Market St., Greensboro, Guilford County, North Carolina NCDENR Incident No. 6367 Dear Mr. Brown: In accordance with the February 17, 2023 letter from the North Carolina Department of Environmental Quality (NCDEQ), Winston-Salem Regional Office (WSRO) to TransMontaigne, this letter presents a request, with rationale, to abandon (a.k.a., decommission) select groundwater monitoring and remediation wells at the TransMontaigne-Greensboro petroleum bulk terminal and transportation terminal referenced above in Greensboro, North Carolina. The site location is shown in Figure 1 (Attachment 1). The site layout, including locations of the fifty-two remaining site groundwater monitoring wells and twenty-six remaining groundwater remediation wells is shown in Figure 2. Well construction details are listed in Table 1 (Attachment 2). A historical summary of groundwater analysis results for current site monitoring wells is provided as Attachment 3. As listed in Table 1, site monitoring and remediation wells range in depth from approximately 15-feet to 127- feet below grade, with well screens and open-hole intervals set within subsurface zones characterized as shallow saprolite, intermediate and deep saprolite, and bedrock. Well diameters range from 2-inches in inside diameter (I.D.) to 6-inches I.D. Wellheads are completed with either stickup protective casings or within flush-mount protective manholes. TransMontaigne and predecessors completed various site assessment and remediation efforts from around the late 1980s through 2017 to address historical site soil and groundwater contamination under NCDEQ Incident No. 6367. Sitewide active soil/groundwater remediation was conducted from 2001 through 2015. Initial efforts from 2001-2009 involved the operation of a combined groundwater/free-product recovery and soil vacuum extraction (SVE) system. Subsequent efforts from 2009-2015 involved the operation of a combined air sparging/SVE system. Request to Abandon Site Monitoring and Remediation Wells TransMontaigne-Greensboro Terminal April 13, 2023 2 PIEDMONT GEOLOGIC, P.C. A New Technology Cleanup Plan (NTCP) was submitted to NCDEQ in May 2017.1 The NTCP provided a proposal to expand the site air sparging system to enhance groundwater remediation in the area of a well with lingering benzene concentrations above the NCDEQ Gross Contamination Level (GCL). The report also stated TransMontaigne’s plan to proceed with NCDEQ requirements for risk-based site regulatory closure per 15A NCAC 2L .0507(d) following achievement of GCL compliance. NCDEQ approval of the May 2017 NTCP was transmitted via a May 22, 2017 letter to TransMontaigne. NCDEQ’s position on risk-based closure was further clarified in a February 5, 2018 letter to TransMontaigne, which stated that NCDEQ “may consider site closure under risk-based rules if no GCL violations are detected in four (4) consecutive quarterly groundwater-monitoring events after shutdown of the active remediation system.” NCDEQ’s position on this matter was subsequently reinforced via a February 7, 2018 email between NCDEQ and Piedmont Geologic, in which NCDEQ agreed that there was no reason being considered that would prevent a risk-based closure implementation following achievement of the GCL compliance per above. Achievement of the stated GCL compliance occurred through quarterly groundwater monitoring events completed from March 2018 to February 2019. Accordingly, TransMontaigne initiated the process of pursuing risk-based site closure. NCDEQ involvement in this process is documented in a series of emails between NCDEQ and Piedmont Geologic from February 21 to March 4, 2019, which reflected NCDEQ’s intentions on issuing a notification of conditional No Further Action (NFA) following: 1) submittal and NCDEQ approval of a Notice of Residual Petroleum (NRP), and 2) execution of a Property Owner Consent to Risk-Based Remediation by Products Pipe Line Company (PPL), who own the terminal property (6367 Burnt Poplar Drive) directly west of the TransMontaigne property. This latter requirement was ostensibly based on the detections of groundwater COCs at concentrations above North Carolina groundwater standards under 15A NCAC 2L .0202 (the “2L standards”) in TransMontaigne monitoring-wells MW-18 and MW-49, in the southwestern portion of the TransMontaigne site property. Following contact by TransMontaigne, PPL declined to cooperate in the process of executing the Property Owner Consent on behalf of TransMontaigne. As a result, TransMontaigne has been blocked from completing the NCDEQ-approved risk-based closure procedure as described above. It is noted that there is no confirmation that encroachment of groundwater COCs from the TransMontaigne property to the PPL property, per above, has occurred. In addition, TransMontaigne has demonstrated that some, if not all, of these southwestern groundwater COC concentrations may be attributable to encroachment of groundwater COCs through the TransMontaigne property from an upgradient site to the east (the GNC Energy site). Accordingly, TransMontaigne has petitioned NCDEQ to waive the Property Owner Consent requirement for risk-based closure in this site-specific case. However, this petition to date has gone unapproved. In early January 2023 TransMontaigne received a request from NCDEQ to complete a groundwater monitoring event for the site. TransMontaigne complied with this request although the need for such monitoring is questioned as the site would already have been issued risk-based regulatory closure with one signature being procured from PPL. 1 Piedmont Geologic, P.C., May 15, 2017, New Technology Cleanup Plan, TransMontaigne-Greensboro Terminal. Results of January 2023 site groundwater monitoring are detailed in a February 3, 2023 letter from Piedmont Geologic to NCDEQ.2 The February 3 letter largely repeats the narrative presented above along with the conclusion that results of the January 2023 site groundwater sampling/analysis indicate no changes in site conditions that would warrant negation of risk-based closure as a continued legitimate site-closure approach for immediate implementation (i.e., with no additional site groundwater monitoring). Accordingly, TransMontaigne requested that NCDEQ allow for abandonment of site monitoring wells per 15A NCAC 2C, under the assurance that no future monitoring well replacements are required for those abandoned, absent of a new release incident. TransMontaigne offered to retain a reasonably limited number of site monitoring wells for potential future contingency purposes, provided that future annual Guilford County permitting fees are waived. NCDEQ, via the February 17, 2023 letter to TransMontaigne, agreed to TransMontaigne’s proposed well abandonment approach, contingent upon submittal and NCDEQ-approval of this proposal. Per above, TransMontaigne requests approval to abandon a total of twenty-nine of the existing fifty-two site monitoring wells plus all twenty-six existing site remediation wells. Site wells to be retained versus site monitoring wells to be abandoned are shown in Figure 3. Rationale behind the proposed abandonment versus proposed retention for each site monitoring/remediation well are included in Table 2. Rationale common between various site wells are summarized as follows. 1. As previous active site remediation efforts were completed to practicable endpoints, no further site remediation is envisioned or warranted, and all site remediation wells will be abandoned. 2. Site monitoring wells with a demonstrated record of no groundwater COC detections, or no COC detections at concentrations above 2L standards, over suitable period of time (i.e., generally eight or more of the most-recent groundwater sampling/analysis events) will be abandoned. 3. Some monitoring wells that are redundant with respect to other nearby retained monitoring wells will be abandoned. Site monitoring-wells MW-19, MW-35, and MW-36 are located along the northern site property boundary, south of West Market Street, and historically have demonstrated groundwater COC concentrations above 2L standards. As shown in the graphs in Attachment 4, the final years of groundwater monitoring for these wells through 2017 demonstrated relatively low COC concentrations and stable COC concentration trends over time. Mann-Kendall statistical analysis (Attachment 4) also indicates no statistically increasing trends. In addition, site monitoring wells on the opposite (i.e., northern) side of West Market Street, downgradient of MW-19/MW- 35/MW-36, including MW-41 and MW-47, have historically demonstrated no groundwater COC concentrations above 2L standards (with one exception from 2003 for MW-47), thus demonstrating no significant offsite migration of groundwater COCs to the north of the site property, and negating the necessity to retain MW-19, MW-35, and MW-36. As it is also desirable to remove site monitoring wells from the Norfolk Southern railroad right-of-way corridor, MW-19, MW-35, and MW-36 will be abandoned. The site monitoring-well network to be retained is shown in Figure 4, with construction details for the wells to be retained wells listed in Table 3. Request to Abandon Site Monitoring and Remediation Wells TransMontaigne-Greensboro Terminal April 13, 2023 4 PIEDMONT GEOLOGIC, P.C. zones as referenced above (i.e., shallow saprolite, intermediate and deep saprolite, and bedrock), allowing for continued characterization of groundwater COC distributions with respect to depth, as warranted, as well as general confirmation of the consistently defined apparent groundwater flow directions delineated repeatedly through routine groundwater monitoring completed from the early-2000s through 2017. Five monitoring wells (MW-5, MW-9, MW-11, MW-56, and SME-9) are being retained for the sole purpose of early release detection (ERD) monitoring by TransMontaigne. Further groundwater monitoring for these wells is considered unnecessary. The proposed well abandonments will be completed by a North Carolina licensed well driller in accordance with 15A NCAC 2C. Following project execution and completion a well-abandonment report will be submitted to NCDEQ. The schedule for completion of the effort will be dependent upon timing of NCDEQ approval of this proposal, plus acquisition of project funding by TransMontaigne. As no such funding has been allocated for 2023, it may be necessary to delay the project until 2024. Once NCDEQ approval is received and project funding is established, TransMontaigne may choose to complete the project in phases, or in parts, over any time frame of its choosing. If completed in phases/parts, well abandonment reports will be submitted for each separate well-abandonment effort. With respect to ongoing monitoring-well permitting fees paid annually to Guilford County DHHS, TransMontaigne objects to such fees on the grounds that, as discussed above, there is no demonstrable need for continued site groundwater monitoring. Accordingly, TransMontaigne again requests a waiver of annual well- permitting fees moving forward, with the exception of monitoring-wells being voluntarily retained by TransMontaigne for ERD monitoring. If this request is denied, then fees for site monitoring-wells MW-57 through MW-60, which serve only to monitor encroachment of groundwater COCs onto the TransMontaigne property from the GNC Energy site to the east, should be the responsibility of the GNC Energy site responsible party, along with any continued monitoring of the wells.
