Defendants.)
IN SUPPORT of their various claims, Plaintiffs cite the
Court to the following evidence which will be presented during a
hearing in this matter.
I. Defendants Cannot Show That The Seasonal High
Groundwater Level Will Be At Least
10 Feet From The Bottom Of The Waste
A review of the administrative record in the case reveals the
following evidence that supports the claim that defendants cannot,
with any professional certainty, state that the bottom of the waste
will be at least 10 feet above the seasonal high water level. In
support of this statement Plaintiffs refer the Court to the following
evidence in the administrative record of the Environmental Protection
Agency of the United States:
1. Item 10 A of the Federal Administrative Record entitled
"Investigation and Evaluation of Soil Conditions, Proposed PCB Disposal
Site, Warren County, North Carolina, S&E Job No. RG-730" written
by Robert J. Owens, P.E., North Carolina Registration No. 5160. On
page 4 of his report, Mr. Owens states, "Observation wells will be
required to accurately measure groundwater levels which are expected to
fluctuate several feet in this area during seasons." Mr. Owens
further states on page 5 of his report that, "Since the groundwater
level is a major limiting factor in the depth of the disposal pit,
we recommend that observation wells be installed and monitored prior
to final design of the disposal pit. A better understanding of the
sub-surface hydrology of the site will permit an optimum design of
the disposal pit and provide collection points for the required
groundwater samples."
2. Item 128 of the Federal Administrative Record. In this
document Charles Gardner, a section chief in the Department of
Natural Re$Our.ces and Community Development, states in a memorandum
dated April 14, 1981:
I have some-concern that seasonally high ground-
water table could be at or above the proposed
pit bottom. According to data presented on the
plans, the measured groundwater levels are roughly
10 feet below the proposed pit bottom; the data
of the groundwater readings is not noted. The
normal range in seasonal variation for upland
piedmont groundwater levels is 5 to 10 feet, and
variations as much as 25 feet have been observed.
I understand that there is an observation well
over 1 mile away that shows historical variations
of only a very few feet; in the piedmont, pro-
jection from that distance is questionable .... "
3. Affidavit of Thomas Karnoski. Mr. Karnoski has observed
water levels in the monitoring wells at the site only during the
month of July, 1982. Base.cl upon his observation there will be a
separation in July of only 16 feet between the waste materials and
the highest observed groundwater levels at the site.
4. Page 17 of the final Environmental Impact Statement of
the State of North Carolina, Item 25 of the Federal Administrative
Record, points out that groundwater levels are at maximum elevations

during the period from January to April. Based on the levels of
elevation during the month of July, the groundwater must only rise
approximately 6 feet between the low level of the summer months and
the high level of the winter months to violate the conditions of
the site approval.
5. Item 127 C of the Federal Administrative Record, memorandum
from L.P. Benton, Jr., to David Kelly, dated March 4, 1981.
Apparently this is the memorandum upon which Defendants rely in
stating that the groundwater level will be at least 10 feet below
the waste. A study of this memorandum will reveal that there is no
signed document by any independent hydrologist confirming the position
of Defendants respecting the separation between the waste and the
seasonal high groundwater level. Mr. Benton states,
"Based on the review of previously recorded
facts, evaluation of the preliminary grading
plans for the disposal site, and consultation
among hydrologists with general knowledge of
the area groundwater, staff concluded that their
review uncovered no additional information which
would refute the groundwater-water level part of
the hydrology, topography section of the final
Environmental Impact Statement."
6. The memorandum of L.P. Benton, Jr., was placed in the
Environmental Impact Statement. Unfortunately, Defendants have not
placed the memorandum by Charles Gardner in the Environmental Impact
Statement. Mr. Gardner stated specific facts respecting the pied-
mont region. Mr. Benton's memorandum does not state any specific
facts. In addition, Mr. Benton's memorandum does not have any
independent certified hydrologists who support his position.
7. Plaintiffs' Exhibit d-A memorandum dated February
4, 1980 from Ed Berry to Bill Myer showing maximum fluctuation for
two wells over a seven year period from 1973 to 1980. One well

in Franklin County averaged 10.6 feet and one well in Halifax
County averaged 8.72 feet.
8. Plaintiffs' E:&.'1.ibi t .'3 These hydrographs demonstrate
fluctuations ;Ln the piedmont area from a few feet to nearly 20 feet.
9. The observation well relied on by Defendants is about two
and one-half miles from the site. Based upon preliminary conversations
with professional hydrologists, none have stated that data from an
observation well two and one-half miles from the site is sufficient
to accurately predict the seasonal high groundwater level. This
conclusion is supported by the memorandum of Charles Gardner, and
by the report by Mr. Owens, a professional engineer, cited above.
10. If the high groundwater level reaches the height of the
pit and rises even higher, then all the safety factors built into
the design become questionable.
11. At a minimum, the Defendants should be required to have
an independent professional person conduct a study of the area, and
based upon the study, certify whether or not the waste will be at
least 10 feet above the high groundwater level. The information
in the Federal Administrative Record would not even stand up in a
Social Security disability hearing. It certainly cannot be relied
upon in a matter that so gravely affects the lives of the citizens
of Warren County.
II. Placing The PCB Dump In Warren County
Discriminates Against The Sub-Class of
:t-linority Plaintiffs On The Basis Of Race
1. Minority individuals comprise &3.7% of the population of
Warren County, the highest percentage of minorities in any county
in North Carolina. (Plaintiffs Exhibit __ / __ )

2. Minority individuals comprise 75.3% of the population
of Shocco Township, the township in which the PCB dump is situated.
(Plaintiffs Exhibit _____ )
3. Several other sites investigated by Defendants had physical
characteristics at least equivalent to the Warren County site. (See
Plaintiffs' Exhibits_!±_, -.:5__, __f2_, _2_, and~)
4. Of the six sites given serious consideration, the Warren
County site was rated fifth by the EPA. (Plaintiffs • Exhibit Lj-) -~--
5. As indicated by the affidavit of Charles Mulchi (Plaintiffs
Exhibit _:_3_-~~' __ ), the soils of Warren County a-re unsuitable for a
PCB dump, while more than 700,000 acres of more suitable soils exist
elsewhere in the piedmont region of North Carolina.
6. Warren County is located at the extreme northern edge of
the areas affected by-PCB spills, necessitating substantial additional
transportation expense and increasing the exposure of persons living
along roadways to PCB's if a dump is built in Warren County.
7. Defendants indicated that they would not employ or threaten
to use the State's power of eminent domain with regard to acquiring
a site for a PCB dump. (Plaintiffs' Exhibit 'j .and I () ) ~--
8. Defendants withdrew their threat of condemnation with regard
to the Chatham County site. (Plaintiffs' Exhibits ',, and _/_,_'"'---__ )
9. Originally, obtaining the concurrence of local officials
was one requirement for a ECB dump site . (Plaintiffs Exhibit __ L~;· __ )
10. The State withdrew its offer to purchase the Chatham County
site, and stopped considering that site as a result of opposition
expressed at a public hearing, even though an application for approval
of the Chatham County site had already been submitted to the EPA.

11. Defendants stopped considering the Wake County sites
after expressions of opposition from residents of Wake County and
the Wake County Commissioners. (Plaintiffs Exhibits and /0

County and 72.8% of the population of Chatham County. (Plaintiffs

13. The Warren County Commissioners expressed strong opposition
to the PCB durr1p. (Plaintiffs Exhibit 17 and

14. The citizens of Warren County expressed even stronger
opposition to the PCB dump than the citizens of Chatham and Wake
Counties. (Plaintiffs Exhibits /9 , .20, 21_, )..~, .3:...1_, and J...~)
15. Defendants stated that procurement of a site would not
proceed until tentative approval was received from EPA, (Plaintiffs Ex.
_l!±_ and .J.5), yet the State was committed to acquiring the Warren
County site more than two months before tentative approval was
received. (Plaintiffs Exhibits and 2. 7 )
16. When the owners of the Warren County site refused to
voluntarily sell the property, the State resorted to threats of
condemnation to force the sale. This occurred more than six months
after Defendants had chosen not to threaten condemnation of the
Chatham County site. (Plaintiffs Exhibits and )
17. As indicated by the affidavit of James T. Flemming (Plaintiffs
Exhibit 3.._J_), property values throughout Warren County, but
especially in Shocco Township, will be adversely affected by the
PCB dump.

11. As with any local ordinance, exceptions to the Warren
County PCB ordinance could be sought and obtained if the ordinance
is unreasonable as applied to a particular situation.

Charles Mulchi deposes and says as follows:
1. I obtained my undergraduate degree, masters degree, and
Ph.D. in soil science from North Carolina State University.

2. I presently am a~Professor in the Department of Agronomy
at the University of Maryland, College Park, Maryland.
3. I have been at the University of Maryland for on or
abo~t 12 years. I specialize and have done work in the area of
environmental science. I have done research on contaminants in
soils.
4. I have studied the proposed site for a PCB waste disposal
site in Warren County in the following manner:
a. I have read "The Soi ls of North Carolina",
Technical Bulletin No. 115 by W.D. Lee, a
recognized treatise in the area and other
texts concerning soils. Attached hereto
are the relevant parts of Technical Bulletin
No. 115.
b. I have personally examined the soils at the
proposed PCB dump site .·on two occasions.
c. the I have studied the conceptual design for
PCB waste disposal site as first planned

5. Based upon my studies and field work, I have concluded
the following:
a. That the soils of Warren County are not
suitable for a PCB dump .
b. That there are approximately 99.S:, ,000 acres
of land within the piedmont area of North
Carolina that have soils with a rfi.X:.ed ~lay :-..
content. Such soils are better suited for a
PC~B-cump than the kaolin clays with a 1: 1
crystal lattice found within Warren County .
c. Clays with a 2:1 cryst al lattice have much
larger surface areas, higher chemical exchange
capacities and a much higher plasticity index.
These clays are referred to as "Montmorillonite"
or "Bentonite" clays .
6. From my professional experience, it would seem that a
reasonable and fair decision-making process with an objective of
constructing a safe PCB waste disposal site would first consider
sites within the areas of the piedmont that have "Montmorillonite"
clays. combined with kaolin clays.
7. -8 The permeability level of either 6 .8 x 10 cm/sec as set
forth in the application of the State of North Carolina to the EPA
-7 regarding the Warren County stie, or of 1 x 10 cm/sec as stated
in the regulations, wil1 be nearly impossible to obtain under field
based upon data recently obtained at the s i te.

permeability of the clay liner as tt is constructed will also be
very difficult. Attached hereto is data obtained from liner and soil
samples taken on July 23, 1982, and conclusions based upon the data. 8. Based upon my knowledge of the soils of Warren County,
soils suitable for a PCB waste disposal site, and the uncertainty
surrounding seasonal high groundwater levels in the area, it is
my opinion that the Warren County ordinance prohibiting PCB dumps
is .reasonable and scientifically based.

1. With respect to the liner material, the extremely
low clay contents prohibit these materials from meeting minimum
standards for plasticity index (i.e., PI greater than 15). The low
clay contents would likewise prevent the compacted liner m~7erials
from meeting minimum permeability requirements (i.e., lxlO
cm/sec.).
2. Respecting the bottom samples, the high sand content
and low clay content for samples 7-10 suggest the leachate would
rapidly move to ground water.

III. The Warren Countv PCB Ordinance Is Reasonable
And Plaintiffs Have Standing To Enforce It
1. The Warren County ordinance on PCB dumps states:
WHEREAS, polychlorinated biphenyls, (herein-
after referred as PCB's) are highly toxic sub-
stances, which are imminently dangerous to human
health and life and are widely distributed in the
environment; and
WHEREAS, efforts are made from time to time
to store, dump, and otherwise dispose of PCB's
in various places; and
WHEREAS, Warren County is peculiarly unsuited
for the disposition of PCB's because there is a
generally high ground water table in the county
and most of the soils of the county are highly
permeable, so that there is a substantial likeli-
hood that if stored or disposed of in the county,
PCB's would eventually seep into the ground water
supply, where they would constitute an extreme
danger to human health and life; ...
BE IT NOW THEREFORE enacted and ordained by the
County of Warren that ...
No PCB's or substances or materials containing
a measurable amount (other than a trace) of PCB's
shall be stored, dUL~ped, or otherwise disposed of
within the boundaries of Warren County.
2. In passing the ordinance, the Warren County Corrrrnissioners
relied upon enabling legislation passed by the North Carolina
support of
Legislature and set forth in/the ordinance. In addition, because
preemption under the Toxic Substances Control Act was in question,
the commissioners also cited the exception to preemption clause in
the Toxic Substances Control Act which applies to any federal law.
3. The Federal Administrative Record, Item 129, Corrnnents of
Warren County on the Draft EIS of the State of North Carolina, and
the affidavit of Charles Mulchi, (Plaintiffs' Exhibit 33) establish
that the types of soil found in Warren County are not located within
a clay pan area and are not suitable for a PCB waste disposal site.
Within the State of North Carolina, approximately 790,000 acres of
land have soil qualities more suitable for a PCB dump than those

soils in Warren County. The seasonal high water level in Warren
County is very hard to predict, and the actual water levels are not
conducive to a PCB du.i~p.
4. The affidavit of Charles Mulchi (Plaintiffs' Exhibit 3 3 )
indicates that the soil permeability in terms of centimeters per
second is very hard to measure and predict; and under field conditions
the required permeability levels will be difficult to obtain with
Warren County soils and difficult to monitor.
5. The Environmental Impact Statement of the State of North
Carolina, Federal Administrative Record, Item 125 at pages 15-16
points out that surface and/or groundwater from the Warren County
site eventually will go to Richneck Creek and Fishing Creek.
6. The federal regulations promulgated pursuant to the Toxic
Substance Control Act in 1978 would have ruled out a PCB dump in
Warren County, unless exceptions to the regulations were granted;
because of the requirement at that time for a separation distance
betweeni groundwater and waste of 50 feet.
7. The affidavits of Plaintiffs indicate they utilize
individual drinking wells that will be endangered by the PCB dump.
8. As Defendant Clark states, the Warren County ordinance
declares a PCB dump a public nuisance. (Brief of Clark at p. 33)
9. The affidavit of James T. Fleming (Plaintiffs' Exhibit
2¥ ) indicates that Plaintiffs will suffer special damages from
this dump in that the value of their real estate will be reduced
15% to 20%.
10. Federal Administrative Record, Item 128. Charles Gardner
points out that ·the water level may reach at least the bottom of
the PCB disposal site. It can reasonably by inferred that this
