does
not include contract adjustment resulting from Change Order #5.

Shaw contracted with Toxicon Corp to analyze soil samples. This lab will produce PCB
analytical results in less than 48 hours.
Shaw distributed the following transmittals: Final Verification/Confirmation Sampling Plan
and Technetics Industries weigh belt system description and calibration procedures.
Terry Lyons said that his subcontractor can't meet the I-week TAT for analyses specified in
the permit. Shaw will contact EPA HQ to modify the permit.
TSCA permit start date is June 10, 2002 with termination date of September 20, 2002.
Shaw/Midwest to obtain revised termination date to conform to anticipated shakedown and
DRE schedule.
8. Comments from Owner, SCO, Contractor, and Designer
Earth Tech asked about the anticipated production rates and completion date. Shaw estimates
that they can treat 15 tons/hour (nominally 12 TPH based on 80% uptime for 6 days/week).
At this rate, soil treatment should be complete by April 2003. Unit will run 24 hours/day, 6
days/week.
Shaw won't reach the bottom of the landfill in the first excavation face until around Labor
Day, will have to remove approx. 10,000 tons of soil first.
Earth Tech asked about the Performance Demonstration Analysis, report that certifies treated
soils meet the performance standards. Shaw produced a draft document for approval based
on the requirements of the TSCA permit.

Final minutes from the August 12, 2002 progress meeting were approved without
comment. Approval of the minutes will be added to the agenda for future meetings.
1. Work performed in the last 30 days
Environmental Quality Management (EQM) performed the DRE test on August
26, 2002. Shaw indicated the system passed the test. Dioxin results from DRE
test were 1/100th of concentration needed to pass the test. Results were sent to
EPA in a letter from Carl Palmer. MSR sent a request to TSCA asking them to
extend the demonstration approval through 10/31/2002.
Weigh belt scale was certified by NC Department of Agriculture and certification
was also received for the flat (platform) scale that measures residuals. Shaw will
add a direct readout in the control room for the flat scale.
2. Work to be performed in the next 30 days
Continue operation of the BCD unit.
Performance demonstration test (PDT) is scheduled for week of October 21 ,
2002. Shaw believes they will have collected enough oil by this time to spike the
feed soils. Collection on the ductwork has prevented Shaw from calculating how
much oil is generated per ton of soil processed.
MSR will perform NIOSH method stack test during the next 5,000 -10,000 tons
of soil to be treated.
3. Review of change orders ( outstanding/anticipating)
None outstanding. Fuel adjustment change order will be prepared on a quarterly
basis or longer period, if warranted.
4. Review status of permits applications, project drawings and submittals
Shaw is to revise the Sampling Plan to indicate that treated soil samples will be
collected on Pad 4 rather than from the conveyor after the product cooler on Pad
3, due to decon issues. Craig Brown of EPA gave verbal approval for this during
a conference call with Shaw and DENR.
DWQ is scheduled to inspect the storm water treatment system.
Daily production form modified to track weights of residual material.
5. Review construction schedule compliance
Met tower repairs are complete except for installation of new rain gauge.
PDT is scheduled for week of October 21, 2002.
Shaw has processed 1,248 tons of soil to date, although most of these have not
met the treatment standard.

for combined Phase I/Phase II work.

Treated soil discharge is 965 degrees F, and feed rate is temperature dependent.
Shaw believes they have resolved the burner difficulties.

Perimeter air monitoring results will be available early next month. Earth Tech
will provide a copy of the results to all.
Pat Barnes said he believed that the stormwater measures in place are protective.
Sampling of the feed soils for dioxins will occur during the PDT.

Minutes of the September 11, 2002 monthly progress meeting were approved without
comment.
1. Work performed in the last 30 days
• Shaw received a letter from EPA headquarters approving the DRE
test results -Shaw is now in interim operations. The letter also
extended the permit date to November 30, 2002.
• As of September 301\ Shaw has processed approximately 3,000 tons
of soil with 1,918 tons passing the acceptance criterion (200 ug/kg
weighted average).
• Shaw is processing approximately 15 tons per hour @ 85% uptime
or 306 tons per day. They plan to increase soil production in the
coming month.
2. Work to be performed in the next 30 days
• Process soil with rate increasing to 20+ tons per hour.
• PDT postponed until at least November 18, 2002. The date is tentative,
and is contingent upon having enough oil to spike the soil for the PDT
test and on availability of EQM to conduct testing.
• MSR will conduct stack testing (NIOSH method) at about the 7500 tons
mark. MSR/Shaw to coordinate with Earth Tech so that perimeter air
monitoring will coincide with the NIOSH test.
3. Review of change orders (outstanding/anticipating)
• Shaw submitted Change Order #6 for treatment of remainder of the soil
(up to 72,000 tons). Change Order value is approximately $4.4 million,
and is pending approval by Earth Tech, DENR, and SCO. The contract
time will increase with substantial completion by September 2003.
4. Review status of permits applications, project drawings and submittals
• Shaw revised the Sampling Plan to collect samples for compositing
hourly from the side of each pile on pad #4. EPA has approved the
revised Plan. Shaw is to submit to Earth Tech a final version of the
Sampling and Analysis Plan for review and comment by October 18,
2002.
• Soil will be accepted as successfully treated based on a weighted
average approach. The weighted average cannot exceed 200 ug/kg
and the maximum concentration cannot exceed 500 ug/kg. Sample
results that are non-detect or below quantitation limits will be
calculated in the weighted average as half the quantitation limit for
that sample.
• Shaw is to modify the production approval form to include the
weighted average.
• Shaw to submit names of laboratories to conduct PCB testing.
• Shaw is to provide Earth Tech daily production reports by noon of
each day. The production day runs from 1830 hours to 1830 hours.
5. Review construction schedule compliance
• 1,918 tons of soil were accepted as successfully treated by Earth
Tech.
• EPA extended the demonstration approval to 11/30/02.
• PDT tentatively scheduled for November 18, 2002.
• With the approval of Change Order #6, project completion will be
September ls1h, 2003.

7. Discuss construction/coordination issues
• Shaw is assuming an uptime percentage of 85%, but actual
percentage has been closer to 60% due to MSR having to retreat
soils.
• Shaw hired an independent review of both Paradigm and Southern
Engineering laboratories. Both were found to be acceptable. Shaw
is to select laboratories for PCB analysis and submit those names to
Earth Tech. There should be one analysis per composite sample for
each batch.
• To date, Shaw has recovered approximately 50 gallons of oil. They
estimate that 500 gallons will be required to spike soils for the PDT.
PCBs will not be brought to the site for spiking.
• The bag filters added to the wastewater system are not removing any
additional PCBs. The DWQ approved the permit modification for
the filters. Shaw to evaluate options and advise NC DENR. An
additional permit modification may be required.
• Treated water has been sent to the unlined pond only during the large
rain event in Sepmber and not since. There is no standing water in
the unlined pond.
• Perimeter monitoring will be conducted in conjunction with the
NIOSH stack test. Anticipated schedule is first week of November
2002 at the 7,500 tons mark.

• Earth Tech presented results of the perimeter air monitoring during
the DRE test. All results are within NC and NAAQS limits except
methylene chloride, as was the case for the background sampling.
PCBs were detected at all locations but within the NC limit. Earth
Tech will issue a summary memo to the group.
• It was agreed that future perimeter air monitoring will not include
volatile organic compounds since the results of the monitoring
conducted during the DRE did not vary significantly from the base
line monitoring.
• The eastern limits of the landfill extend past the surveyed limits as
shown on the project drawings. Shaw will determine the eastern
limits using a trackhoe. The other landfill boundaries are assumed
as shown on the drawings. Excavation has not yet reached the
bottom of the landfill. Shaw will advise DENR/Earth Tech of the
potential increase in landfill volume once the width and depth are
defined.

Minutes from the October 9, 2002 Monthly Progress Meeting were approved by all
attendees with the following clarification requested by Shaw: Item No. 4, third bullet
delete "weighted average" and insert -disposition, "Acceptable, But Contractor Chooses
to Reprocess."
1. Work performed in the last 30 days
• In the last 30 days, 8,445 tons of soils were processed. 7,992 tons passed
and 453 tons did not meet the acceptance criteria.
• Nominal throughput is 310 tons per day (tpd) versus a target of306 tpd.
Production target is 20 tons per hour.
2. Work to be performed in the next 30 days
• Continue processing soil. MSR intends to work through Thanksgiving
and only break for the Christmas holiday.
• The second NIOSH stack test, during the 10,000 to 15,000 ton range of
treated soils, is scheduled for week of November 18, 2002. Earth Tech
requested that test be conducted during dry weather so that the perimeter
air monitoring, conducted as a simultaneous event, is conducted during
non-rainfall conditions.
3. Review of change orders (outstanding/anticipating)
• Money for Change Order #6 has not been transferred as yet to DENR's
account. Funds will likely be available in November.
4. Review status of permits applications, project drawings and submittals
• Comments on Sampling Plan were provided to Shaw on November 5,
2002, and Shaw will revise and resubmit accordingly.
• Running average of approved soils is 109 ug/kg of PCBs versus the
legislated target of 200 ug/kg.
• Shaw is to continue contacting EPA concerning extension ofTSCA
performance demonstration test from November 30, 2002 to January 31 ,
2003.
5. Review construction schedule compliance
• 9,911 tons of soils were processed and passed to date. 7,992 tons were
processed and passed in October.
• Soil processing finish date June -July 2003.
• The estimated Phase II completion date is September 18, 2003.
6. Percentage complete to be reported by Contractor (Phase I & II)
• 76.27% complete Phase I & II, 32.9% complete Phase II only.
7. Discuss construction/coordination issues
• Uptime 82%, 310 tpd versus target of 306 tpd.
• Oil recovery is approximately 300 gallons, which is below Shaw's
expectations. From the DRE, oil contains 7% PCBs. Quantity
should be sufficient to conduct PDT the week of January s111•
• PDT should involve one run on January 6th and two runs on January
ih. The liquid BCD test will likely lag a week to allow recovery of
the spiked oils.
• MSR is working on filter for wastewater treatment system to
improve performance.
• Storm water system has treated over 1 million gallons. Scheduled
sampling of treatment system influent, effluent, unlined pond water
and sediment, and sedimentation basin sediment was conducted on
November 1, 2002 by Earth Tech and DENR personnel.
• Perimeter monitoring schedule, 10,000 to 15,000 tons range,
scheduled for week of November 18, 2002.
• Perimeter monitoring results from the August sampling event were
shared with the attendees. All PCB and dioxin results were within
the NC guidelines.
• Shaw reported a release of diesel fuel due to broken fuel line on a
dump truck on November 6, 2002. Shaw was instructed to undertake
reporting and corrective actions in accordance with Division of
Water Quality, Groundwater Section Guidelines.
• Shaw expects to have their NC General Contractor's license by
January, will keep DENR informed of progress.
8. Comments from Owner, SCO, Contractor, and Designer
• Due to recent heavy rains, Shaw was reminded of the importance of
maintaining site erosion & sediment control measures. Shaw has
added silt fences around the treated soil stockpile and will reseed the
northern boundary of the landfill.
• Cash flow projections were provide to DENR by Shaw and Earth
Tech.
• Lien filed by Pride on MSR was been corrected with MSR and Pride
agreeing to a payment plan.
• The Community Technical Advisor stated that the community
concerns were mainly on the issues of storm water and potential
impact on sediments. He was advised of the storm water and
sediment sampling conducted on November 1, 2002, and that the
results would be shared upon receipt.

• The Community Technical Advisor stated that he was concerned that
storm water on the treated soil pad could pass beneath the jersey
barriers such that contaminants from one bin could pass to an
adjacent bin. Shaw stated that they had observed storm water
flowing around the barriers but only in very heavy rain events due to
the slope of the pad. Shaw stated that they observed no sediment
transport in the flow around the barriers. They also stated that flow
beneath the barriers was unlikely due to the build up of soil against
the base of the barrier and beneath the barrier. Earth Tech will watch
for run-off between bins during storm events.
• The Community Technical Advisor stated that he was concerned that
the contractor could negate the intent of the legislated criterion of
200 ug/kg by the using the running average (109 ug/kg current
average) to produce a series of batches above 200 ug/kg. Shaw
stated that their system was not that precise to enable them to
"tweak" treatment system. DENR also stated that they would chart
the results to look for any such action. The net result to date for the
community is positive, as the average PCB concentration in the
landfill is approximately half the legislated target.
• The eastern limits of the landfill are still not delineated.

1. Minutes of the November 6, 2002 progress meeting were approval without comment.
2. Work performed in the last 30 days.
• 14,247 total tons of soil were treated and accepted. 4338 tons were treated and
accepted in November. The average concentration is 106 ug/kg versus a target
concentration of 200 ug/kg.
• The November processing rate was below schedule of 306 tons per day due to
equipment downtime and soil moisture content that limited production to 12-13 tons
per hour.
• Shaw did not have available the results ofNIOSH stack test conducted in November
(10,000-15 ,000 tons increment)
3. Work to be performed in the next 30 days
• Due to ice storm, power was out at the site from December 4th through December
11th when power was restored at 1600 hours. MSR and Shaw will shutdown on
December 22nd until December 29th for the Christmas Holiday. They anticipate
working over New Years.
4. Review of change orders ( outstanding/anticipating)
• Change Order #6: Money is available and will be transferred into DENR account
when needed.
• Shaw anticipates issuing a change order for additional erosion and sediment control
measures at the soil stockpile area. Change order expected to be in the $4,000-
$5 ,000 range.
• Project completion date should be increased 7 days to account for the power outage
due to the ice storm.
5. Review status of permits applications, project drawings and submittals
• Performance Demonstration Test is planned to start on January 6, 2003. EQM will
mobilize on-site on Sunday, January 5th•
• Earth Tech will conduct perimeter air monitoring during that week in conjunction
with the PDT.
• Shaw received an extension of the TSCA startup period to January 31 , 2003.
• Shaw added a floe system to the storm water treatment system.
6. Review construction schedule compliance
• Phase I is essentially complete.
• Phase II target completion date is July 2003 for soil treatment, but meeting that date
will require increase in production rate and system availability over performance to
date.
7. 80.5% percentage complete on money approved to date. 96% complete on Phase I.
8. Discuss construction/coordination issues
• Sampling results from the sedimentation basins were discussed. Pat Barnes
requested that additional samples be collected down stream of the basins and he and
Dennis Jones were to mark those locations.
• Sampling of landfill cover materials showed PCB concentrations in the soil cover
above the flexible membrane liner and also in the clay cap above the waste material.
Earth Tech to develop options for dealing with these soils.
• Shaw has indicated that the landfill may be 16 feet wider than had been delineated
on the site as-built drawing for the landfill. Earth Tech to revise soil tonnage
estimates and present to DENR.
• Air monitoring results from the November sampling event are under review and will
be available at the next progress meeting scheduled for January 2003.
• Erosion control measures requested by Earth Tech for the north side of the site have
been implemented by Shaw.
• Target date for Performance Demonstration Test is January 6, 2003.

• The Community Technical Advisor requested additional samples be collected
downstream of the sedimentation basins, DENR and Earth Tech concurred.

• Target completion date is significantly behind due to poor production rate in

• Average PCB concentration of accepted soil is 0.111 ppm

• Continue to operate BCD unit with target production goal of 12-13 tons per hour

4.0 REVIEW OF CHANGE ORDERS
• DENR to approve Change Order No. 6 after the Performance Demonstration
Test.
5.0 STATUS OF PERMITS, PROJECT DRAWINGS AND SUBMITTALS
• Status ofTSCA permit is on schedule with performance demonstration test
(PDT) being conducted this week. No problems reported by EQM with
sampling. EPA will extend the January 31, 2003 permit deadline and grant
additional extensions as data from the PDT is submitted to EPA. Shaw provided
a schedule of TSCA permit process.
• State inspected erosion and sediment controls measures and found no problems.
• Results of gel-floe addition to the storm water treatment system indicated that
PCB concentration in storm water discharge to the unlined pond and spray
irrigation system is 10 ppb. Shaw to contact gel-floe vender to determine if
performance could be improved. Shaw will also floe the lined pond to lower
turbidity into the system once the pond level drops below 50,000 gallons.
• Shaw to check status of their NC GC license, contractor license board scheduled
to meet this month.
6.0 REVIEW OF SCHEDULE COMPLIANCE
• Phase I target completion date is February 3, 2003.
• Final contract completion date will be determined after approval of Change
Order No. 6. Anticipate developing final schedule and completion date for
February meeting.
• Based on current product rate completion is projected for October 2003 which is
behind planned date of July 2003.
7.0 PERCENT COMPLETE: 96% Phase I, 51.61 % of Change Order No. 5.
8.0 CONSTRUCTION/COORDINATION ISSUES
• Earth Tech will collect soil samples from cap soil stock pile (Mt. Tilley) week of
January 13, 2003.
• Earth Tech, DENR, and community technical advisor plan to collect off-site sediment
samples January 6, 2003.
• Northern extent of landfill has been determined through construction of test pits -no
change to original northeast comer point. Southeast comer point is estimated to be
20 feet east of as-built location.
• Estimated total of soil to be treated is 72,000 tons.
• Shaw to clear Pad 1 of oversized material and black cleaning residuals.
• Preliminary results to of PDT due to Shaw week of January 22, 2003, dioxins two
weeks later.

• The community technical advisor indicated that community concerns had been
addressed and did not identify any additional concerns.
• East extent of the landfill has been estimated and staked.
• Shaw was advised that liquidated damages were included in contract provisions.

approach to system maintenance, and develop a more comprehensive preventive
maintenance program.

1.0 Minutes of the January 3, 2002 monthly progress meeting were accepted with the
following comment: Terry Lyons, US EPA stated his opinion that the black residue on
Pad 1 consisted primarily of clay material mixed with black residue that resembled
carbon black.
2.0 PROJECT STATUS
• 6,936 tons of soil were processed in January with all batches meeting the
acceptance criteria.
• Target completion date for soil treatment has improved due to increased
production rate in January to August 6, 2003. Weather delays are likely to
extend date for substantial completion to October 3rd.
• Average PCB concentration of accepted soil is 0.127 ppm
• An addition of a diaphragm pump on the product cooler has resulted in increased
production rate.
• The performance demonstration test (PDT) was conducted January 7 -9, 2003.
Shaw will submit the laboratory data to EPA according to the schedule outlined
in the demonstration permit.
• Shaw will advise NCDENR regarding TSCA storage and labeling requirements
for the drums on Pad 1. Twenty-seven drums are currently stored on the Pad
with a total of 30 to 35 required to contain the entire black residue.
• Earth Tech will request that Shaw provide a change order (CO #7) for a test to
provide information on the treatment of clay soils from cap stockpile area (Mt.
Tilley).
3.0 WORK TO BE PERFORMED IN THE NEXT 30 DAYS
• February goal is 7,300 tons with net target production rate of 306 tons per hour.
• Shaw plans to excavate to the bottom liner in the southern end of the landfill this
month and conduct testing of clay liner. Shaw will scrape away the sand and
approximately one inch of clay, decon the bucket, and then excavate the next five
inches of clay.
• Earth Tech will provide a specification for placing stockpile and cap material
back into the landfill for soils that exhibit a PCB concentration of <1 ppm.
• Backfilling of landfill may start by the end of the month.
4.0 REVIEW OF CHANGE ORDERS
• Shaw to prepare Change Order #7 for a test of the thermal treatment of clay
material.
5.0 STATUS OF PERMITS, PROJECT DRAWINGS AND SUBMITTALS
• Status ofTSCA permit is on schedule with data submitted to EPA as outlined in
demonstration permit.
• Shaw rebuilt the sedimentation basin weirs with new #57 stone per
recommendation of NC inspector.
• The addition of gel-floe to the storm water treatment system appears to give good
results for removal of suspended particulates and associated PCBs.
• Shaw submitted application for NC GC contractor's license in January. The
board asked Show to provide additional information on bonding. The board will
review again in February.
6.0 REVIEW OF SCHEDULE COMPLIANCE
• Thermal treatment completion originally set for July 2003 but weather delays
will likely extend the project completion date into the first week of August.
7.0 PERCENT COMPLETE: 60 .33%.
8.0 CONSTRUCTION/COORDINATION ISSUES
• Earth Tech will collect soil samples from cap below the FML at sample points LF-13,
14 and 15.
• Earth Tech, DENR, and community technical advisor plan to collect additional off-
site sediment samples.
• Estimated total of soil to be treated is 72,000 tons.
• Shaw to clear Pad 1 of oversized material and black cleaning residuals.
• Addition of fuel oil to the product feed seems to minimize the formation of black
residue in the system, although Shaw feels this may also be due to absence of "bad"
feed materials.
• Liquid PCB quantity is lower than expected even with the addition of the fuel oil.
Shaw will present tracking of condensate production at next meeting.
9.0 COMMENTS FROM OWNER, SCO, CONTRACTOR, DESIGNER, AND
COMMUNITY
• The community technical advisor indicated that community strongly discourages
trucking landfill material off-site for disposal.
• Soil samples taken at the site in 1997 and stored at EcoFlo in Greensboro were
shipped back to the site for treatment. The shipment consisted of one 85-gallon
over-pack drum.

1.0 Minutes of the February 5, 2003 monthly progress meeting were approved without
comment.
2.0 PROJECT STATUS
• 6,468.57 tons of soil passed in February with average PCB concentration of 0.15
ppm. Four days were lost due to CP&L power outages.
• Production rate is 12-13 tons per hour (232 tons per day) gross production versus
Shaw's target of 306 tons per day.
• Pad No. 1 was has been cleaned of black residue and the residue placed in
approximately 30 drums.
• Shaw to complete seeding of north side of the site area by next Wednesday
(March li11).
3 .0 WORK TO BE PERFORMED IN THE NEXT 30 DAYS
• Shaw will conduct pilot test of the clay soils in the stockpile (Mt. Tilley)
tomorrow (March 6th). Earth Tech will monitor the test.
• Shaw has removed all waste material and first layer of clay from the southern end
of the landfill, and have exposed the clean clay bottom liner. Test results indicate
that the PCB concentration in the clay liner is below 1 ppm criteria.
• A sand seam at the southern end of the landfill near the top of the fill was found
to contain PCBs at a concentration of 19 ppm. Shaw will remove that material

1.0 Minutes of the March 5, 2003 monthly progress meeting were approved without

2.0 PROJECT STATUS
• 4,325 tons of soil passed acceptance criteria in March with an average PCB
concentration of 0.27 ppm. Average PCB concentration to date of the treated soil is
0.15 ppm with approximately 50% of the landfill processed.
• Production rate is 13-14 tons per hour (220 tons per day) gross production versus
Shaw's target of 306 tons per day. Shaw's monthly target is 7,800 tons.
• System was down 10 to 11 days due to hot tube removal and other repairs.
• Sand seam was removed from the south side of the landfill. Approximately 20 tons
required thermal processing; the remainder of the sand was clean.
• Results of the analysis of the clay landfill bottom liner were below verification
criteria, and backfilling of the landfill with treated soil was begun.
• A clean soil stockpile area was created in the vicinity of the east air monitoring
station (#2) to stockpile clean soil for the final cover.
3.0 WORK TO BE PERFORMED IN THE NEXT 30 DAYS
• Earth Tech will complete seeding and applying jute netting to the north soil stockpile
(Mt. Tilley).
• Earth Tech will collect soil samples on the north end of the landfill cover and in the

• Estimated extension to the contract time due to December 2002 ice storm and

estimated 72,000 tons of soil to be treated.
• Perimeter air monitoring results for March and for project to date were below North
Carolina toxic pollutant guidelines.
• To date, 2,123 gallons of fuel have been added to the feed soils. Fuel addition
stopped recently since soil is being removed from the upper portions of the landfill.
The "black snot" problem apparently occurs with soil at the bottom portion of the
landfill.
• EP A's budget passed but funds are frozen due to war in Iraq. EPA to reimburse
DENR directly for approximately $52,000 for performance demonstration test by
EQM when funds are released.
• Thermal treatment test of clay soil was completed. Soil was processed at a rate of 10
tons per hour. High moisture content in clay soil, fines carry-over, and greater
potential for failed batches would increase the cost for treating clay soils to at least
$234 per ton.
• Dioxins and furans TEQ in feed soils at 200 ppt in March. System has demonstrated
98% removal of those compounds so treated soils would be well below the treatment
criteria of 200 ppt TEQ.

1.0 Minutes of the July 9, 2003 monthly progress meeting were approved without comment.
2.0 PROJECT STATUS
• 6,363 tons of soil passed the acceptance criteria in July with an average PCB
concentration of 0.101 ppm. 372 tons of clay material from Mt. Tilley was treated
with average PCB concentration of BQL (Below Method Quantitation Limit).
Average PCB concentration to date of the treated soil is 0.140 ppm excluding the 372
tons of clay.
• Average production rate is 13 tons per hour (225 tons per day), including clay.
• During June/July, the unit was down for five days for repairs to the trunion bearings,
centrifuge, pug mill, and condensate system -total down time 201 hrs.
• Kimberly Summers was on-site during the week of July 4th to inspect erosion and
sediment control measures with no new issues being identified.
• Mt. Tilley was excavated a further 4-foot depth with 372 tons thermally treated and
the remainder placed in the landfill. Approximately five feet of Mt. Tilley remain for
disposition.
3.0 WORK TO BE PERFORMED IN THE NEXT 30 DAYS
• Shaw will excavate the remaining soils to the bottom of the landfill.
• Shaw will backfill the landfill as bottom grids are cleared and sampled.
• No major maintenance shut-downs are planned for the month.
• Earth Tech to complete sampling of the Mt. Tilley stockpile.
4.0 REVIEW OF CHANGE ORDERS
• Shaw to provide backup information on erosion and sediment control change
order.

• E&S measures inspected on during the week of July 4th with no issues identified.
6.0 REVIEW OF SCHEDULE COMPLIANCE
• The completion of thermal treatment is scheduled for September 22, 2003, including
that of the dewatered sludge from the lined pond. Substantial completion is
scheduled for November 18, 2003. Shaw will update the schedule each month based
on actual production. Revised contract time is September 26, 2003.
• Liquid PCBs will be disposed one week after completion of soil thermal treatment.

8.0 CONSTRUCTION/COORDINATION ISSUES
• Based on the amount of landfill area uncovered to date, there is no change in the
estimated 72,000 tons of soil to be treated.
• Perimeter air monitoring results for off-site location will be available in August.
• To date, 2,800 gallons of PCB liquids have been collected in the tanks, anticipate
3,000 to 4,000 gallons by project end. No fuel was added to the feed soils during
July.
• Shaw to provide plan for disposal of incompatible material (rocks or debris) that
cannot be thermally processed.
• Shaw is still waiting for EPA's contribution for the EQM sampling, will credit
DENR approximately $30,000 in subsequent application for payment following
receipt.
• Shaw to provide site restoration plan and final site sampling plan.
• DENR to prepare generator form for off-site disposal of condensate. Shaw to solicit
firm quotes based on analyses.
• Earth Tech will verify the estimated quantity of imported fill necessary for final

2.0 PROJECT STATUS
• 7,783 tons of soil passed the acceptance criteria in August with an average PCB
concentration of 96 ppb. 68 ,246 tons of material have been treated to date at an
average daily rate of 251 tons per day. Average PCB concentration to date of the
treated soil is 0.135 ppm excluding the 372 tons of clay treated in July.
• Average production rate is 251 tons per day.
• During August, the unit was down for 167 hours for repairs to the pug mill, kiln seal,
recirculation fan, and conveyor belt.
• No E&S inspection was performed by Kimberly Summers during August. Last
inspection was during the week of July 4th• No new issues were identified during that
inspection.
• On August 29, 2003 written approval was received from EPA region IV to place
material containing <10 ppm PCBs in the landfill at a depth of 15 feet below final
grade.
• Onyx completed sludge removal and dewatering from the lined pond (approximately
60 cy were removed).
3.0 WORK TO BE PERFORMED IN THE NEXT 30 DAYS
• Shaw will excavate the remaining soils to the bottom of the landfill.

• To date, 2,90 gallons of PCB liquids have been collected in the tanks; anticipate

1.0 Minutes of the September 2003 monthly progress meeting were approved without

2.0 PROJECT STATUS
• 8,894.36 tons of soil passed the acceptance criteria in September with an average
PCB concentration of0.156 ppm. 77,144.22 tons of material have been treated to
date with an average PCB concentration of 0.137 ppm excluding the 372 tons of clay
treated in July.
• Average production rate for September was 300 tons per day.
• During September, the unit was down for 24 hours for repairs and 48 hours due to
Hurricane Isabel.
• No E&S inspection was performed by Kimberly Summers during September, but an
inspection was made on October 8, 2003. No new issues were identified during that
inspection.
• Shaw has removed sediment from both on-site and off-site areas ( completed
10/7/03). Off-site material, approximately 40 tons, is staged on pad 4 for subsequent
disposal back into the former landfill.
• Written approval was received from EPA Region N to place material containing <10
ppm PCBs in the landfill at a depth of 15 feet below final grade.
3 .0 WORK TO BE PERFORMED IN THE NEXT 30 DAYS
• Shaw has completed excavation of all remaining landfill material, and confirmation
sampling of the clay bottom met acceptance criteria.
• Shaw will continue backfilling the landfill since all bottom grids have been cleared
and samples meet criteria.
• Shaw excavated an opening in the landfill bottom liner using a trackhoe. The
opening measures approximately 10 feet long by 5 feet wide. Depth is
approximately 8-10 feet below the top of the clay liner. The opening penetrated the
lower liner.
• Shaw to move a four-foot lift from Mt. Tilley into the landfill during the week of
October 13th .
• Earth Tech to complete sampling of the Mt. Tilley stockpile after four-foot lift is
removed.
• No major maintenance shutdowns are planned for the month of October. Thermal
treatment is scheduled for completion by October 15-16, 2003.
• Non-aqueous liquids collected to date approximately 3,300 gallons.
• Placement of final cover scheduled for mid-November.
• Equipment decontamination will commence once MSR has completed thermal
treatment (week of October 13111).
• Shaw to send Sampling and Analysis Plan (Rev. 4) to NCDENR and Earth Tech
week of October 61\ and NCDENR to forward plan to EPA Region IV.
4.0 REVIEW OF CHANGE ORDERS
• CO #13 -Treated Soil to 78,000 Tons approved.
• CO #14 -Increase in amount for Off-Site Disposal of Debris (material not
suitable for thermal treatment) pending approval.
• CO #15 -Erosion and Sediment Control -Mt. Tilley stockpile. Earth Tech
recommended approval in the amount of $18,618.00.
• CO #16 -Off-Site Sediment Removal -Letter of Authorization prepared for
Shaw to proceed on a time and material basis not to exceed $5 ,800.
• CO #17 -Final Tonnage. Change order will be prepared by Shaw after thermal
treatment is complete.
5.0 STATUS OF PERMITS, PROJECT DRAWINGS AND SUBMITTALS
• E&S inspection in October -Shaw to seed north side of the site and maintain
sedimentation basins until grass is established. Seed north side first, then seed
former landfill area.
• Non-discharge system handled a total of 4 million gallons total during the project
duration. John Hunt of DWQ inspected the system in September after hurricane
Isabel, and no issues were identified. Lined pond did not overtop during the
hurricane. Maximum wind speed measured at the site meteorological station was
45 mph.
• Untreated soil dioxin results were TEQ of 1 73 ppt, which is less than the
treatment standard.
• NC DENR to sample site monitoring well the last week of October and then
abandon the wells in accordance with the requirement contained in 15A NCAC
2C after the results are received in early December.
6.0 REVIEW OF SCHEDULE COMPLIANCE
• The completion of thermal treatment is scheduled for October 16, 2003 based on
additional soil in the landfill. Substantial completion is scheduled for December 15 ,
2003. Shaw will update the schedule each month based on actual production.
• Liquid PCBs will be disposed one week after completion of soil thermal treatment.
Shaw to record condensate oil volume prior to MSR decon.
7.0 PERCENT COMPLETE: 93.23% based on 78,000 tons.
8.0 CONSTRUCTION/COORDINATION ISSUES
• Perimeter air monitoring results had shown levels decreasing as soil was removed
from the landfill with the exception of week 36 where levels had increased.
• To date, 3,300 gallons of PCB liquids have been collected in the tanks; anticipate
4,000 gallons by project end. No fuel was added to the feed soils during August.
• Rocks to be crushed prior to thermal treatment.
• EPA has indicated to Shaw that they cannot reimburse for the addition sampling
performed by EQM during the performance demonstration test in January because it

was not part of their contract with EQM. The plan had been to reimburse under the
liquid phase demonstration test. Since the liquid will be shipped offsite, that is no
longer possible. EPA can only reimburse for the $30,000 by finding discrete work
that is to be done and having a contract approved and in place before the work is
done.
• Shaw to provide site restoration plan and final site sampling plan, and sealed as-built
drawings at project completion.
• DENR to prepare generator form for off-site disposal of condensate. Onyx has
approved acceptance of the oil for disposal.

1.0 Minutes of the October 2003 monthly progress meeting were approved without comment.
2.0 PROJECT STATUS
• Thermal processing of soils was completed October 18, 2003.
• A total of 82,092.51 tons of soil were processed by thermal desorption and passed the
acceptance criteria of 200 ppb. The net tonnage, not including haul road material,
was 81,622.71 tons. The average PCB concentration of all soils processed was 137
ppb.
• Shaw and their subcontractor MSR are demobilizing from the site with MSR
demobilization nearly 90% complete.
• Backfill of landfill and placement of soil cover is complete.
• Shaw plans to hydroseed landfill and disturbed site areas during the week of
November 24, 2003.
• One section of Pad 1 had been cleaned. The wipe sample results after cleaning were
below the EPA high occupancy wipe sample limit of ~ 0 ug/100 cm2 .
• No E&S inspection was performed by Kimberly Summers during October.
• Total organic liquid waste was 4273.Slgallons. Shaw will deduct the amount of oil
used for flushing equipment and the amount added to soil during thermal treatment to
determine a net quantity of organic liquid waste for payment. Organic liquid was
shipped to Onyx in Port Arthur, TX for destruction on November 14th ••

• Final demob to be completed by December 22, 2003.

1. Minutes of the November 2003 monthly progress meeting were approved without
comment.
2. Work performed in the last 30 days.
• System demobilization with expected completion by December 31 st•
• Decontamination Pad 4 complete. Pad 2 several areas complete. Pads 1 and
3 waiting for cleaning solution. Decontamination of all pads to be completed
by the last week in December.
• Hyrdoseeding cover and impacted site areas except in the area of the former
lined pond. Vegetation not apparent after 2 weeks of seeding completion.
• Installed storm water discharge line in the sump on Pad 4.
• Liner removed from the lined pond. Grading in the area incomplete. Results
of confirmation due week of December 15th .

3. Work to be performed in the next 30 days
• Complete cleaning of the pads. Water from cleaning solution to be placed into a
tanker truck for subsequent transportation for disposal.
• Abandon site monitoring wells (by NC DENR).
• Demobilize DENR and Earth Tech trailer. Shaw trailer to remain over the
winter.
• Complete storm water management controls on the pads.
• Close site water line and drain to prevent freezing over the winter.
4. Review of change orders ( outstanding/anticipated)
• Final erosion and sediment control change order and liquid PCB adjustment
combined into Change Order 20.
5. Review status of permits applications, project drawings and submittals
• Erosion controls inspection performed by K. Summers on December 5th• No
comments were noted during the inspection.
• Division of water quality will be on-site December 12th to inspection the
storm water treatment system. Shaw does not plan to set up the spray
irrigation system, if required, until the spring 2004.
• Non-discharge treatment system status/sampling results -Shaw to submit
laboratory analytical reports.
• Air permit reporting requirements/notification -Shaw to submit copies of
notification to Earth Tech
• TSCA permit reporting requirements/notification -Shaw to submit copies of
notification to DENR and Earth Tech.
6. Review construction schedule compliance
• Partial utilization beneficial occupancy complete by December 30, 2003.
• Shaw re-mobilization date April 12, 2004
• Substantial completion by May 10, 2004.
7. Percentage complete to be reported by Contractor (98.42%)
8. Discuss construction/coordination issues
• Earth Tech presented and updated air monitoring results for November 13th •
Site average concentration at the ambient standard.
• Earth Tech will provide the results of the laboratory analytical results from
soils collect from within landfill site by December 12th•
• Shaw to submit laboratory analytical reports, figure and summary from
samples collected from the clay liner.
• Shaw to submit laboratory analytical reports, figure and summary from
samples wipe samples collected on the pads.
• Shaw to furnished as-Built drawings and final report prior to substantial
completion.
• Shaw to provide a cost estimate for disposal off-site of non-salvageable
jersey barriers .

• Earth Tech to provide a preliminary punch list by December 19th•
• The Community Technical Advisor (CTA) Pat Barnes voiced the concern of
creating an LCID landfill with the disposal of the non-salvageable jersey
barrier in the unlined pond, and though it would create a misconception
among the community over disposal of ever inert material on the site after
completion of the "clean up".
