Dear Mr. Beasley:
The Underground Storage Tank (UST) Section, Division of Waste Management, Department of
Environmental Quality (Department) has received the Ground Water Monitoring Report dated February 4,
2021, which documents the results of a limited groundwater sampling event on January 6, 2021.
During the most recent sampling event, non-aqueous phase liquids (NAPL, or free product) was
detected in monitoring well MW-1 at a reported thickness of 0.26’. Title 15A of the North Carolina
Administrative Code (NCAC) Subsection 2L .0406(2) defines a site as Intermediate Risk if petroleum
constituents exceed certain gross contaminant levels (GCLs), many of which are defined relative to
saturation concentrations, which would be exceeded by the presence of NAPL. Accordingly, this site
remains Intermediate Risk.
To continue to evaluate the presence of NAPL in MW-1 and the stability of the NAPL plume via
the four new sentinel monitoring wells, MW-11 through MW-14, you must conduct a semiannual
monitoring event during the third quarter of 2021. A report documenting the findings of this event must
be submitted to this regional office no later than October 29, 2021.
Effective October 1, 2004, the Department of Environmental Quality requires that all work not
determined to be an emergency response or associated with risk assessment (i.e., the Limited Site
Assessment Report, per Title 15A NCAC 2L .0405) must be preapproved if State Trust Fund reimbursement
is anticipated. To comply with this requirement, a completed Preapproval/Claim Authorization Form
encompassing the scope of work described above must be received in this office prior to the start of any
tasks for which you intend to seek reimbursement. Upon completion of any preapproved activities, you
should submit your claim promptly. Reimbursement funds are budgeted based on completed preapprovals,
but delays in reimbursement or even denial due to a failure to meet the statute of limitations on claiming a
completed task can result if the work is not completed in a timely fashion or if claims are not submitted
immediately following work completion.
