STATUS OF PERMIT:
PTO issued June 24, 1997. In accordance with North Carolina General Statute 130A-294 (a2) this permit is for life-of-site. Life-of-Site ends when the facility reaches its final permitted elevations or by June 24, 2057. PURPOSE OF SITE VISIT: Cell 6B pre-operation meeting and Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS:
A. 15A NCAC 13b .1626 (2)(b), “Except as provided in Sub-Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors
and scavenging, and to minimize fires and the generation of odors.” UNRESOLVED: The overall amount of exposed waste was greatly reduced. However, exposed waste was
observed on the northern side slope and along the access road to the working face. Additional cover soil will need to be applied over areas of exposed waste prior to seeding and stabilization of these areas. OBSERVED VIOLATIONS: B. 15A NCAC 13B .1626 (8)(d), “Leachate shall be contained within a lined disposal cell or leachate collection and storage system. All leachate shall be treated, as required by the receiving facility, prior to discharge.” RESOLVED: A soil sampling plan and supporting documentation was submitted to the Section on 2/28/23, approved on 3/7/23, and an abatement report containing sample analytical results was submitted on 5/18/23.

Impacted soil within the stormwater drainage ditch was removed, sampled for contaminants, and disposed of within the active section of the landfill. On 5/25/23, Ervin Lane, Section Hydrogeologist, issued a letter stating that the leachate release abatement has been concluded and no additional assessment is required.
ADDITIONAL COMMENTS Construction of a new disposal cell (6B) on the north side of the landfill has been completed. Allen Gaither, Tim Davis, and Ervin Lane, representing NCDEQ, conducted a pre-operation meeting with Matt Einsmann and Scott Harless of Republic Services, Matt Cheek of HHNT, and Dylan Van Den Berg of TRC.
1. New vegetative growth has been established in some areas that lacked vegetative cover during the previous inspection. The upper areas of the northern side slope, on the western side slope, and slopes along the access road to the working face all contained new vegetative cover. Mr. Harless stated that he is now utilizing mulch generated from the landfill gas collection station which is aiding his efforts. Good job! 2. Erosion rills remain an ongoing issue and were present in multiple areas within the non-vegetated portions of the side slopes, most notably on the lower portion of the northern slope adjacent to the new 6B cell. Erosion rills were
also identified within some vegetated portions of the southern and western side slopes. Continue to ensure erosion rills are repaired, properly graded as soon as practical, and vegetated. Ensure that any exposed waste in the erosion rills is properly covered during the repairs. 3. During this inspection, exposed waste was observed on the north side slope where it meets 6B and on the top of the landfill adjacent to the current working face. On the evening of 6/1/23 Mr. Harless texted pictures showing the exposed waste on top of the landfill had been covered. Ensure any areas of exposed waste are covered with additional soil, regraded to ensure proper drainage, and vegetated. 4. Ensure that intermediate soil is being applied as required in .1626 (2) (d).
5. During this inspection, it was noted that a large amount of sediment had washed down from the north side slope and collected on the 6B cell HDPE geomembrane liner and within the stone protective cover layer. Two leachate seeps were also observed along the toe of the north side slope where it meets the new 6B cell. Mr. Einsmann stated that the
erosion was caused by recent heavy rains and these areas would be repaired as soon as possible. Ensure that any sediment is removed from the liner and protective cover layer and that any leachate seeps are repaired in a timely manner and monitored as needed. Stormwater in the new cell should be evaluated should the leachate seep onto the liner. Stormwater impacted by leachate shall be collected and treated as leachate and not pumped and discharged. 6. During this inspection, newly installed groundwater monitoring wells #11 and #12 were found to be properly locked but missing identification plates. Mr. Harless emailed pictures of these monitoring wells with proper identification plates affixed on 6/5/23.
7. The stormwater drainage channel along the base of the northeastern side slope was again observed to be full of red clay mud and sediment. Mr. Harless stated that this section of channel was cleaned out 2 weeks prior, but the recent heavy rains coupled with the exposed soil of the new 6B cell caused it to become filled again. Stormwater drainage ditches should be cleaned out to ensure that they function properly. 8. During this inspection, facility staff were observed actively mowing the vegetative cover and picking up windblown waste on the side slopes and along the top of the landfill. Good job!

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
