In accordance with N.C.G.S. 130A-294(a2), the Permit is for the life-of-site of the facility which is defined as the period from the initial receipt of solid waste at the facility until the facility reaches its final permitted elevations, which period shall not exceed 60 years. Permit number 8401-CDLF-1997 was approved to begin waste receipt operations on December 31, 1997, therefore the Permit shall expire on December 31, 2057. Permit number 8401-MSWLF-1999 was approved to begin waste receipt operations on May 18, 1999, therefore the Permit shall expire on May 18, 2059. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 OBSERVED VIOLATIONS: A. 15A North Carolina Administrative Code 13B .0542 (c)(1) states in part: A C&DLF shall accept only those solid wastes that it is permitted to receive. The facility is permitted to receive C&D waste as defined in 15A NCAC 13B .0101(14), inert debris waste as defined in 15A NCAC 13B .0101(28) and land-clearing waste as defined in 15A NCAC 13B .0101(31) as described in Permit Condition # 44 of the approved Permit Approval to Operate. During the inspection, industrial waste consisting of extruded plastic waste, plastic sheeting, baled plastic and cardboard from Fiberon was observed within the landfill. Also observed was plastic sheeting, paper, cardboard and plastic bands from Performed Line Products. Acceptance of this waste is a violation of 15A NCAC 13B .0542(c)(1). During the inspection, facility staff made arrangements to ensure that this waste will be disposed of at the MSWLF in the future. The facility consists of a closed MSWLF, MSWLF, CDLF, yard waste/compost area, white goods area, scrap tire collection, battery collection and a drop-off area for residential waste. 2. The service area for the facility is Stanly County. 3. Proper signage is located at the entrance of the facility. 4. All access roads were being maintained and in good condition. 5. On March 14, 2023, an update to the Methane Remediation Plan was submitted by HHNT on behalf of the City of Albemarle to Ervin Lane, Hydrogeologist. The installation of 11 temporary gas monitoring points was completed in November 2022 and monitored weekly for 8 weeks. Based on the results, 6 new landfill gas monitoring wells were installed at the northern property boundary to supplement the facility’s landfill gas monitoring network. Please continue to work with Ervin Lane regarding the remediation plan. Municipal Solid Waste Landfill (8401-MSWLF-1999): 6. The facility was operating in Phase 2. 7. The facility is approved to utilize tarps and Posi-Shell as an alternative cover material. 8. The working face was small and well controlled. 9. No unacceptable waste was observed. 10. Windblown litter was well controlled. 11. Edge of waste markers were being maintained. 12. Good vegetative cover was being maintained on Phase1 of the MSWLF and the inactive areas of Phase 2 of the MSWLF. 13. Adequate freeboard was observed in the leachate pond. The fabric on the leachate pond needs repair. 14. The leachate collection system includes a force main and pump station. Construction and Demolition Landfill (8401-CDLF-1997): 15. The working face was well controlled. 16. Windblown litter was well controlled. 17. Edge of waste markers were being maintained. 18. Good vegetative cover was being maintained on the inactive areas. Closed Unlined MSWLF (8401-MSWLF-1983) 19. Good vegetative cover was observed on the closed unlined MSWLF. 20. No erosion was observed. 21. Edge of waste markers were being maintained. Scrap Tire Area: 22. Tires were being collected in covered trailers and being stored properly. White Goods Area: 23. White goods containing Freon were observed separate from other metals and were being stored properly. Treatment and Processing Area/Small Type 1 Compost Area: 24. Land clearing debris is kept segregated from yard waste and yard trash. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Ground land clearing debris is sold to the public. 26. Leaves are windrowed separately and composted. 27. No unacceptable waste was observed. Records Review: 28. Reviewed the operations plan, comprehensive daily inspection forms, training records, groundwater, surface water and leachate semi-annual reports (August 2022 and January 2023), methane monitoring records (conducted quarterly), special waste records, asbestos records, compost temperatures, leachate disposal records and random load inspection records (1 per week for both the CDLF and the MSWLF). 29. 854,904.73 gallons of leachate was discharged to the City of Albemarle sanitary sewer system in June 2023. 30.
