It is the responder's responsibility to utilize whatever delivery means available to guarantee delivery in 401 Oberlin Road, Suite 150, Raleigh, NC, by the specified time noted. 1.5 The State of North Carolina by this process is requesting information concerning a project that has not and may never be authorized. All participation is voluntary and all submissions are appreciated. Organizations responding to this request will not become an exclusive list of vendors should the process continue on to a future Request for Proposals. 1.6 Refer technical inquiries to address/person specified in 1.3. 1. 7 Cost for Statement Preparations: The State will not reimburse responders for costs incurred in the preparation of a response. 1.8 Proprietary Information: All information will be open for public inspection. Warren County PCB Landfill Detoxification Request for Information Page2 PART II BACKGROUNDANDSCOPEOFWORK A. BACKGROUND In 1982 a landfill permitted under the Toxic Substances Control Act (TSCA) was constructed in Warren County, North Carolina. The purpose of the landfill was to contain soil that had been contaminated from the illegal spraying of liquids containing PCBs along 210 miles of road in North Carolina. The contaminated roadsides were listed as a Superfund site and the Warren County PCB Landfill was the selected remedy. Many in the community felt that the Warren County was the selected location for the landfill because it has a predominantly minority population and is one of the poorer counties in the state. Residents and civil rights leaders vehemently protested the location of the landfill in Warren County. That community activism was considered the "watershed event" that brought environmental justice to the national level. The governor of North Carolina at the time, James B. Hunt, Jr., wrote a letter to the citizens promising that the State would "push as hard as it can for detoxification of the landfill when and if the appropriate and feasible technology is developed." A study conducted in the mid-1980s concluded that no such technology was available. When Governor Hunt was re-elected in 1992, a Joint Warren County/State PCB Landfill Working Group (Working Group) was established to study the status of the landfill and determine the feasibility of detoxification. The NC General Assembly appropriated $1 million for this purpose. An extensive site assessment was conducted in 1997 and detoxification technologies were researched and evaluated at the bench-scale. After Phase I -Pilot Scale Testing in 1997 using material from the landfill, the Working Group selected Base Catalyzed Decomposition (BCD) as the best and safest process for the site. The process met the Working Group's treatment requirements plus fulfilled the objectives to destroy PCBs and dioxins rather than only separating the contaminants from the soil. The State Assembly supported the Working Group's selection when in the "Current Operations Appropriations and Capital Improvement Appropriations Act of 1998" it stated that "based catalyzed decomposition (BCD) technology shall be used to detoxify the landfill". It also stated "treatment standards for residual concentrations of contaminants remaining in the soil shall be 200 parts per billion for PCBs and 200 parts per trillion toxicity equivalent concentration (TEQ) for dioxins/furans." A Phase II -Preliminary Design for the detoxification using the BCD process was completed in 1998 and estimated the treatment and restoration cost at $14-20M. Phase Ill -Final Design is underway and should be completed in November of 1999. It is estimated that a request for proposals for the implement of the final phases of the detoxification project will be issued in January 2000. Selection of a detoxification contractor will occur in the spring of 2000 with start of work expected within six months of the award of the contract. The selection of a detoxification technology completed the mission of the Working Group. A new Citizens Advisory Board (CAB) is being established whose mission is to work together to complete detoxification of the landfill. Their role will include serving as a liaison to the State on behalf of the Warren County community, providing education and updates to the community about PCB Landfill issues, and developing specifications for detoxification of the landfill and for the selection of a contractor. B. SITE DESCRIPTION The State owns and maintains a closed landfill (July 1983) containing PCB-contaminated soils in Warren County, North Carolina . This landfill is permitted under the TSCA and contains approximately Warren County PCB Landfill Detoxification Request for Information Page3 40,000 cubic yards of contaminated soil. The soil came from the illegal disposal of PCB-contaminated liquids along North Carolina roadsides. The landfill is located on a 142-acre tract of land on the east side of SR 1604 approximately 1.5 to 2.0 miles from the intersection of SR 1604 and US 401, 2-3 miles south of Warrenton. The containment area of the landfill cell occupies approximate 3.8 acres and is enclosed by a fence. Leachate is pumped semi-continuously from the landfill and passes through sand and activated carbon filters before discharging to an 800,000-gallon collection pond. A spray irrigation (non-discharge) permit is maintained for the facility, so that any treated leachate can be routed to an irrigation system installed along the crest of the landfill. No NPDES permit is available. The unpaved entrance road is maintained by the NC Department of Transportation and was designed to handle large soil-laden dump trucks. PCB-contaminated soils contained in the landfill have been physically characterized as coarse- grained, with less than 30% passing through a #200 sieve. Their liquid limit and plasticity index is 25 and 8 respectively. Total organic or humic content is less than 2%. The average concentration of PCBs is approximately 350 ppm with a range of 150 to almost 900 ppm. The PCBs are a mixture of PCB congeners with approximately 61% Aroclor 1260, 27% Aroclor 1254, and 12% Aroclor 1242 by weight. Other chemicals such as chlorinated benzenes, furans, and dioxins are present in ppq to ppb concentrations. C. POTENTIAL SCOPE OF WORK The remaining phases of the detoxification project are treatment and restoration/demobilization. The treatment phase will include site preparation, obtaining required permits, excavation of landfill materials, demonstration testing of the process, soil treatment, process wastewater treatment, and monitoring/testing of air, soil , and water. The restoration/demobilization phase will include backfilling of material; reclamation of the site; and decontamination, dismantlement, and demobilization of the equipment. As stated previously, the selected process for remediation of the site is BCD. In Phase I Pilot Testing, the process demonstrated its capability to meet the stringent treatment requirements established by the Working Group of residual concentrations of 200 parts per billion for PCBs and 200 parts per trillion TEO for dioxins/furans. Other processing requirements are that the concentration of contaminants in the air measured during excavation and processing at the property line not exceed 8 x 10-4 micrograms per cubic meter PCBs and 5 x 1 o-8 micrograms per cubic meter TEO for dioxins. It is the desire of the Working Group that the property requires no further operations or maintenance after the detoxification and that the property can be used to benefit the community. The BCD process was invented and patented by the U. S. Environment Protection Agency's (EPA) National Risk Management Research Laboratory (NRMRL). (Information on the process and licensing can be obtained from George Huffman at U.S. EPA/ NRMRL, 513-569-7431). The PCB Landfill is subject to TSCA regulations (40 CFR 761) and is considered as alternative methods of disposal under TSCA. The State will facilitate and administratively support respondents' efforts to obtain US EPA approval. Phase Ill -Final Design is underway and should be completed in November of 1999. It is estimated that a request for proposals for the implementation of the final phases of the detoxification project will be issued in January of 2000. A copy of the Final Design Report will be included in the request to aid in the preparation of bids for the project. Site visits will also be conducted at that time. Selection of a detoxification contractor will occur in the spring of 2000 with start of work expected within six months of the award of the contract. The treatment and demobilization is expected to require approximate 18-24 months. Warren County PCB Landfill Detoxification Request for Information Page4 The Phase Ill -Final Design will include the following elements: □ Completed Site and area surveys □ Geotechnical evaluations of area under each proposed structure □ Site layout and logistics □ Soil material handling □ Building, Structures, Parking and Personnel Support Areas □ Infrastructure Improvements including improvements to access road and perimeter road □ Stormwater Management □ Construction or assembly and setup of equipment □ Excavation of the Landfill □ PCB Soil Treatment and Process Design □ ConfirmationNerification Sampling □ Decontamination □ Backfilling and Final Grading □ Project Work Plans ► Community Involvement Plan ► Project Health and Safety Plan ► Performance Demonstration Plan ► Air Monitoring Plan ► Site Operations Plan ► Quality Assurance Project Plan ► Final Verification/Confirmation Sampling Plan ► Construction Quality Assurance Project Plan ► Emergency Response Plan The vendor chosen for the detoxification will be expected to work cooperatively with the State, CAB, and community. The Warren Family Institute has received a grant from the EPA to fund a full-time Community Involvement Coordinator and a part-time job developer. The vendor chosen will be expected to work with them to ensure the community is informed of the progress of work at the site and to ensure that the community receives economic benefits from the project. Training and employment of local citizens and the purchasing of supplies and services from local businesses during the detoxification will be expected. Also note that financial assurance will be required for the performance of detoxification and closure should the project proceed to implementation. Warren County PCB Landfill Detoxification Request for Information Pages Part Ill INFORMATION REQUEST RESPONSES Each responder is asked to submit two (2) copies of their information concerning the ability of their organization to perform the services described in the potential Scope of Work. The technical qualifications may be narrative in form. The basic information requested is outlined below. Additional information may also be included. A. Organization Information A. Name Provide the legal firm name of the responder. B. Mailing Address Provide the principal contact, office street address, and mailing address. C. Principal Contact's Telephone Number(s) Provide the daytime phone number including area code of the responder's authorized contact with the authority to answer questions concerning the information supplied. B. Nature of Business Provide information describing the legal business entity, size, organizational structure, functions, and length of time in the remediation business for the firm D. Technical Expertise The responder should address their organization's ability to perform the services described in the potential Scope of Work. E. Project experience Describe your organization's remediation experience. Experience in large (>20,000 yd\ full-scale remediation of sites contaminated with PCBs, dioxins, or related compounds utilizing indirect heat thermal desorption or the BCD process would be preferred. Examples of quantities of waste treated, length of projects, treatment levels obtained during remediation, the ability to mobilize equipment, and ability to work with the community are also requested. Previous clients that can attest to the experience and performance of the vendor s may also be included. The vendor is welcome to provide any additional information that he deems appropriate. F. Key Personnel Identify key individuals in responder's organization that are involved in remediation projects and their role, training, and experience. Warren County PCB Landfill Detoxification Request for Information Page6 Add to Part III -Technical Proposal and Cost Proposal All copies shall be properly executed, all blank spaces shall be filled in, and any interlineations, alteration, or erasures shall be formally explained and initialed by the offeror. Failure to comply with these requirements may be cause for rejection of your bid. Partial or incomplete bids may not be considered. Bids shall be in strict conformity with the solicitation documents and any amendment thereto. All information provided with you bid shall be on 8 ½" x 11" format, indexed with a table of contents. Larger sizes may be used for drawings if they are folded to fit in the bid. Minimum Qualification of Offerors The state reserves the right to reject any bid if the evidence submitted by the offeror, or the investigation of such offeror, fails to satisfy the state that such offeror has no conflict of interest in performing the work, and is properly qualified to carry out the obligations of the Solicitation Documents and to complet the Work contemplated therein in accordance with the requirements and schedule wherein. An offeror may be investigated to determine ifit is qualifies to perform the Work. To assist in this investigation, the following items must be submitted with your bid. These minimum qualifications must be met by the Contractor, including any second-tier subcontractors. a. Evidence that the firm submitting the bid is authorized to do business in the jurisdiction where this project is located ( at a minimun, this must include General Contractors license, documentation of an individual's North Carolina Professional Engineering registration, or the firm's license to provide engineering services). b. Conflict oflnterst Statement -each candidate must submit a statement that there are not personal or organizational conflicts of interest in the preformance of this work. A conflict of interest will disqualify a candidate from further consideration. c. Names and locations of a minimum of three (3) projects of like magnitude, with a bried narrative description, cost, and a customer contact name and phone number . Projects must have successfully used thermal desorption for the treatment of contaminated soil. d. Listing of any majoy second-tier subcontractors needed to complet the work herein. The listing shall, at a minimum, include name and address of the proposed subcontractor, description of the work to be subcontracted, type of subcontract anticipated, and an extimated value of the subcontract. e. An insurance certificate indicating your ability to meet the insurance requirements. f. Written confirmation from your bonding agent that your firm can obtain payment and performance bonds as specified elsewhere in this oslicaitation for remedial action work of this nature at an NPL site. g. Evidence that your firm can comply with the Health and Sefety requirements of this solicitation. This information shall include, at a minimum, your firm's Interstate Experience Modification Rate (EMR) and OSHA 200 logs for the three (3) most recent years and total number of hours workde deach year. If the state where the job site is located has an EMR, provide the same information for that state. h. Evidence that your firm can provide a Critical Path Method (CPM) schedule with time-phased bar chart showing the order in which the Work will be performed for the duration of te project, which can be easily updated on a weekly basis. 1. Provide a copy of your firm's QA plan that provided QNQC requirements and procedures for the types of work required herein. J. Listing of key personnel with resumes for each person. Listing shall, at a minimum, include resumes for a Project Manager and a Field Superintendent, a Field Quality Control Manager, and Chief Operator. Each of these individuals must have at least three (3) years experience in the construction and operation of similar soil remediation systems. k. Provide the corporate experience of the organization performing the completiono fo the detailed design of the treatment system. This firm must have at least fine ( 5) years experience in the design and operation of thermal desoprtion. Provide the name and resume of the Design Manager, who shall have at least three (3) years experience in the desing andoperation of thermal desorption systems. Solicitation Documents Complet sets of solicitation documents shall be used in preparing bids. The state assumes no responsiblitiy for errors or misinterpretations resulting from the use of incomplet sets of solicitation documents. The State, in making copies of solicitation documents available, does so only for the purpose of obtainign bids on the Work and does not confer a license or grant for any other use. The following additional documents will be provided at the Pre-bid Conference for use as background information. These will become part of the solicitation document. Phase III final design Phase I Other Information ??? Before submitting a bid, each offeror must (a) examine the solicitation documents thoroughtly, (b) familiarize itself with local conditionsa that may in any manner affect cost, progress, or performance of the work, ( c) familiarize itself with Federal, State, and local laws, ordinances, rules and regulations that may in any manner affect cost, progress, or performance fo the Work, and (d) study and carefully correlate offeror's observations with the requriements of the Solicitation Documents. Failure to become familiar with the Solicitation Documents and the project area will be at the offeror's risk. The submission of a bid will constitute an indisputable representation by the offeror that it has read and understood every requirement ofthis solicitation, and that the Solicitation Documents are sufficient in scope and detail to indicate and convey understanding of all terms and conditions for pricing and performance of the Work. Pre-Bid Conference It is the responsibility of the respondent to read and become completely familiar with all information in this solicitation. Under 1. 7 specifications, how much deviation is allowed. This needs to be stated. Activities included in the Statement of Work must commence with five (5) days of Written Notice to Proceed and must be completed in accordance with the schedule provided in the SOW. BID Forms Each Bid shall be submitted on the Bid Forms provided in this solicitation. Bid Forms shall be completed (with a price provided for each item) in ink or typewritten and manually signed. The Bid Price shall be stated in words and figures. Bids by corporations shall be executed in the corporate name by the president or vice-president (or other corporate officer accompanied by evidence of authority to sign), and the corporate seal shall be affixed and attested by the secretary or an assistant secretary. The corporate address and state of incorporation shall be shown below the signature. Bids by partnerships shall be executed in the partnership name and signed by a partner whose title shall appear under the signature. The official address of the partnership shall be shown below the signature. All names shall be typed or printed below there signature. The Bid shall contain an acknowledgement of receipt of all Amendments (the numbers of which shall be filled in on the Bid Forni). Each erasure or change appearing on the Bid Forms must be clearly initialed by the offeror. The address to which all future communications regarding the Bid are to be directed shall be shown. Any modifications or withdrawal of a bid is subject to the same conditions as submitting a bid. Bids may be modified only by an appropriate document duly executed (in the manner that a bid must be executed) and delivered to the place where bids are to be submitted at any time prior to the due date and time for bids. Bid may be withdrawn prior to the scheduled time ( or authorized postponment thereof) for the opeing of bids. BASIS FOR AW ARD The State will award a contract resulting from this solicitation to the responsible otferor whose offer clearly indicated that the offeror has met all the solicitation requirements established herein, and provides the lowest price (Bid Total from the Bid Forms) to the state for all the work called for herin. The State intends to make two awards for this solicitation. In accordance with the desires of the community, the first award will be made to the qualifies offeror who has the capabilities to utilize BCD. The second award will be made to the qualifies offeror that will utilize thermal desorption without the BCD process. If necessary to assure complete understanding of all offers, the State may conduct discussions with any or all of the offerors. Award of the contract For any resultant contract, the state expects to give the successful offeror a Notice of Award within sixty ( 60) days after the actual offers are due. All offers shall remain valid for at least one hundred fifty ( 150) days after the actual date offers are due, but the state may, in its sole discretion, release any bid and reture the Bid Security prior to that date. The initial award will be given to the successful offeror that can provide thermal desorption with the BCD process. The state will then have the optin to issue a second award if the intiial offeror cannot demonstrate compliance with stack testing emission standards and/or soil remediation goals. Execution of the Contract When a Notice of Award is given to the succssful offeror, it will be accompanied by copies of the Contract and all other applicable Solicitation documents. Within five (5) days, excluding Saturdays, Sundays, and legal holidays, after the date of receipt of such notification, the Contractor shall execute and return all copies of the Contract and all other applicable Solication Documents to The State. The State will deliver one (1) fully signed copy to the Contractor. The type of Contract resulting from this solicitation will be _______ . Bids for any other type of Contract will not be considered. All materials and equipment fo rthe project shall be furnished by the Contractor, unless otherwise specifically prescribed. They shall conform to the Drawings and Specifications and ahsll be from a source acceptable to the State. Use of community resources. Retention Bids submitted in response to the soliciation will not be returned, but will be retained by the State to doucment the procurement. Performance and Payment Bonds The successful offeror shall furnish performance and payment Bonds with five ( 5) days of Award of a Contract, each in an amount at least equal to the Total Contract Price ( excluding priced option) as Security for the full and successful performance and prompt payment of all Contrator' s obligations as specified in the Solicitation Documents Subcontracting Plan Offerors must provide wit their bid a Small Business and Small Disadvantaged Subcontracting Plan which meets all the requirements of the FAR clause 52.219-9. Offerors shall state in a letter with their plan any current or past subcontracting gosals for Small Business and Small Disadvantaged Business along with their current statue in meeting these goals. Any variance from goals shall be explaned. ???? Certified Cost or Pricing Date All offerors are reminded that Certified Cost or Pricing Data has not been requested with your bid, as sufficient competition is expected. Certified Cost or Pricing Data may, however, be requested by the State at any time. Any requested date must be provided with ten ( 10) days of request or your offer may be considered non-responsive.
