Johnson Property 112 Green Acres Lane, Greensboro, NC 27410 Incident Number: 48731 / Risk Classification: Low Ranking: L60D Dear Mr. Lerew: On behalf of William T. Johnson, Pyramid Environmental & Engineering, P.C. completed the tasks required by the North Carolina Department of Environmental Quality (NC DEQ) for regulatory closure of the above referenced site/incident. As required, a Notice of Residual Petroleum (NRP) was recorded at the Guilford County Register of Deeds and the public notification pursuant to 15A NCAC 2L.0115(k) was completed for the subject property. A copy of the Conditional Notice of No Further Action (CNNFA) letter for the referenced site issued by the NC DEQ on March 16, 2023, is included as Attachment A. Site History In October 2022, Pyramid conducted a pre-purchase Phase I Environmental Site Assessment (ESA) on the subject property on behalf of the National Park Service (NPS). As part of the Phase I ESA, Pyramid installed two soil borings adjacent to an existing 550-gallon heating oil underground storage tank (UST) using a hand auger and evidence of a petroleum release was discovered in the soil boring closest to the fill port. One soil sample (SB2-7’) was collected and shipped overnight to Red Lab in Wilmington, NC for laboratory analysis. The lab results for SB2-7’ indicated total petroleum hydrocarbon (TPH) concentrations that exceeded the NCDEQ actions limits. As part of this investigation, Pyramid was authorized by the NPS and the current property owner to report the petroleum release to the NCDEQ. A copy of the 24-hour Notification (Form UST-61) with Red Lab Report and other supporting documentation is included as Attachment B. Based on the low risk classification of the site, the incident qualified for incident closure using the NRP process, which included removing the residual heating oil from the tank, excavating, and removing the UST, transporting the residual fuel and UST off-site for proper disposal, recording a NRP on the subject property with land use restrictions at the Guilford County Register of Deeds and completing the required public notification. ______________________________________________________________________________________ Final Incident Closure Letter – 112 Green Acres Lane – NCDEQ Incident # 48731 2 Pyramid Environmental & Engineering, P.C. 04/06/23 Removal of Heating Oil UST On March 9, 2023, one 550-gallon heating oil UST was removed and permanently closed at the site by Fulp Environmental. Prior to removing the UST, 35 gallons of residual fuel was removed from the tank. The residual fuel and UST were transported off-site for proper disposal by Fulp Environmental. Copies of the Certificates of Disposal for the UST and residual liquid are included in Attachment C. Water Supply Well Abandonment On March 10, 2023, the on-site inactive water supply well was properly abandoned by Pyramid NC Certified Driller Timothy D. Leatherman (NC License #2888-A). The water supply well was abandoned using a mixture of 3,000-psi cement and pea gravel in accordance with the NCDEQ, Division of Water Resources well abandonment guidelines and Guilford County Health Department requirements. The Guilford County well inspector was on site during the well abandonment and approved the work. Copies of the Well Abandonment Records and Well Abandonment Detail diagram are included in Attachment D. Notice of Residual Petroleum On March 15, 2023, a Notice of Residual Petroleum was recorded for the subject site at the Guilford County Register of Deeds in Deed Book R 8709, Pages 2541-2544. The NRP includes groundwater and soil restrictions. A copy of the recorded NRP is included as Attachment E. Public Notification On March 20, 2023, public notification letters were prepared by Pyramid and mailed to the Greensboro Mayor, Greensboro City Manager, Guilford County Manager, Guilford County Department of Public Health, and to the owners of all properties that are adjoining or adjacent to the subject site. After a three-week waiting period, four signed return receipt cards were received by Pyramid. Copies of the of the seven certified mail receipts and four signed return receipt cards are included in Attachment F. Incident Regulatory Closure Having completed the activities required in the CNNFA letter dated March 16, 2023, Pyramid, and William T. Elm Street, Suite 209 Greensboro, NC 27408 Re: Conditional Notice of No Further Action 15A NCAC 2L .0407(e) Risk-based Assessment and Corrective Action for Petroleum Underground Storage Tanks Johnston Property 112 Green Acres Lane Greensboro, Guilford County Incident Number (if applicable): 48731 Risk Classification: Low Ranking: L60D Dear Mr. Johnston: Information received by the UST Section, Division of Waste Management, Winston-Salem Regional Office on October 24, 2022 and the Notice of Residual Petroleum received on March 15, 2023 have been reviewed. The review indicates that soil and groundwater contamination meet the cleanup requirements for a low-risk noncommercial site under Title 15A NCAC 2L .0202 and .0400, as modified by Session Law 2015-241, but contamination exceeds the limits allowed for unrestricted closure of a site. The UST Section determines the subject incident to be eligible conditionally for no further action status. However, final approval of no further action status is contingent on the filing of the approved NRP with the Register of Deeds in the county in which the release is located, verified by the receipt of a certified copy of the filed NRP by this office; and on receipt of confirmation that public notice requirements have been completed, as described in the following paragraphs. Be advised that, as contamination may exceed the groundwater quality standards established in Title 15A NCAC 2L .0202, groundwater within the area where contamination is present or is expected to migrate is not suitable for use as a water supply. Be advised that as soil contamination may exceed the residential MSCCs, the property containing the soil contamination is suitable only for restricted residential use ("residential" being inclusive of, but not limited to, private houses, apartment complexes, schools, nursing homes, parks, recreation areas and day care centers), as stipulated in the Notice of Residual Petroleum (attached). As groundwater contamination may exceed the groundwater quality standards established in Title 15A NCAC 2L .0202, and soil contamination may exceed the residential MSCCs, pursuant to NCGS 143B- 279.9 and 143B-279.11, you must file the approved Notice of Residual Petroleum with the Register of Page 2 of 2 Deeds in the county in which the release is located and submit a certified copy to the UST Section within 30 days of receipt of this letter. As groundwater contamination may exceed the groundwater quality standards established in Title 15A NCAC 2L .0202, and soil contamination may exceed the lower of the residential or soil-to-groundwater MSCCs, public notice in accordance with 15A NCAC 2L .0409(b) also is required. Thus, within 30 days of receipt of this letter, a copy of the letter must be provided by certified mail, or by posting in a prominent place, if certified mail is impractical, to the local health director, the chief administrative officer of each political jurisdiction in which the contamination occurs, all property owners and occupants within or contiguous to the area containing contamination, and all property owners and occupants within or contiguous to the area where the contamination is expected to migrate. Within 60 days of receiving this letter, this office must be provided with proof of receipt of the copy of the letter or of refusal by the addressee to accept delivery of the copy of the letter or with a description of the manner in which the letter was posted. Interested parties may examine the incident file by contacting this regional office and may submit comments on the site to the regional office at the address or telephone number listed below. Petroleum odor was detected at 7 feet in the soil boring (SB-2) closest to the fill pipe. Sample SB-2-7' was prepared in a container supplied by Red Lab and shipped via FedEx Ground to the lab in Wilmington for analysis.
