Ok. The fuel belongs to the insured. You are the responsible party to clean it up, no matter the fault. However, that is

Thanks Brenda.    I’ve advised the fire marshall that we’re not signing and neither is the insd for the clean up.     We may 
offer to pay half, but the police report now has C/D as exceeding safe speed….he contributed to the MVA, per NC 
insurance guidelines.

I spoke to adjuster Zane this morning about this clean up and do not have a direct contact for him. We are well over a 
month with this not being attended to.  

He advised me he was waiting on a report to see who was at fault. Here is the report to expedite this, however the 
responsible party is responsible for clean‐up. In this case, the fuel belonged to the truck insured by you and should be 
cleaned by that insurance company. If you guys later find out, your client is not at fault, you will have to seek that 
through the other insurance carrier for reimbursement or litigation. Nevertheless, the report shows the truck driver was 
at fault. If this is not taken care of promptly, I will be forced to turn this over to NCDENR for enforcement. Please advise 
your intentions on moving forward.

Just got off the phone with Eastern Environmental and the site where the fire and spill has not been cleaned up yet. 
Eastern is advising the RP has not signed the contract for them to clean it up. This site has to be cleaned up. Can you 
advise where you guys are at?

5 gal buckets of foam to extinguish the car with the fuel tank burning. Attached is the estimate for replacing those used
