Hull Silver Hare Racing, LLC PO Box 5778 High Point, NC 27262 RE: Notice of No Further Action 15A NCAC 2L .0407(d) Risk based Assessment and Corrective Action for Petroleum Underground Storage Tanks 301 Old Thomasville Road High Point, Guilford County, NC (WSRO) STF Incident Number 13799 Risk/Rank: Low, L019R Dear Mr. Hull: A petroleum release was identified at the referenced site during tank removal activities in June 1990. On June 18, 1990, Aquaterra conducted a closure assessment for two underground storage tanks (USTs) that were located near the garage: one 10,500-gallon #2 fuel oil UST, and one 250-gallon used motor oil (waste oil) UST. Petroleum contaminated soils were removed from beneath each tank, and the 10,500-gallon tank received clean closure. However, 360 mg/kg Oil and Grease was identified in one of the confirmation soil samples collected beneath the waste oil tank. The Responsible Party, Alma Desk Company, was dissolved in 1994, and no further assessment work was conducted. The incident was referred to the State Lead Cleanup Program in 2011, but by that time the tank basin was covered by a building, and risk-based samples could not be collected from the source area. We recently reviewed the file, and the confirmation soil sample results beneath the waste oil tank were 5.1 mg/kg gasoline-range Total Petroleum Hydrocarbons (TPH), and < 2.0 mg/kg diesel-range TPH, which are below current and former action levels, so additional sampling will not be required. Based on this information, the UST Section finds it appropriate to classify the risk of the discharge or release as low. Furthermore, the UST Section determines that no further action is warranted for this incident. This determination shall apply unless the UST Section later finds that this discharge or release poses an unacceptable risk or a potential risk to human health or environment, or additional information is provided to warrant reassessment of the site. Pursuant to 15A NCAC 2L.0407(a), you have a continuing obligation to notify the UST Section of any changes that you know of, or should know of, that might affect the level of risk assigned to the discharge or release.
