According to information available to the Division of Waste Management, underground storage tanks formerly operated at the referenced site, released petroleum products into the environment. Furthermore, on February 3, 1994, the DWM received correspondence from Vernon Poole & Company, Inc., indicating that you purchased three pumps and two underground storage tanks at the site on January 17, 1994. Since you are unwilling or unable to assess or remediate the petroleum constituents that leaked from the system, the DWM is accepting the project into the State Lead Program of the UST Section. According to Division records the UST system was last used in January 1994; therefore, you are considered to be an owner or operator of the USTs pursuant to N.C.G.S. 143-215.94A. The UST Section must inform you that we are mandated to seek the recovery of funds for costs related to all activities performed by the Trust Fund Branch in specific situations. Failure to pay these costs may result in the referral for cost recovery to the North Carolina Attorney General's Office.
