Dear. Mr. Davis: The North Carolina Division of Waste Management (DWM) has accepted the referenced site into the State-Lead Program due to the fact that the responsible party was unwilling or unable to proceed with the
required activities. Due to the proximity of Beaver Creek and the presence of drinking water wells in the area, the site is classified as a high risk. Additional work will be required at the site before the site can be considered for closure, and in the future, it may be necessary to record the presence of contamination on the property deed to obtain site closure.
You have expressed an interest in purchasing the property. At this time, you do not appear to have operated the underground storage tanks at the site, or appear to be responsible for the contamination observed at the site. The DWM does not hold landowners responsible for contamination caused by other parties. However, the DWM expects landowners to cooperate in any efforts made by the State-Lead Program to assess and/or remediate such contamination. Unfortunately, since the State-Lead Program
cannot predict future regulatory changes, the DWM cannot guarantee you will never be held responsible for contamination observed at this property. If you have any questions, please contact me at [phone].
