Dear Mr. Simonsen:
This Notice of Regulatory Requirement is a supplement to the Notice sent by the Underground
Storage Tank (UST) Section, Division of Waste Management, Department of Environmental Quality
(Department) on October 26, 2022, in response to the proposed corrective action alternative presented in
the October 13, 2022, Ground Water Monitoring Report.
As referenced in the prior Notice, the UST Section has evaluated the proposal and seeks additional
information related to the site risk prior to authorizing a formal Corrective Action Feasibility Study for the
various proposed injection compounds.
To that end, the Department directs you to install a type III telescoping deep monitoring well
between the core of the contaminant plume and the active Town of Plymouth - Public Water Supply Well
#1 (screened from 146’ to 185’ below ground surface) located ~400’ north of the site. Please note that this
supply well has been tracked as ‘PWS-2’ in the site reports owning to the presence of a closer supply well
at the time the release was detected: Town of Plymouth - Public Water Supply Well #2, ~175’ east of the
site, which was listed as ‘PWS-1’ due to proximity.
This deep monitoring well should have an outer casing set into the first apparent confining or semi-
confining layer encountered in the surficial aquifer, with the inner boring advanced until the top of the
potential confining unit for the Castle Hayne aquifer is reached. The boring logs previously provided for
deep monitoring well MW-31 indicate that a ‘gray silty stiff clay’ was reached at ~100’ below ground
surface (bgs) at that location. Hydrogeologic logs from the Division of Water Resources Plymouth Station
well (K 17A) and Plymouth Fertilizer Plant well (J 16N) project the start of the Castle Hayne Confining
Unit to be between ~80 and 100’ bgs in this area.
If possible, the installation and sampling of this deep well should be conducted along with the 1st
quarter 2023 sampling event directed in the Department’s prior Notice, to be included in the same report
requested for submittal no later than April 28, 2023.
If additional time is needed to coordinate appropriate equipment for this drilling effort, please notify
the Department of your intended schedule.
Effective October 1, 2004, the Department of Environmental Quality requires that all work not
determined to be an emergency response or associated with risk assessment (i.e., the Limited Site
Assessment Report, per Title 15A NCAC 2L .0405) must be preapproved if reimbursement from the
Commercial Leaking Petroleum Underground Storage Tank Cleanup Fund (Trust Fund) is anticipated. To
comply with this requirement, a completed Preapproval/Claim Authorization Form encompassing the scope
of work described above must be received in this office prior to the start of any tasks for which you intend
to seek reimbursement. Upon completion of any preapproved activities, you should submit your claim
promptly. Reimbursement funds are budgeted based on completed preapprovals, but delays in
reimbursement or even denial due to a failure to meet the statute of limitations on claiming a completed
task can result if the work is not completed in a timely fashion or if claims are not submitted immediately
following work completion.
