Dear Ms. Jones:
The Underground Storage Tank (UST) Section, Division of Waste Management, Department of
Environmental Quality (Department) has received the October 20, 2022, Site Check Report, documenting
a soil investigation conducted on September 28, 2022 in response to failed piping causing an accumulation
of fuel in the 12,000-gallon gasoline UST system sump.
Title 15A of the North Carolina Administrative Code (NCAC) Subchapter 2N .0603 requires an
investigation when any system component fails or when there is evidence of a potential release to the
environment. The Site Check included the sampling of soil from the UST system basin and along the
product piping during repair activities. The samples were analyzed onsite using an ultraviolet fluorescence
detector for Total Petroleum Hydrocarbons (TPH) – Gasoline and Diesel Range Organics (GRO and DRO).
Soil contamination was reported above the UST Section’s TPH screening limits at all but two
locations. However, the greatest soil response was observed in the UST basin at boring PP-3-3’, with a
GRO-equivalent result of 3,944 mg/kg and a DRO-equivalent result of 610 mg/kg.
To evaluate whether the release at the UST sump reached groundwater, and potentially to assist in
determining whether this recent release has commingled with the earlier onsite release being tracked as
Incident 6508, a monitoring well must be installed at or immediately downgradient of the area of greatest
soil contamination observed during the Site Check. The results of this supplemental Site Check assessment
must be submitted to the Department by January 31, 2023.
Effective October 1, 2004, the Department requires that all work not determined to be an emergency
response or associated with risk assessment (i.e., the Limited Site Assessment Report, per Title 15A NCAC
2L .0405) must be preapproved if Commercial Leaking Petroleum Underground Storage Tank Cleanup
Fund (Trust Fund) reimbursement is anticipated. To comply with this requirement, a completed
Preapproval/Claim Authorization Form encompassing the scope of work described above must be received
and approved by this office well prior to the start of any tasks for which you intend to seek reimbursement.
Please note that the site eligibility for this release must be determined, or, if commingled, an update
to the eligibility for Incident 6508 must be obtained, before a claim for either release may be processed.
Upon completion of any preapproved activities and eligibility determination/redetermination, you
should submit your claim promptly. Reimbursement funds are budgeted based on completed preapprovals,
but delays in reimbursement or even denial due to a failure to meet the statute of limitations on claiming a
completed task can result if the work is not completed in a timely fashion or if claims are not submitted
immediately following work completion.
