ADDITIONAL COMMENTS On June 28, 2023 Chuck Kirchner met with Richard Hill, Emily Ball, Rodney Foust with Austin Quarter Landfill, and Ben Clawson and Tommy Lager with MESCO, and Brad Murray and Jake Rodgers with Baxter Johnson for a Phase 6, Cell 1A construction meeting to discuss progress of the Cell 1A construction and to conduct a partial inspection of the MSW landfill.
1. In the May of 2023, the facility began construction of Phase 6, Cell 1A. 2. Diversion berms and sediment traps appear to have been installed per the approved plan and appear to be
functioning properly. 3. Active grading on Cell 1A is currently underway. 4. Upon completion of grading a 1’ clay liner will be installed prior to the installation of leachate lines and landfill liner. 5. Completion of Phase 6, Cell 1A is anticipated to be in September and then the contractor will add the permanent cap onto the C&D landfill in November. The landfill is working on closing the C&D landfill. 6. A site inspection was conducted of the active area of the landfill. 7. Waste is currently being placed in existing cell 2A. 8. The landfill basin where the liner was repaired has been filled and is currently covered with soil. 9. The facility is planning on hiring an additional operator to help with the increase in MSW waste material being received at the landfill according to Mr. Hill. 10. Seed and mulch all bare areas of the landfill cap as discussed in the field. 11. Windblown waste possibly from the days operations was observed on the northern slope of existing Cell 2A. 12. At the conclusion of each operating day, all windblown material resulting from the operation shall be collected
and disposed of by the owner or operator per 15A NCAC 13B .1626(11). 13. The yard waste area was recently relocated to make way for new cell construction. 14. The yard waste area contained approximately 150-200 tons of woody debris according to Mr. Hill.
15. Yard waste material was ground to mulch approximately two weeks ago according to Mr. Foust. 16. Leachate tanks were observed in good condition. Tank A and Tank B both had 3.5’ of leachate in them. 17. Convenience center observed in good condition and free of windblown waste.
18. Access roads were of all-weather construction and observed in good condition.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
