HomeMy WebLinkAboutWS-6406_24174_G_ELIG_20070220 February 20, 2007 CERTIFIED MAIL RETURN RECEIPT REQUESTED 7005 0390 0001 3553 8557 DOROTHY D & FRANCES D FAGGE 3359 OLD LEXINGTON RD ASHEBORO, NC 27205 RE: Former Caraway Grocery 3359 OLD LEXINGTON RD ASHEBORO, Randolph County NC DWM Incident #24174 Dear Dorothy and Frances Fagge: The Winston-Salem Regional Office (WSRO) has referred the subject site to the North Carolina Underground Storage Tank (UST) Trust Fund Branch, for inclusion on the list of sites awaiting cleanup. According to information on file with the Division of Waste Management (DWM), petroleum contamination was discovered at the site during March 2002, and USTs remain at the site. In a letter to Mr. Randell Williamson dated February 15, 2007, the DWM accepted the referenced site into the State Lead cleanup program. A copy of the February 15, 2007 letter is attached. The site was accepted into the state lead program because Mr. Williamson refused to address the contamination resulting from the USTs. According to the information on file, you are not considered to be an owner or operator of the USTs pursuant to G.S. 143-215.94A To determine the risk posed by the contamination at the subject property, the UST Section will need access to the property. To conduct assessment and remedial activities, it may be necessary to drill soil borings, install groundwater monitoring wells, or excavate contaminated soil. An access agreement for the purpose of conducting the required work is attached. Please sign the attached site access agreement letter and return to the address indicated on the letter. Please understand that failure to allow access to the property could potentially make you responsible for the cleanup under other State and Federal regulations. If the conditions of the access agreement are unacceptable, you may apply for eligibility to the Former Caraway Grocery 3419 Old Lexington Road Asheboro, NC February 20, 2007 Page 2 Commercial Underground Storage Tank Trust Fund as the landowner, pay the appropriate deductible, and hire a consultant to handle the assessment and remediation activities.
