A review of the report indicates that in the areas investigated; soil contamination does not exceed the soil-to-groundwater maximum soil contaminant concentrations (MSCCs) and that contaminated groundwater has been cleaned up to the level of the standards or interim standards established in Title 15A NCAC 2L.0202. Based on available information provided to date, the UST Section determines that “No Further Action” is warranted for this incident in the areas that have been adequately investigated. This determination shall apply unless the UST Section later finds that a discharge or release poses an unacceptable risk or a potentially unacceptable risk to human health or the environment. This No Further Action determination applies only to the subject petroleum incident; for any other incidents at the subject site, the responsible party must continue to address contamination as required. While Benzo(a)pyrene and p-Isopropyltoluene were detected in the soil and groundwater, our office considers these to be associated with a previous use of the property and not associated with a petroleum or hazardous substance release.
