The Division may establish alternative site-specific buffers in the permit conditions if it is necessary for the preservation of public health and the environment. 2. 15A NCAC 13B .0563 (4)(c) - A permit shall not be required for a site that meets the following conditions (in part): the site disposal area does not exceed two contiguous acres in size; Andrew Hammonds and David Powell with the Section inspected the Harris NLCID for a routine comprehensive inspection. It was observed, upon inspection, that waste disposal is approximately two and half acres for the NLCID during inspection, which is not a permitted LCID. A laser range finder was used by David Powell to measure the limits of disposal, from Edge of Waste (EOW) marker to marker. One side measured FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 approximately 145 yards and the second side measured approximately 85 yards. It was noted that the sides were not straight, and the landfill was not “square shaped”, however, it was apparent that some waste was beyond the limits of the approved two-acre disposal. To be larger than two acres a permit is required, and this site only has a notification. In addition, upon researching the deed work on the counties GIS system online, it was determined that the notification was on a two-acre parcel of land, PARCEL ID 842900038311, leaving no room for buffers to property lines. Waste must be pulled back inside to meet the limits of two acres for disposal. The landfill must meet the 100-foot buffers to property lines surrounding the landfill and the property lines should be expanded to meet this rule in the minimum. This parcel can be merged with the larger tract or just expand the current parcel to meet buffer rules. EOW markers should be installed to mark the two-acre limits of disposal, and new property lines marked so that they can be confirmed by Section staff upon follow-up. In addition, please remember there is a requirement for permitting or closing Notified Land Clearing Inert Debris Landfills across the state. It would be beneficial for the owner to look at which option they would like to pursue, use this time for corrective actions and to also work toward the final closure or permitting needs. This would make good use of their time and resources. Copies of the 2021 LCID rules and the NLCID Closure Requirement Letter, from Solid Waste Section Chief Edward Mussler, dated 10/6/2021, will be sent with this inspection report to Harris Trucking. ADDITIONAL COMMENTS 1. The NLCID is on a property with a large mine, owned and operated by Harris Trucking. Road access was pretty good, but some grading is needed. The site has a gate and signage. The signage needs to be repaired to meet rule 15A NCAC 13B .0566. Currently, the top sign is covering part of the sign below it, which it is assumed those words are, “WE DO NOT…” because what’s left says that the landfill accepts wastes that are not approved for this site or an LCID. Please fix the signage to meet rule below, including adding NLCID number for this site, which is N1103. 15A NCAC 13B .0566 (14) - A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 2. The side slopes were well shaped and at 3:1 or better for most sides. The north side was steeper than 3:1 and needs to be sloped better. Erosion rills were visible on all sides of the structure, which needed repair. Some older waste was visible along the access road to the top of NLCID. Cover should be added every 30 days or when reaches one acre in size, whichever occurs first. After inspection, Mr. Powell spoke with Mr. Chad Harris, and he indicated no waste has been disposed of at NCLID in many months. Please address cover and erosion and fix sloping to 3:1 on all sides. EOW markers were visible onsite but its unsure if they accurately mark the approved two acres of disposal based on laser range finder measurements taken during inspection. Please check and correct the EOW markers to mark the approved two acres NLCID, with respect to the limits of disposal and property lines. Property lines need to be moved with deed work and some waste needs to be pulled back inside a total of the two-acre limit of disposal. Once the issues are fixed, then the four EOW corner markers should be installed to mark the correct corner, limits of waste disposal and with respect to property lines buffers of at least 100 feet. Section assigned permitting engineer for Richmond County is Mr. Ming Chao, whom will be retiring at end of June 2023, and so all correspondence should go to Sherri Stanley until she delegates those duties to another in Section permitting. Corrective measures are necessary as a result of this inspection and should be met within 60 days receipt of this inspection. Failure to meet the conditions for compliance may result in Compliance Actions. A follow-up inspection in the future will be needed to confirm the corrective actions have been taken. Given the nature of the situation and the corrective actions, it may take longer time. If additional time is needed, please communicate with Mr. Powell, and discuss before the end of the deadline timeframe.
