Yard Waste Area is a YWN and under 7703T-TRANSFER-1994 PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The purpose of this inspection was to conduct a follow up on the yard waste area and the removal of the older waste as previously identified. This visit to the Richmond County site was also for the Pre-operation of an Air Curtain Incinerator, T and P Permit, on the other side of property which should be the new way of managing the yard waste at this facility once in operation. It should be noted that a previous meeting involving Richmond County Bryan Leggett and Jerry Austin, along with Smith and Gardner Mike Brinchek, Solid Waste Section staff Jason Watkins, Andrew Hammonds, Sherri Stanley, and David Powell was conducted on 5/24/2023 virtually, to discuss a proposed LCID landfill in the area near, and possibly including the YWN. The YWN part of this meeting resulted in an agreement that Richmond County will submit a Corrective Action Plan to the Section for managing all the new waste onsite, as well as identifying a “good faith effort” in addressing the older yard waste remaining in the yard waste notification. The Section awaits an LCID application for review. The Corrective Action Plan (CAP) was received by Section on 5/30/2023. All new waste should be utilized according to rule, and the older waste should continue to be utilized according to rule, in a good faith effort, until a permit/approval from the Section permits an alternative or the waste is removed down to soil. 2. It’s understood the ACI will take the flow of new yard waste and the YWN will not receive any waste so that the older and newer wastes at that location can be removed without continuing to lose ground to even newer wastes interfering with the sites cleanup. The County wishes to keep the YWN incase unforeseen circumstances arise in which it may be needed. Upon inspection of the YWN, Simmons and Simmons were onsite mulching and windrowing the newer waste. They will also haul some of the mulched newer waste to Central Carolina Holdings for their landfill to use on side slopes according to Mr. Leggett. The NE part of the notification had the older waste previously removed and soil replaced and graded. Between this area, which had the older waste removed, and the rest of the notification, further south, there is now a large ditch which leads to rear of notification, eastern side. Mr. Leggett explained this is the separation from cleaned up area, with the older waste removal and replaced with soil, and the rest of the notification which has not had the older waste removed yet. This ditch has leachate collecting, although not leaving site, but could potentially with right conditions. There is also some of the newer yard waste in this leachate, please remove all waste from the water. Please address and ensure there is no runoff. The ditch should be buffered 25 feet on each side like a swale/berm per 15A NCAC 13B .1404. Looking into the side profile of this ditch, on the side of the notification with older waste yet removed, it’s visible to see many feet of undecomposed and unmulched waste in the cross section of that area. 15A NCAC 13B .1406 (4) - Leachate shall be contained on site or treated prior to discharge. A National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to the discharge of leachate to surface waters. Leachate and unapproved wastes. Wood wastes were visible several feet deep in the cross section of the ground in this area, where older waste removal was previously halted. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 7 Stormwater should be diverted from compost area; no waste shall be in water and leachate shall not be allowed to discharge. 4. The YWN also has newer yard waste across most of the notification with minimal separating of windrows/composting areas. Mr. Leggett instructed onsite workers to alter operations and add more separation of windrows while onsite. Unapproved waste piles, removing unapproved wastes were visible during inspection. Based on discussions and previous onsite inspections, some of the mulch onsite at the YWN has and will be used for erosion control, vegetation establishment and additional cover dressing for the closed MSW and other areas around the County landfill site. Be sure not to use more than 3 inches in depth and mulch YW cannot be used for Beneficial Fill. Older and more broken down, or composted over time, YW can also be utilized in this manner as well. No yard waste/mulch should go to the Public unless it meets the 15A NCAC 13B .1406 rules. 6. In future, better placement and sizing of the windrow should be emphasized to minimalize one windrow from catching the others on fire. It is unknown if that would have helped in this fire but be sure and remember lessons learned during this event to try and prevent it from reoccurring in the future. Transfer Station Permit Attachment 3, Part (7), 21 - The permittee must store or stockpile the received waste or processed/ground material (such as mulch) in the following manner: a. Each windrow has the maximum height of 30 feet and the width of 50 feet at any time. b. Each windrow shall be maintained at least 25-foot clear distance or perimeter from drainage ditches and swales, around the processing area, and other stockpiles of raw wastes and ground material to allow for inspection, monitoring temperature, or firefighting. c. Each windrow shall be maintained at least 50-foot clear distance from property boundaries. 7. Some Edge of Waste (EOW) markers were present and represent the limits that are being used currently. However, they need to be reinstalled in correct locations once work onsite is completed. Be sure the accurately mark the 2 acre or less notification as well as comply with buffers. 8. Consult the Sections Permitting Branch Head Sherri Stanley, sherri.stanley@deq.nc.gov or (919) 707 – 8235, for approval before altering any process/plans at the permitted facilities. Mr. Ming Chao will be retiring at end of June 2023 and so all correspondence should go to Sherri Stanley until she delegates those duties to another in Section permitting. 9. Corrective measures are necessary as a result of this inspection and should be met within 60 days receipt of this inspection. Failure to meet the conditions for compliance may result in Compliance Actions. The county is transitioning to their new ACI and should be removing waste from the YWN, both old and new, to clean up the site. A follow-up inspection in the future will be needed to confirm the corrective actions have been addressed. Given the nature of the situation and the corrective actions, it may take longer time. If additional time is needed, please communicate with Mr. Powell, and discuss before end of the deadline timeframe.
