IT Corporation (IT) respectfully submits the following questions regarding our proposal for the
project referenced above as a result of recent receipt and review of the proposal documents and
discussions held in your office on December 7, 2000 at the pre-bid meeting.
1. Can the State please provide a standard price for No. 2 fuel oil as the basis for bid item #11?
2. Has the State identified any outlets for the treated oils?
3. Based upon experienced EPA permit review periods, the schedule provided previously, as well
as the state's time line to complete Phase I, it appears to require no less than 12 months. Is it
the States intent to charge liquidated damages upon themselves based upon something out of
the contractor and state's control? We request the 270 days be extended to at least 360 days as
a more reasonable reflection of the 4 to 6 month EPA review requirement that drives this
schedule.
4. What provisions are available to us and NCDENR to protect Confidential and Proprietary
Business Information that has been requested with the RFP response? In particular, we are
concerned that the Process Flow Diagram and Master Equipment List will not be maintained
confidential. We would like to submit accurate information, but this will be difficult if it must be
kept in a format suitable for the Public domain.
5. Other than including liquidated damages in the Phase I work, how is NCDENR making
assurance that the offeror's equipment will be available for mobilization to the Warren County
project? Are any other certifications being requested of the offeror's?

Dear Ms. Backus:
WRS Infrastructure & Environment, Inc. (WRS) and its teaming partners Arcadis, Focus
Environmental, and Environmental Chemical Corporation, has completed a preliminary
review of the Bid Package submitted to us for the Warren County PCB Landfill
Detoxification project. Based on our reviews, the WRS team has the following
questions:
1. Will the Contractor be allowed to manage secondary waste streams generated from
the CBCD and LBCD process off-site? Will the State of North Carolina sign
manifests moving these secondary waste streams to approved, off-site facilities?
2. What happens if the design and performance phase for the specified treatment criteria
fails to meet the treatment goals established for the project?
3. What is the remedy for the Liquid BCD phase of the performance testing if the LBCD
process fails? What are the performance requirements for the treated liquids from the
LBCD process?

QUESTIONS/CLARIFICATIONS

l. What is the design basis to be bid. Attachment 2 of the RFQ dated November
2000 entitled Basis of Bids includes broad ranges of values. Revised Section
11210 of the RFQ also includes a design basis containing nominal values and
ranges of values. It is difficult to accurately estimate a unit price to such a broad
range of values. Contractors will have to include contingency in the unit price to
cover the risk associated with such a broad range. A menu of unit prices will
more accurately define the values and thus allow Contractors to more accurately
price the units.
2. What are the organics, inorganics, and bound water fractions that make up the
TVS values presented in the RFQ. What is the chemical composition of the
organic and inorganic fractions of the TVS values.
3. What is the intent of the requirements contained in Appendix E. Are these
requirements applicable to new construction. Do they apply to existing
equipment.
4. Are costs required for hot and cold standby. Bid item 9 applies to cold standby
only (temporary demobilization of operating staff).
5. Bid Item 3 includes excavation and treatment of contaminated soils during the
Shakedown and performance test period. During this time, several thousand tons
of soil will be excavated and treated. How is the Contractor compensated for
excavation and treatment of soils during this Phase I period since Bid Item 11 in
Phase II includes excavation and treatment of the total base quantity of soils (i.e.,
72,000 tons). Should a quantity of soils be estimated and brought forward to Bid
Item 3 (and the corresponding quantity subtracted from the 72,000 tons).
6. Bid Item 2 includes excavation and treatment of contaminated soils from the
existing stormwater pond. How is the Contractor compensated for excavation and
treatment of these Phase I soils since Bid Item 11 in Phase II includes excavation
and treatment of the total base quantity of soils (i.e., 72,000 tons). Should a
quantity of soils be estimated and brought forward to Bid Item 2 (and the
corresponding quantity subtracted from the 72,000 tons).
7. Bid Item 12 includes treatment and off-site recycle of liquids. Liquids will be
required to be treated during the Phase I shakedown period and performance test.
How is the Contractor compensated for treatment and disposal of these Phase I
liquids since Bid Item 12 in Phase II includes treatment and disposal of the total
base quantity of liquids (i.e., 60,000 gallons). Should a quantity of liquids be
estimated and brought forward to Bid Item 3 (and the corresponding quantity
subtracted from the 60,000 gallons).

8. General Conditions-Article 8b states that all equipment must be new. Clarify that
previously used equipment will be permitted.
9. Material Weighing-Bid item 11 3f. Where is material to be weighed.
10. Additives-Bid item 11-3f. Should the cost of LBCD additives be included in this
bid item. Bid item 12 covers LBCD treatment but does not refer to additives to be
included in the costing.
11. Mobilization costs-Bid item 1 is called Mobilization but costs for mobilization
appear to be part of Bid item 2 (i.e., "Provide and install"). Clarify.
12. Process pads-Bid item 14.2e includes cost of decon/removal of the process pads.
We could not find the reference to the "see note below". Past meetings have
indicated that the process pads were to remain in place after decon, for future use.
Clarify that pads with curbs remain.
13. Division 11 Specifications-Section 11500, Sec 1.02 A 14-Table 1 and Section
11600 are not included.
14. There are two versions of some plans (Final December 1999 and Final March
2000). Clarify which plan is appropriate.
15. Is the pre-engineered metal building required by the contract?
16. Addendum No. 1, Section 02200 indicates that the Contractor is to use city water
for compaction and rewetting of treated soils. However in the measurement and
payment section 01270 bid item 3t indicates" re-hydrate treated materials using
the treated condensate water" . Also, bid item 11 p indicates "re-hydrate treated
materials using treated process water". Clarify
17. Addendum No. 1, Section 02513 indicates that all paved surfaces in the process
area including feed preparation, treatment, and treated soil storage will be
concrete. New spec drawings Sl shows the material prep area, half the blended
stockpile area, and the treated soil area as asphalt. Clarify.
18. Section 11000, BCD Detoxification System Equipment indicates that the
equipment shall be suitable for Class I Division II electrical classification with
purge control panels (NEMA 4X). Is this all enclosures that will be on the site or
just enclosures that by code will be in Class I Division II areas.
19. Article 5, Shop Drawings, Submittals, Samples, Data indicates that the contractor
shall submit to the designer all shop drawings, descriptive data, color charts, etc,
required for the work. All shop drawings shall be reviewed by the contractor and
shall bear the contractor's stamp of approval before forwarding to the designer.
Page 13. Clarify this is in reference for the new design build only and does not
include existing equipment.
20. Article 42 , guarantee indicates that the guarantee for latent defects related to the
structural system shall be 10 years. Define latent defects? Where does this apply?
21. Is the Contractor expected to pay permit fees or will these be waived or paid by
the state to themselves.
22. Has baseline air monitoring already been completed.
23. Page 02100-3 of the bid package states that EPA may perform stack monitoring,
etc. and that the contractor is to pay for these services. Is this statement correct or
will this be part of the in-kind services to be provided by EPA.
24. Is the Contractor to perform any air monitoring. If the EPA, State, and EarthTech
conduct all of the sampling, will the Contractor be allowed to QA/QC their data
and results.
25. Is it the intent of the NCDNER that blank sheets in Appendix Ebe filled out by
the bidder and submitted as a part of the bid.
26. Can the dollars or some portion of the dollars for Estimated Phase I Community
Resources also count to the Estimated Phase I Minority Business Participation
dollars or vice versa (also apply to Phase II).
27. The RFQ does not specify the number of copies of the proposal. Clarify how
many copies should be submitted.
28. Can the existing NPDES permit be modified for use during the remediation
project.
29. Can an on-site laboratory be used for the PCB immunoassays and/or the
verification samples.
30. Various laboratories have indicated a long turnaround time for analysis of
dioxin/furan samples. Can treated soils generated during the first 14 days of
operation be stockpiled awaiting analytical results. If yes, where?
31. Various laboratories indicate that PCB immunoassay tests can not quantify as low
as 200 ppb PCBs. Clarify that a detection limit in the low ppm range that will be
acceptable for immunoassays.
32. The schedule of values for Bid item 10 for top soil, fill and clay liner removal and
stockpile indicates that a lump sum cost be provided for 14,000 cubic yards.
Should the bid item include a unit cost since the quantity of material is estimated.
33. Some items that require off-site disposal can not be sent to a Subtitle D landfill
( e.g., the geotextile line in the landfill which can not be decontaminated by rinsing
or washing). Where should costs for these items be included.
34. In the event Phase II is not awarded, are the treated materials to be placed back in
the landfill prior to replacing the top soil and cover.
35. In which bid item should the costs for the Phase II performance/payment bond be
placed?
36. Is the property insurance referenced in Article 34c still required?

treatment permit?
2 Bid item 1-2(g). Perimeter ambient air standards -how were they
established by the state?
3 Bid item 1-2(g). Perimeter ambient air standards -has the state performed an analysis to
determine the detection levels that can be demonstrated using the required sampling and analysis
methodologies and are the detection levels below the ambient air standards?
4 Bid item 1-2(g). Perimeter ambient air standards -have they been compared to background levels
at the Warren County site?
5 Bid item 1-2(g). Perimeter ambient air standards -have they been
compared to standards at other sites?
6 Bid item 1-2(g). Perimeter ambient air standards -how will background levels be used in
determining compliance with standards during site operations activities at the Warren County site?
7 Bid item 1-2(g). Perimeter ambient air standards -what is the time duration of the period for
establishing background levels at the Warren County site?
8 Bid item 2-3(b). Perimeter ambient air monitoring equipment excluded from contractors scope of
work. Conflicts with Specification 02100-2 which requires contractor to install perimeter ambient
air mentoring stations.
9 Bid item 2(g). Air Monitoring Plan. Is anything required for perimeter monitoring since Earthtech is
responsible for implementing Perimeter Air Monitoring program?
10 Bid item 3. Performance demonstation test -will the state allowing spiking with a surrogate other
than PCBs that may be more readily commercially available?
11 Bid item 3. Performance demonstration test -Spiking with PCBs may be required per the
performance demonstration plan. Will the state imdemnify the supplier of the PCB spiking
materials for all claims related to disposal of residuals from the performance test?
12 Bid item 3-2(k). Does oversize and metallic material have to be deconned in accordance with 40
CFR 761 or can it be disposed of in a Subtitle C landfill?
13 Bid item 4-2(b ). What at the required procedures for performing the GEM
calibrations.
14 Bid item 5 & 6. These items conflict with the state's stated intention to allow interim operations
operations after performance demonstration if performance standards are met.
15 Bid item 5, 6 and 9. How are these to be addressed from a schedule standpoint, particularly as
related to liquidated damages?
16 Bid item 5. Does the state anticipate demobilization after the performance test. If so, how is
contractor paid remobilization.
17 Bid item 5. Scope of work not described in specifications. What is state's
rationale for including this item?
18 Bid item 6. Scope of work not described in specifications. What is state's
rationale for including this item?
19 Bid item 7. Are there two open houses or one? (Completion of construction and completion of
demo test are near the same time).
20 Bid item 11 . 11 /30/00 Addendum, Attachment 2. Does the 72,000 tons of contaminated soil

25 Bid item 11-2(ee). How will the state choose which of the several hundred potential air toxic
compoundsspecified in the NC Air Toxics regulations must be addressed in the air quality permit?
26 Bid item 11-2(ee). Is a NC DEHNR air permit required or does the

27 Bid item 11-2(ee). What dispersion model must be used to prepare the NC DEHNR air quality
permit and what is the scope of the dispersion modeling?

29 Bid item 11-2(0) -Spec 01010, page 5 requires stormwater to be treated to 1 ppb for PCBs. Bid

1. What is the design basis to be bid. Attachment 2 of the RFQ dated November
2000 entitled Basis of Bids includes broad ranges of values. Revised Section
11210 of the RFQ also includes a design basis containing nominal values and
ranges of values. It is difficult to accurately estimate a unit price to such a broad
range of values. Contractors will have to include contingency in the unit price to
cover the risk associated with such a broad range. A menu of unit prices will
more accurately define the values and thus allow Contractors to more accurately
price the units.
2. What are the organics, inorganics, and bound water fractions that make up the
TVS values presented in the RFQ. What is the chemical composition of the
organic and inorganic fractions of the TVS values .
3. What is the intent of the requirements contained in Appendix E. Are these
requirements applicable to new construction. Do they apply to existing
equipment.
4. Are costs required for hot and cold standby. Bid item 9 applies to cold standby
only (temporary demobilization of operating staff).
5. Bid Item 3 includes excavation and treatment of contaminated soils during the
Shakedown and performance test period. During this time, several thousand tons
of soil will be excavated and treated. How is the Contractor compensated for
excavation and treatment of soils dming this Phase I period since Bid Item 11 in
Phase II includes excavation and treatment of the total base quantity of soils (i.e.,
72,000 tons). Should a quantity of soils be estimated and brought forward to Bid
Item 3 (and the conesponding quantity subtracted from the 72,000 tons).
6. Bid Item 2 includes excavation and treatment of contaminated soils from the
existing st01mwater pond. How is the Contractor compensated for excavation and
treatment of these Phase I soils since Bid Item 11 in Phase Il includes excavation
and treatment of the total base quantity of soils (i.e., 72,000 tons). Should a
quantity of soils be estimated and brought forward to Bid Item 2 (and the
c01Tesponding quantity subtracted from the 72,000 tons).
7. Bid Item 12 includes treatment and off-site recycle of liquids. Liquids will be
required to be treated during the Phase I shakedown period and perf 01mance test.
How is the Contractor compensated for treatment and disposal of these Phase I
liquids since Bid Item 12 in Phase II includes treatment and disposal of the total
base quantity of liquids (i.e., 60,000 gallons). Should a quantity of liquids be
estimated and brought forward to Bid Item 3 (and the conesponding quantity
subtracted from the 60,000 gallons).

8. General Conditions-Article 8b states that all equipment must be new. Claiify that
previously used equipment will be permitted.
9. Material Weighing-Bid item 11 3f. Where is material to be weighed.
10. Additives-Bid item 11-3f. Should the cost of LBCD additives be included in this
bid item. Bid item 12 covers LBCD treatment but does not refer to additives to be
included in the costing.
11 . Mobilization costs-Bid item 1 is called Mobilization but costs for mobilization
appeai· to be part of Bid item 2 (i .e., "Provide and install"). Clarify.
12. Process pads-Bid item 14.2e includes cost of decon/removal of the process pads.
We could not find the reference to the "see note below". Past meetings have
indicated that the process pads were to remain in place after decon, for future use.
Clarify that pads with curbs remain.
13 . Division 11 Specifications-Section 11500, Sec 1. 02 A 14-Table 1 and Section
11600 are not included.
14. There are two versions of some plans (Final December 1999 and Final Mai·ch
2000). Claiify which plan is appropriate.
15. Is the pre-engineered metal building required by the contract?
16. Addendum No. 1, Section 02200 indicates that the Contractor is to use city water
for compaction and rewetting of treated soils. However in the measurement and
payment section 01270 bid item 3t indicates" re-hydrate treated materials using
the treated condensate water" . Also, bid item 11 p indicates "re-hydrate treated
materials using treated process water". Clarify
17. Addendum No. 1, Section 02513 indicates that all paved surfaces in the process
area including feed preparation, treatment, and treated soil storage will be
concrete. New spec drawings S 1 shows the material prep area, half the blended
stockpile ai·ea, and the treated soil area as asphalt. Clarify.
18. Section 11000, BCD Detoxification System Equipment indicates that the
equipment shall be suitable for Class I Division II electrical classification with
purge control panels (NEMA 4X). Is this all enclosures that will be on the site or
just enclosures that by code will be in Class I Division II areas.
19. Article 5, Shop Drawings, Submittals, Samples, Data indicates that the contractor
shall submit to the designer all shop drawings, descriptive data, color chaits, etc,
required for the work. All shop drawings shall be reviewed by the contractor and
shall beai· the contractor's stamp of approval before fmwarding to the designer.

20. A1ticle 42 , guarantee indicates that the guarantee for latent defects related to the
strnctural system shall be 10 years. Define latent defects? Where does this apply?
21. Is the Contractor expected to pay pe1mit fees or will these be waived or paid by
the state to themselves.
22. Has baseline air monitoring already been completed.
23 . Page 02100-3 of the bid package states that EPA may perform stack monitoring,
etc. and that the contractor is to pay for these services. Is this statement conect or
will this be part of the in-kind services to be provided by EPA.
24. Is the Contractor to perform any air monit01ing. If the EPA, State, and Ea.1th Tech
conduct all of the sampling, will the Contractor be allowed to QA/QC their data
and results.
25. Is it the intent of the NCDNER that blank sheets in Appendix Ebe filled out by
the bidder and submitted as a part of the bid.
26. Can the dollars or some portion of the dollars for Estimated Phase I Community
Resources also count to the Estimated Phase I Minority Business Paiticipation
dollars or vice versa (also apply to Phase II).
27. The RFQ does not specify the number of copies of the proposal. Claiify how
many copies should be submitted.
28. Can the existing NPDES permit be modified for use during the remediation
project.
29. Can an on-site laboratory be used for the PCB immunoassays and/or the
verification samples.
30. Vaiious laboratories have indicated a long turnaround time for analysis of
dioxin/furan samples. Can treated soils generated dming the first 14 days of
operation be stockpiled awaiting analytical results. If yes, where?
31 . Various laboratories indicate that PCB immunoassay tests can not quantify as low
as 200 ppb PCBs. Claiify that a detection limit in the low ppm range that will be
acceptable for immunoassays.
32. The schedule of values for Bid item 10 for top soil, fill and clay liner removal and
stockpile indicates that a lump sum cost be provided for 14,000 cubic yards.
Should the bid item include a unit cost since the quantity of material is estimated.
33 . Some items that require off-site disposal can not be sent to a Subtitle D landfill
(e.g., the geotextile line in the landfill which can not be decontaminated by rinsing
or washing). Where should costs for these items be included.
34. In the event Phase II is not awarded, are the treated materials to be placed back in
the landfill prior to replacing the top soil and cover.
35 . In which bid item should the costs for the Phase II petformance/payment bond be
placed?

IT Corporation (IT) respectfully submits the following questions regarding our proposal for the
project referenced above as a result of recent receipt and review of the proposal documents,
including Addendum #1 .
1. It is stated that the contractor is to pay for sampling costs associated with the debris. Can the
State define a number of anticipated samples for bidding purposes?
2. The 270 calendar days stated as the period of performance, prior to the initiation of liquidated
damages, appears to be in conflict with other statements regarding project completion by
December 31 , 2002. (Article 23 of Supplementary General Conditions) Please clarify which is
the true project schedule and exactly when the liquidated damage clause will be initiated.
3. Are the contractors expected to include in their price the $66,000.00 quoted for electrical
upgrade to the site?
4. Has this work been done or is it our responsibility to coordinate installation after award?
5. Is there a transformer at the electrical termination priced above?
6. What voltage will be brought to within 120' of the site boundary?
7. The treatment standard has been set for the LBCD process at 2 ppm PCB and this is a
performance specification. Please define and or clarify what, when and how will the
determination be made to switch from payment under bid item #12 and the optional off-site
incineration unit rate.
8. Do Davis Bacon or prevailing wage rates apply? If so please provide the local wage
determinations.

9. Section 2.5 Subcontractor Responsibilities: "Subcontractor employees working on-site
exclusively in the support zone (e.g. site preparation and site restoration activities) will require the
necessary training per 29 CFR 1910.120/1026.65 and participate in the drug testing." IT
interprets this to mean that the subcontractor personnel receive the site orientation and HAZCOM
training. Will the Owner require any additional training?
10. Section 1.5 Scope of Work and Treatment Systems. Must all the diagrams, listed in this
section be included in the HASP or can the HASP reference the design plans.
11 . Table 6-2 **** Organic Vapor Readings: Sustained monitoring period consists of 20 readings
taken every 15 seconds." Should this read 15 minutes?
12. Section 13.0 Log, Reports and Record Keeping: "Medical records shall be maintained on
site, in a locked area, as well as in the employer's office for their employees." Is he medical
clearance certification, signed by the attending physician, sufficient to meet the statement, or
must each employees full medical file be maintained on-site?
10. The revised specification section 11400 in the RFP requires treatment of the process
condensate aqueous phase to either 0.2 or 0.5 microgram/liter, depending on which revised
subsection requirement is used. This is 1000 times lower than the original design specification.
There is no established basis for any specification on the PCB content of this water, either in the
State law mandating the site's cleanup or in a specific regulatory requirement. We know of no
basis for having such a low numerical specification on process condensate that is going to be
reused for soil cooling water supply. Please either eliminate this requirement or change this
requirement back to the original requirement of 200 microgram/liter.

PCBs, create unsafe operating parameters for the detoxification unit, create unsafe
working conditions for the health and safety of the site workers and surrounding
community. Will the State allow for the recovered organic liquid phase to be
incinerated at an approved TSCA off-site incinerator under Unit Cost Item #2?
