` ADDITIONAL COMMENTS
1. Staff, with the Section, visiting Yard Waste Notification (YWN) for a follow up inspection on 6/15/2023 and to verify if corrective actions have been completed for this site and IS262109. Once onsite, Mr. Powell saw much work has been completed with almost all waste removed. City provided documentation via email on May 1,
2023, which included a map identifying piles and areas and waste generalized description, hauling logs and Cumberland County Landfill receipts and excel spreadsheet tracking loads etc. Initially Mr. Dennis Miller expected to be finished with corrective actions by June 1, 2023. It’s now expected to be finished by July 1, 2023. Hydroseeding is planned according to Mr. Dennis Miller once all items removed from site. Any change to expected complete date should be communicated to David Powell and all documentation provided via email. 2. Upon inspection, most of the site was clean down to soil. Rock has been brought into for access road
maintenance. There were some stockpiles of sand and soil left onsite. In addition, there was some stockpiled mulch still onsite as well. If this mulch was purchased the please remove and stockpile elsewhere. If this mulch was generated as part of the Yard Waste Notification, then it should be utilized or disposed of according to rule. This site needs all C and D waste and vegetative waste/materials removed to close the Yard Waste Notification/IS262109.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

3. On the northeastern side of site, there were some older materials stockpiled for some time, now being gathered
up as waste with excavator. This waste consists of bricks, block, broken pallets, and some metal. Please be sure this waste is removed and taken to appropriate disposal site for that waste type.

4. Please continue work, ensure waste goes to appropriate landfill for that waste type and keep documentation. A follow up inspection will be done to confirm all corrective actions are completed after July 1, 2023, or when the city notifies David Powell if sooner.
5. Please be sure not to disturb cap of the Pre-Regulatory Landfill. Contact Ryan Channel for any requirements associated with the PRLF, if not done so already, at ryan.channell@deq.nc.gov or 919-707-8333. 6. Corrective measures are necessary as result of this inspection. Failure to resolve these matters may result in further enforcement action. July 1, 2023, was requested by Mr. Dennis Miller as a realistic timeframe for completing the onsite Corrective Actions. Any changes to operations or a delay in meeting this due date, should be communicated with David Powell before due date.
