OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0203(d) states: By receiving solid waste at a permitted facility, the permittee shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” 1. Permit to Operate No. 65-05 ATTACHMENT I, PART I, General Facility Permit Condition # 6 states: “Construction or operation of this solid waste management facility must be in accordance with the Rules 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Should the approved plan and the rules conflict, the rules shall take precedence unless specifically addressed by a permit condition. Failure to comply may result in compliance action or permit revocation.” a. Permit to Operate No. 65-05 approved Operation Plan, Section B, Number 2, Part IV states in part:
“Time in storage varies according to the volume of waste received, though no waste shall be stored for longer than one year from the date of acceptance.”
2. Permit to Operate No. 65-05 ATTACHMENT III, PART V, General Facility Permit Condition Number 12(b) states: “The maximum period of accumulation for all HHW stored at the facility shall be no more than one year after initial receipt.”
Orange County is in violation of 15A NCAC 13B .0203(d) in that two drums were observed in a storage building with an accumulation start date older than one year.
ADDITIONAL COMMENTS
On June 9, 2023, Chuck Kirchner met with Lee Cloer, Tyler Lunsford and Clyde Dickey with Orange County Solid Waste to conduct a comprehensive inspection of the Walnut Grove Household Hazardous Waste Facility on Walnut Grove Church Road in Cedar Grove, Orange County.
1. The facility is a permanent household hazardous waste (HHW) facility owned by Orange County. 2. The facility is located at the Walnut Grove Church Road Convenience Center.
3. The facility is open Monday, Tuesday, Thursday, and Friday 7:00 am to 6:00 pm, Saturday 7:00 am to 5:00 pm, and Sunday 1:00 pm to 6:00 pm. The facility is closed on Wednesday.
4. The facility household hazardous waste generator identification number is NCPH0681302.
5. Orange County Solid Waste is the operator of the HHW facility and Orange County Solid Waste has contracted with Tradebe, Inc. to manage the waste at this facility.
6. Add a copy of the permit to the permit book as discussed in the field. The March 3, 2020 permit was discussed
during this inspection.
7. The facility contingency plan is included in the Operations Plan, dated 7/16/2019 (FID 1323972). The contingency plan was reviewed.
8. Waste is only received from Orange County residents.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

9. Resident zip codes are recorded on a daily log when the residents drop off HHW. This is a new
procedure that Orange County Solid Waste is conducting. Records were reviewed for May 27, 2023 through June 9, 2023. Older records are kept at the office and Mr. Lunsford stated that they are available for further review.
10. No unacceptable waste was observed at the facility during this inspection. Unacceptable wastes that must not be collected at this site include radioactive materials, infectious or biological wastes, explosives/shock sensitive material, organic peroxides, ammunition, friable asbestos wastes or material and polychlorinated biphenyls (PCB) with the exception of fluorescent light ballasts and PCB household waste. 11. If unacceptable waste is brought to the facility, it may be accepted for appropriate disposal.
12. The facility stores HHW in a three-compartment chemical storage building (self-contained unit), each compartment is separate from the other. Access is via a steel door to each compartment. The first compartment is currently used to store propane tanks, old fire extinguishers, foam aerosol cans and fluorescent bulbs. The second compartment is used to store aerosol cans, corrosive or toxic liquids and some toxic solids like packages of fertilizer or pesticides. The third compartment is used to store flammable liquids, oil and latex paints. 13. Household hazardous waste is sorted by class and poured into 55-gallon drums or are kept in their original container and collected into 55-gallon drums, plastic drums or 5-gallon buckets depending on size and quantity
of waste being collected. 14. Product accumulation labels were observed on bulked material drums. Two drums were older than one year but had a very small amount of propane tanks in them. All other drums appeared to be in compliance. See Observed
Violations above. 15. The three-compartment chemical storage building is equipped with secondary containment located underneath the floor of each compartment. Secondary containment is isolated by compartment. 16. The three-compartment chemical storage building secondary containment does not have sump outlets. Secondary containment will have to be pumped-out if used. 17. Located west of the chemical storage building is two open walled sheds used for additional HHW
material collection. 18. The first shed has a large used oil can and a recycle antifreeze tote. Both containers were observed to be in good condition. In addition to the oil and antifreeze, lithium and dry cell batteries are currently
collected in this shed. 19. The second shed has a pallet where used car batteries are collected. One 96 gallon covered plastic trash cans where compost materials are collected and a container to collect used cooking oils.
20. Located to the west of the two sheds is a walled shed that is used for equipment storage. No HHW material is stored in this shed.
21. Household hazardous waste may be collected outside but may only be stored outside of the three-compartment chemical storage building if properly sealed and ready for shipment and placed on secondary containment pallets.
22. The facility attendant building is adjacent to the three-compartment chemical storage building.
23. Clyde Dickey with Orange County Solid Waste is certified, trained by the EPA, in 8 Hour HAZWOPER facility operations.

24. The following are NCSU 40 Hour HAZWOPER certified personnel, trained in facility operations:

25. Lou Capitanio, Kevin Bragg and William Benjes have attended a HAZWOPER course with Trainex and are
currently awaiting certificates to be mailed.
26. Mr. Dickey stated that Tradebe, Inc. staff is on site usually one time per week and generally picks up HHW from the facility weekly. Two to six drums of HHW are usually picked up each week according to the manifests.
27. Noble Oil picks up the used oil, oil filters and anti-freeze. Ket Energy picks up the cooking oil and Brooks Compost picks up the compost material.
28. The three-compartment chemical storage building is equipped with a fire suppression system. 29. There are two portable fire extinguishers. 30. The facility has an eyewash station that contains two eyewash bottles.
31. The facility maintains an adequate supply of absorbent material.
32. Emergency equipment is inspected weekly. Records observed January 4, 2023 through June 8, 2023.
33. Tradebe Inc. sends the facility a Uniform Hazardous Waste Manifest of material received (by generation date) for verification of the material shipped out. Records were observed from July 19, 2019 through June 2, 2023. Materials were shipped out to Tradebe Treatment and Recycling, LLC, EPA ID Number IND00064693.
34. The facility annual report (FAR) was received by the SWS, dated July 21, 2022. Facility throughput for July 2021 through June 2022 is 56,185 lbs. 35. The convenience center accepts municipal solid waste (MSW), white goods, electronics, scrap tires, clean wood, yard waste, cooking oil, antifreeze, used oil, motor vehicle oil filters, batteries, food waste, plastic film, metal, aluminum, paper, cardboard, glass and plastic bottles, and textiles. Collected materials are stored in containers. 36. The Caldwell Fire Department and/or the Cedar Grove Volunteer Fire Department can be contacted to address an emergency at the facility. 37. Orange County Solid Waste staff are on site during operating hours. 38. The site is secured by a locked gate. County personnel also work in the convenience area. 39.
