Attention: Mr. Thomas Brintle 125 Plaza Lane Mount Airy, North Carolina 27030 Re: Notice of No Further Action 15A NCAC 02L .0407(e) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Brintle’s Truck Stop 125 Plaza Lane Mount Airy, Surry County Incident Number: 13363 Risk Classification: Low (Reduced from Intermediate) Ranking: L41R Dear Mr. Brintle: The Groundwater Monitoring Report and Updated Receptor Survey received by the Underground Storage Tank (UST) Section, Division of Waste Management, Winston-Salem Regional Office on April 11, 2023 have been reviewed. The file review indicates that soil contamination does not exceed the lower of the residential or soil-to-groundwater maximum soil contaminant concentrations (MSCCs) established in Title 15A NCAC 02L .0411. The report also indicates that contaminated groundwater does not exceed the level of the groundwater quality standards or interim standards established in Title 15A NCAC 02L.0202. Based on information provided to date, the UST Section finds it appropriate to reduce the risk classification of the subject incident from intermediate to low. Furthermore, the UST Section determines that no further action is warranted for this incident. This determination shall apply unless the UST Section later finds that the discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title 15A NCAC 02L .0407(a), you have a continuing obligation to notify the Department of Environmental Quality of any changes that might affect the risk or land use classifications that have been assigned. This No Further Action determination applies only to the subject incident; for any other incidents at the subject site, the responsible party must continue to address contamination as required.
