Please note, the UST Section does not prohibit the sale of the subject property.  However, North 
Carolina General Statute (NCGS) 143B279.9 and 143B‐279.11 require a Notice of Residual 
Petroleum (Notice) to be filed with the Register of Deeds in the subject County, where the 
release is located, when a release from an underground storage tank has not been remediated 
to below “unrestricted use standards”.  The Notice is required either prior to conveyance of a 
contaminated property or prior to receiving a Notice of No Further Action.  “Unrestricted use 
standards” for groundwater are the groundwater quality standards and interim standards 
contained in Title 15A NCAC 2L .0202, and “unrestricted use standards” for soil are the 
residential maximum soil contaminant concentrations (MSCCs) established in Title 15A NCAC 2L 
.0411.

Chase, 
The subject site has a UST petroleum incident (Incident #11608) that was determined to be 
comingled with solvents from a dry cleaners.  The dry cleaners DSCA ID is # 67‐0003.

Once a petroleum release becomes co‐mingled with solvents, the UST Section can no longer 
direct cleanup due to the solvents. 

As per correspondence in the UST incident file dated 1/7/2005, it did not appear that the DSCA 
program was actively handling this site as their program is voluntary. 

As of the last monitoring report submitted for the UST incident in 1998, Free Product was 
reported to exists onsite. 

The file for this incident is relatively large so I have attached the last monitoring report, the site 
CSA (minus labs and some attachments) and correspondence with DSCA.  Additional files for 
this site should be available on our Laserfiche site at DWM Laserfiche Public Search
