Dear Mr. Edwards,
WithersRavenel, Inc. (WR) has prepared this Initial Abatement Action Report to document the
removal of petroleum impacted soils at the facility addressed as 102Tidewater Way in Elizabeth
City, Pasquotank County, NC (Figure 1). Petroleum soils removed from the location were
associated with a release of diesel fuel from a refrigerated truck saddle tank owned and operated
by the Food Bank of the Albemarle. The release of approximately 50 gallons of on‐road diesel fuel
occurred on April 16, 2020 as the result of a compromised fuel delivery line. The compromised
fuel line allowed for the release of fuel to the surficial soils/gravel beneath the truck, extending to
the southwest of the release location (see Figure 2).
The following report documents remedial efforts that took place between April 20 and 27, 2020.

BACKGROUND
On April 16, 2020, a release from the saddle tank of a refrigerated truck owned and operated by the Food
Bank of the Albemarle was discovered in an area in which the vehicle is routinely parked, on property owned
by Big Daddy’s Pizza, Inc. The property is addressed as 102 Tidewater Way, and is identified by the
Pasquotank County GIS service as Parcel # 8922 381598. The release was the result of a compromised fuel
delivery line on the refrigerated truck. An estimated total of 50 gal of on‐road diesel fuel was released to
the surface soils and gravel beneath the truck. The release extended from the source location to the
southwest. The extents of the release are shown on Figure 2, while photographs of the release area are
included as an attachment.
INITIAL ABATEMENT ACTIONS – APRIL 2020
On April 20, 2020, WR mobilized to the subject property with EEM to perform abatement actions relating
to the release. On April 20, 2020, EEM removed a total of 85.29 tons of impacted soil from the release area,
which were live‐loaded into waiting dump trucks for transportation to Soil Resources, LLC, an NCDEQ
permitted soil remediation facility located in Edgecombe County, NC. During excavation activities at the
location, which extended to a terminal depth of approximately 2.5 ft beneath surface grade, groundwater
did not infiltrate the area. Disposal manifests, weigh tickets and a Certificate of Disposal are provided in
Appendix A. Following removal of impacted soils, the resulting excavation was backfilled to match original
grade. Fine grading of the area was completed on April 27, 2020.
Following the removal of impacted soils, two floor samples (samples FL‐1 and FL‐2 – obtained from the base
of the excavated area at depths of approximately 2.5 ft beneath surface grade) and four sidewall samples
(SW‐1, SW‐2, SW‐3 and SW‐4 – obtained from depths of approximately 1.5 ft beneath surface grade) were
collected and field screened with a field calibrated TVA‐1000B FID/PID. These samples were submitted to
RedLab, LLC for analysis for Total Petroleum Hydrocarbons (TPH) – Diesel Range Organics (DRO) and TPH
– Gasoline Range Organics (GRO) by UVF methods. Laboratory analysis of the submitted samples did not
reveal any TPH‐DRO concentrations above the current NCDEQ Action Level of 100 milligrams per kilogram
(mg/kg). TPH‐GRO was not detected in the samples submitted for testing. These data are shown in Table
1, attached. The excavation, soil sample locations, and analytical results are illustrated on Figure 3. The
Laboratory Analytical report is included as Appendix B and a Photographic Record is included as Appendix
C.
CONCLUSIONS & RECOMMENDATIONS
Petroleum impacts associated with the April 2020 surface release have been mitigated. A total of 85.29
tons of impacted soils were removed from the location of April 20, 2020. These soils were transported from
the site for treatment/disposal. Final excavation soils samples revealed no petroleum related concentrations
above current NCDEQ Action Levels.
WR recommends a letter of No Further Action be issued with respect to the April 2020 AST surface spill of
