Re: Notice of No Further Action
15A NCAC 2L .0507(d)
Risk-based Assessment and Corrective Action for
Petroleum Aboveground Storage Tanks and
Other Sources - Session Law 2015-286
Former Craven Oil 1915 Glenburnie Road, New Bern
Craven County
Incident Number: 17830
Risk Classification: Low
Ranking: L 140 D
Dear Ms. Stanley:
The file for the above mentioned incident has been reviewed by the UST Section, Division of Waste
Management, Washington Regional Office. The review indicates that soil and groundwater contamination
meet the cleanup requirements for a low-risk release from an aboveground storage tank (AST) or other
source under Title 15A NCAC 2L .0202 and .0500, as modified by Session Law 2015-286, but
contamination exceeds the limits allowed for unrestricted closure of a site. Another incident (#38641)
which is also located at 1915 Glenburnie Road, filed a Notice of Residual Petroleum (Book 3523, Page
541) for both soil and groundwater with the Craven County Register of Deeds Office on December 27,
2017. This Notice of Residual Petroleum satisfies the requirements of Title 15A NCAC 2L .0507(f)(3).
Therefore, the UST Section determines that no further action is warranted for this incident. This
determination shall apply unless the UST Section later finds that the discharge or release poses an
unacceptable risk or a potentially unacceptable risk to human health or the environment. Pursuant to Title
15A NCAC 2L .0507(a) you have a continuing obligation to notify the Department of any changes that
might affect the risk or land use classifications that have been assigned.
Be advised that, as contamination may exceed the groundwater quality standards established in
Title 15A NCAC 2L .0202, groundwater within the area where contamination is present or is expected to
migrate is not suitable for use as a water supply. Be advised that as soil contamination may exceed the
residential MSCCs, the property containing the soil contamination is suitable only for industrial /
commercial use as stipulated in the Notice of Residual Petroleum (attached).
Interested parties may examine the incident file by contacting this regional office and may submit
comments on the site to the regional office at the address or telephone number listed below.
This No Further Action determination applies only to the subject incident; for any other incidents
at the subject site, the responsible party must continue to address contamination as required.
If you have any questions regarding this notice, please contact me at the UST Section Office address
or telephone number listed below.
Sincerely,
Allison Ward
