Box 27687, Ra!eigh, I-Jorth Carolina 27611-7687 Telephone 919-733-7375 An Equc' Opportunity Affinnative Action Employer STATE OF NORTH CAROLINA COUNTY OF WAKE Cooperative Agreement CONTRACT NUMBER This Cooperative Agreement is made between the North Carolina Department of Environment, Health, and Natural Resources and the North Carolina Department of Justice for the purpose of assisting the Department of Environment, Health, and Natural Resources in the development and refinement of an enforcement program and procedures for implementation of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) in this state. It is AGREED that: A. The Department of Justice shall provide (i) an attorney knowledgeable in the area of CERCLA and related areas; (ii) legal assistance and advice as required; (iii) technical supervision of the aforementioned attorney, (iv) and a secretary. B. The Department of Environment, Health, and Natural Resources shall reimburse the Department of Justice a sum not to exceed $77,000 (Seventy-seven Thousand Dollars) upon receipt of quarterly expenditure reports reflecting actual expenditures incurred for salaries and benefits for one attorney position and for one secretarial position. These reports are due to the Department of Environment, Health, and Natural Resources, Fiscal Management Office, within thirty (30) days of the end of each quarter. The Department of Environment, Health, and Natural Resources shall also pay all necessary expenses, including travel for the attorney and secretary. C. Either party may terminate this agreement by giving thirty (30) days written notice to the other party. If the agreement is terminated, the Department of Justice will be paid an amount which bears the same ratio to the total compensation as the services actually performed to the total services covered by this agreement. , • -..,. i, IJJ.J INl(leit--A 10/~9 2. ' The purpose of the Cooperative Agreement between the Department of Environ- ment, Health, and Natu.ral Resources and the Department of Justice is to provide legal services for the' federal Superfund program as implemented by the Department. 25 percent of the attorney's salary is provided by State funds: therefore, 25 pe~cent of the attorney's time may be assigned as de- termined by State priorities. Major projects include consent agreements and enforcement actions under the inactive hazardous sites statute and the State Superfund contracts for National Priorities List Site cleanups. I l I !
