Dear Mr. Grantham:
The Washington Regional Office of the Underground Storage Tank (UST) Section, Division of
Waste Management, Department of Environmental Quality (Department) has received a copy of the Site
Check Report dated May 12, 2020 for the Grantham Supply & Supermarket at the address listed above.
This report details investigative efforts conducted on April 17, 2020, in response to July 2018 hydrostatic
testing of the overfill sumps on the gasoline and diesel USTs at this facility.
The report indicates groundwater contamination exceeds the groundwater quality standards
established in Title 15A of the North Carolina Administrative Code (NCAC) Subchapter 2L .0202.
Therefore, the UST Section hereby confirms that you must comply with the requirements of Title 15A
NCAC 2L .0405, within the timeframes specified in the attached rule, which include the collection of soil
samples and a survey of potential at-risk receptors within 1,500 feet of the source area of the release.
As the facility has a prior Limited Site Assessment (LSA) Report submitted for Incident #16371,
the Trust Fund LSA Task Codes are not available for assessing this new release. Rule changes since the
earlier LSA was conducted require that a full receptor survey be completed. Due to preexisting releases at
this facility, any work for which reimbursement will be sought must be preapproved. The groundwater
analytical results from the Site Check satisfy the requirement for LSA groundwater samples.
For the purposes of this scope, the soil assessment and receptor survey information must be
submitted with a Letter Report within 120 days of the date of the release discovery: September 1, 2020.
Failure to comply with the State's rules in the manner and time specified may result in the
assessment of civil penalties and/or the use of other enforcement mechanisms.
Since a release or discharge has been confirmed, a Licensed Geologist or a Professional Engineer,
certified by the State of North Carolina, is required to prepare and certify all reports submitted to the
Department of Environmental Quality in accordance with Title 15A NCAC 2L .0103(e) and 2L .0111(b).
Effective October 1, 2004, the Department requires that all work not determined to be an emergency
response or associated with risk assessment (i.e., the Limited Site Assessment Report, per Title 15A NCAC
2L .0405) must be preapproved if State Trust Fund reimbursement is anticipated. To comply with this
requirement, a completed Preapproval Task Authorization Form encompassing the scope of work described
above must be received in this office prior to the start of any tasks for which you intend to seek
reimbursement. Upon completion of any preapproved activities, you should submit your claim promptly.
Reimbursement funds are budgeted based on completed preapprovals, but delays in reimbursement or even
denial due to a failure to meet the statute of limitations on claiming a completed task can result if the work
is not completed in a timely fashion or if claims are not submitted immediately following work completion.
