7) State Agreements [MOU and or PPAs]
MOU
General. The Region has MOUs/M:OAs/EAs (Agreements) for all major delegated programs in
each state. These are updated and or modified on an annual basis. In those instances where an
Agreement has not been enter/signed for a current year (i.e. FY 1998), it is understood that states
will continue operating under the elements and criteria set out in the most recent Agreement.
PPAs/PPGs
General. The I{egion has been careful to follow all OECA policy memoranda when negotiating
PP As with its states. Each 98 PPA incorporates the OECA requirement for specific enforcement
targets. There has been no objection to this from any state. In addition, the Region has strongly
encouraged each state to adopt the ECOS Accountability Measures. The states considering PP As
have indicated this will not be a problem. Somewhat surprisingly, five states out of eight are not
interested in converting their traditional individual grants to consolidated PPGs. The reason:
individual state program managers worry they won't be allocated the full portion of funds they
operate with now if those funds are comingled with other funds.
Alabama. The Region has not signed any agreements, either PP A or PPG, with the State of
Alabama. The Region does not anticipate any 98 agreements.
Florida. The Region had a PPA with the State of Florida during 1997. This agreement was not
the work plan for the grants, instead it concerned smaller, separate projects aimed at improving
environmental results and communication between EPA and the State. The 98 PP A will focus on
coordinating the Regional and State enforcement strategies across all media programs. The State
has not expressed interest in a PPG.
Georgia. EPA had a limited 97 PP A and PPG with the State. Georgia has increased the scope of
its PPA and PPG to include, for 98, the following programs: Air 105, Water 106, Groundwater,
RCRA, UST, PWSS, Information Management, and multi-media. The State agreed to incorporate
the ECOS Accountability measures into the 98 PP A.
Kentucky. The State has shown no interest in either PPAs or PPGs.
Mississippi. The State has a 97 PP A with the Region which is limited in scope and not connected
in any way to the PPG. The State is experimenting with reinventing permitting to make it more
user-friendly. The 98 PP A will incorporate the outputs from this effort. Currently the PPG covers
Air 105, Water 106, and RCRA, and its purpose is to save administrative time.
North Carolina. The State and the Region had a limited PP A in 97, more as an experiment in
cooperation and communication than anything else. After a self-assessment in mid 1997,-
negotiations began on the 98 PP A. The State will be working with the Region to coordinate
enforcement strategies for 98 and beyond. The State has shown no interest in a PPG.

South Carolina. The State has asked to be considered for a 98 PPG covering all present grants
eligible. No interest has been expressed in PP As.
Tennessee. An interim PPA is allowing re-engineering efforts (a combination of reinvention of
various programs and a reorganization of the department) to rollforward. EPA is providing the
services of A. T. Kearney as a consultant to the State to speed this along. When this effort closes
out, the 98 PPA will incorporate most of the accepted changes. Tennessee has shown no interest
in a PPG.
