STATUS OF PERMIT:
Notified LCID - Permit or closure required by 1/1/2026. See attached letter to email with this report. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection
STATUS OF PAST NOTED VIOLATIONS: All concrete has been covered. All vegetative waste is piled up on the Yard Waste Notified site (YWN-27-002) adjacent to this Notified LCID.

ADDITIONAL COMMENTS:
01 - Mr. John College and Mr. Andrew Hammonds, NCDEQ-DWM-FOB met today with Mr. Jeffrey Newbern (Owner/operator) and Mr. Ken Elliott (Elliott Consulting) to discuss the progress made to get this Notified Land Clearing and Inert Debris Facility (NLCID) and the adjacent Notified Yard Waste Facility (YWN-27-002) (Small Type 1 Compost Facility) combined into a Permitted Treatment and Processing Facility. 02 - Mr. Elliott has been in contact with DWM Permitting for information needed to permit these two notified sites into one permitted facility. Please copy Mr. Andrew Hammonds on ALL information you send or receive on this process. Andrew.hammonds@deq.nc.gov 03 - Mr. Elliott provided documentation and other information that the permitting section is now involved and plans moving forward. Be sure to contact DEMLR to ensure compliance on a Sedimentation & Erosion Control Plan is in place. 04 - The Air Curtain Burner (Permitted with title V permit thru DAQ) is not currently being used due to un-favorable winds that would impact the Golf Community behind this facility. Facility has constructed the new burn box. Need to measure the pile to ensure you are not over the required maximum amount.
05 - Remember, on the YWN-27-002 (Small Type 1 Compost Facility) that you can only have 6000 cu/yds of material on-site at any given time per, 15A NCAC 13B .1402 GENERAL PROVISIONS FOR SOLID WASTE COMPOST
FACILITIES; (e) (6) (a). 06 - Be sure to establish the 25 ft. access lanes around the perimeter for fire fighting equipment and visual inspections. See Attached Reference information.
07 - Facility still needs to remove old equipment from usable areas to ensure setbacks and side slopes can be met.
08 - Remember that the LCID Waste must be totally covered monthly at a minimal. Looks good during this
inspection.
09 - Signage and Security measures (locking cable and/or fencing) have been put back in place. 10 - No Digital pictures were taken during this inspection.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
