GENERAL OONDITIONS
INSURANCE -Soil & Material Engineers, Inc. rmintains Workmen's Canpensation and
Employer's Liability Insurance in confonnance with state law. In addition, we
rmintain Canprehensive General Liability Insurance and Aut(IIX)bile Liability
Insurance with bodily injury limits of $100,000.00·-$300,000.00 and property
damage limits of $100,000.00. A certificate of insurance can be supplied
evidencing such coverage which contains a clause providing that ten days written
notice be given prior to cancellation or reduction of coverage.
Cbst of the above coverage is included in our quotai fees. If additional
coverage or increased limits of liability are requirai, we will endeavor to
obtain the requested insurance and charge separately for costs associated with
additional coverage or increased limits.
CHAN}ED OJNDITIONS -'Ihe outlined scope of services will be accanplishai in a
timely, M>rkrranlike, and professional manner by anployees of Soil & Material
Engineers, Inc. at the unit fees quotai. If during the execution of the \\Ork
we are requirai to stop operations as a result of changes in the scope of M>rk,
such as requests by the owner or requiranents of third parties, additional
charges will be applicable.
SAMPLIN:i 00 TFSTIN:i 1..(X;ATIONS -'!he unit fees included in this proposal do not
include costs associated with surveying of the site or the accurate horiz.ontal
and vertical locations of tests. Field tests or boring locations described in
our report or shown on our sketches are based on specific information furnished
to us by others or estirmtes made in the field by our technicians. Such dimensions,
depths or elevations should be considered as approxirmtions unless otherwise
statai in the report.
DAMAGE TO EXISTIN:i MAN MADE OBJECTS -It shall be the responsibility of the owner
or his duly authorized representative to disclose the presence and accurate
location of all hidden or obscure man made objects, relative to field test or boring
locations. Our field personnel ~rre trained to recognize clearly identifiable stakes
or markings in the field, and without special written instructions, to initiate
field testing, drilling and/or sampling within a few feet of each designated location.
If we are cautioned, advised or given data in writing that reveal the presence of
underground or overground obstructions, such as utilities, special instructions will
be given our field personnel by us. As evidenced by your acceptance of this proposal,
you agree to indannify and save Soil & Material Engineers, Inc. harmless fran all
claims, suits, losses, personal injuries, death and property liability resulting fran
unusual subsurface conditions or danages to subsurface structures, owned by you or
third parties, occuring in the prosecution of the proposai \\Ork, whose presence and
exact locations were not revealed to us in writing, and to reimburse Soil & Material
Engineers, Inc. for expenses in connection with any such claims or suits, including
reasonable attorney's fees.
SAMPLE DISFOSAL AGREEMENT -Test specimens or samples (excluding drilling samples)
will be disposed of imnediately upon canpletion of tests. All drilling samples will
be disposed of 60 days after sulmission of our report unless otherwise requested.
Upon request, we will agree to retain tests specimens or drilling samples for a
nrutually acceptable storage charge.
