PO Box 12 West End, NC 27376 allan@kkcubuilders.com allan@casavantgroup.com PARTICIPANTS: David Powell, NCDEQ– SWS Andrew Hammonds, NCDEQ – SWS STATUS OF PERMIT: Expired September 16, 2018 PURPOSE OF SITE VISIT: Complaint Inspection STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0566 (7): UNRESOLVED- This rule has been readopted in 2021 and has changed is now combined into (3), (4), and (5). (3) All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. (4) Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. (5) erosion control measures, structures, or devices shall be utilized to prevent silt from leaving the site and to prevent on-site erosion, and shall comply with 15A NCAC 04. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 Permit to operate Attachment 3, cover material requirements #21 states, “Within 120 calendar days after completion of the final disposal operations, the disposal area must be closed and covered with a minimum of one (1) foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. However, for ditches located on the landfill, at least 2 feet of soil cover is required between the bottom elevation of the ditches and the waste mass.” 15A NCAC 13B 0.0564 (9): UNRESOLVED – This rule has been readopted in 2021 and is now (6) Buffer Requirements: A site shall maintain the following buffer requirements:(a) 50 feet from the waste boundary to waters of the State as defined in G.S. 143-212. (b) 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells. OBSERVED VIOLATIONS: NA ADDITIONAL COMMENTS 1. Purpose of this inspection was to do a routine inspection and follow up on the closure of this facility. Gate was closed upon arrival, but Mr. Powell walked onto front of LCID to inspect part of the disposal area. Mr. Casavant has been contacted and asked to submit the required documentation for closure and information to resolve the previous violations. Please do so ASAP once corrective actions have been addressed. Also, please ensure the LCIDLF has the required depth of soil cover for closure, which should be reflected in the engineering document that will be submitted to Section Permitting. 2. The permit for the Stump Hole LCID landfill expired in September of 2018. Annual fees are still required until closed according to rule. Post Closure Care will now also be required for ten years. 3. Upon receiving all required documents and returning for final closure follow up inspection, there should be nothing should be on the landfill or inside EOW markers. It was noted during last inspection that new EOW markers have been added. T-posts were still visible and represented the EOW, according to Mr. Casavant previously. It should be determined if all these markers are EOW markers and in correct locations. Inspector will need to revisit for closure and verify the distance of buffers using these EOW markers. Permit Condition No. 10, Part 1 of Attachment 3 of the Permit to Operated dated September 16, 2013 (DIN 18927) - The permanent markers that accurately delineate the waste disposal boundary must be maintained. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please mow and address any cover or areas needing to be revegetated at that time. EOW markers or buffers markers are seen in photos below. If not already done so, landowner should communicate with the Sections Permitting Branch Head Sherri Stanley at 919-707-8235 or sherri.stanley@deq.nc.gov, and with Moore County, to ensure all requirements that are needed for closure. Owner should communicate with Moore County Planning and Zoning for any permits or actions they may require. Also, DEMLR should be contacted, (910-433-3300 Tim LaBounty) in regards to any mining, sedimentation and erosion control and storm water requirements. 6. The Section has not received the require documentation to close the site. Once the property is sold, then new owner can apply for a permit at that time if they wish, but the site must be properly closed and in compliance per the rules before submitting a new application for permit. Please bring this site into compliance and submit required closure documentation. Once the issues at this site have been addressed then the Violations can be resolved. 7. Corrective measures are necessary to bring the landfill into compliance and should be completed within 30 day’s receipt of this inspection report. Confirm EOW markers/location and that site is compliant with buffer rules. Requested final closure documents need to be submitted to Section Permitting. Ensure proper cover and finish establishing grass cover. Cover or remove exposed wastes inside landfill. All Equipment removed from landfill and inside EOW markers. Check with Moore County Solid Waste/Planning and Zoning on closure requirements. Check with DEMLR on closure requirements.
